HomeMy Public PortalAboutORD06897 ( ORDINANCE NO. 6897 AN ORDINANCE AUTHORIZING AND DIRE"CTING THE MAYOR AND THE CITY CLERK OF THE CITY OF JEFFERSON, MISSOURI, TO EXECUTE FOR AND ON BEHALF OF THE CITY OF JEFFERSON, MISSOURI, A QUITCLAIM DEED, REMISEING, RELEASING AND FOREVER QUITCLAIMING UNTO MARY WELLS, AS THE GRANTEES ALL OF THE RIGHT, TITLE AND INTEREST OF THE CITY OF JEFFERSON, MISSOURI, INTO SPECIFICALLY DESCRIBED REAL ESTATE IN WHICH THE CITY OF JEFFERSON, MISSOURI NOW HOLDS AN EASEMENT FOR SANITARY SEWS PURPOSES. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSO I, AS FOLLOWS: SECTION 1. The Mayor and the City Clerk of the City of Jefferson, Missouri, for and on behalf of the City of Jefferson, Missouri, are hereby authorized and directed to execute a quitclaim deed; thereby remiseing, releasing and forever quitclaiming all right, title and interest of the City of Jefferson, Missouri, in favor of Mary Wells as Grantee, into the following specifically described real estate in the City of Jefferson, County of Cole, Missouri: "Part- of Outlot No. 61, described more particularly as follows Beginning at a point in said Outlot No. 61 which point is 5 .0 feet easterly from the westerly line of said Outlot and 175.0 northerly from the south line thereof; thence from said point easterly parallel with the southerly line of said Outlot 150.0 feet; thence northerly parallel with the westerly line of said Outlot 131 feet 3 inches; thence westerly parallel with the voutherly line of said Outlot 150.0 feet; thence southerly parallel with the westerly line of said Outlot 131.0 feet 3 inches to the point of beginning." "Also, a part of Outlot No. 61, described more particularly as follows: Beginning at a point on the southerly line of said Outlot which point is 5 feet easterly from the southwesterly corner of said Outlot; thence from said point easterly along the southerly line of said Outlot 150.0 feet; thence northerly parallel with the southerly line of said Outlot 43 feet 9 inch s; thence westerly parallel with the southerly line of said Outlo 150.0 feet; thence southerly parallel with the westerly line o said Outlot 43 feet 9 inches to the point of beginning." LO D AND JANET R. LORD AND THOMPSON F. WILLIS AND ERMA E. WILLIS, FOR TH PURCHASE OF CERTAIN REAL ESTATE BY THE CITY OF JEFFERSON, MISSOURI, FOR THE SUM OF FIFTEEN THOUSAND ($152000 .00) DOLLARS, AND ENACTING NEW ORDINANCE PERTAINING TO THE SAME SUBJECT. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI AS FOLLOWS: t*[ ) ECTION 1. Willis for the purchase of certain real estate by the ity of Jefferson, Missouri, for the sum of Fifteen Thousand $15,000.00) Dollars , be, and the same is hereby repealed. ECTION 2. The Mayor and the City Clerk of the City of Jefferson, ssouri, are hereby authorized and directed for and on behalf of the ity of Jefferson, Missouri, to execute a contract with George W. Loi d nd Janet R. Lord and Thompson F. Willis and Erma E. Willis relating to he purchase of certain specifically described real estate by the Ci y f Jefferson, Missouri, for the sum of Fifteen Thousand ($15,000.00) 1 ollars. ECTION 3. Said contract shall be in words and figures as follows: CONTRACT FOR THE SALE OF REAL ESTATE THIS AGREEMENT made this 24th day of March, 1960, between the ity of Jefferson, Missouri, a municipal corporation of the third lass, existing under the laws of the State of Missouri by and hrough its Mayor, C. Forrest Whaley, Cole County, Missouri, party o he. first part, and George W. Lord and Janet R. Lord, his wife, and hompson F. Willis and Erma E. Willis, his wife, of Cole County, Missouri, arties of the second part. WITNESSETH: 1. First Party agrees to buy and the Second Parties agree to sel 1 he following described tract of land located and situated within th ity of Jefferson, County of Cole, Missouri, and more particularly escribed as follows: Part of the northeast quarter of Section 12, Township 44, Range 12, more particularly.'described as follows: Beginning at a point on the southerly line of Dunklin Street where the Range line between R 11 W. and Range 12 W. intersects said southerly line of Dunklin Street in the City of Jefferson, Missouri, thence North along the Range line between Range 11 W. and Range 12 W. , a distance of 19 .8 feet; thence turning an angle of 50 degrees 15 minutes to the left for a distance of 42.0 feet to the southerly right-of-way line of U. S. Highway No. 50 ; thence in a westerly direction along and with said southerly 'line of Highway No. 50 a distance of 34.3 feet; thence in a southeasterly direction along a curve - to the right for a distance of 59 . 16 feet more or less; said curve having a radius of 152. 18 feet and being tangent to the southerly right-of-way line of Dunklin Street extended at a point 18 .46 feet northwesterly of the point of beginning; thence southeasterly along the extension of the southerly right-of-way line. of Dunklin Street to the point of beginning. 2. The above described land is all of that portion of the land fX.ich lies within the black lines, which black lines in turn are enc osed by e red lines as said tract of land appears on the survey of David Brown, registered land surveyor, which is attached hereto marked he "A" and made a part of this contract by reference. 3. First Party agrees to use the above described property as right-of-way for the extension and widening of Dunklin Street per he plan attached hereto, marked Exhibit "B" and made a part of this ontract by reference. 4. Second Parties agree to convey said premises to the First arty, free from all encumbrances, for public street right of way urposes by a warranty deed, provided that, if said premises cease to be used for public street right of way purposes at any time within a period of thirty five years, said property shall revert to the then owners of the adjacent tract of land of which the above described premises is now a part, and provided further that if said premises shall be continuously used for public street right of way purposes for a period of thirty five years, then the title to said premises shall become and vested in the First Party in fee simple absolute. 5. The consideration to be paid by the First Party to the Sec nd Parties for said land shall be Fifteen Thousand ($15,000) Dollars, subject to the further provisions of this agreement. 6. Second Parties shall pay all takes for the year 1959 and prior years. Second Parties shall pay 5/8 of the taxes for the year 1960 on the entire tract of land of which the premises described above is a part. 7. Second Parties shall deliver unencumbered possession of th premises and a warranty deed to the premises on April 1, 1960, or a soon thereafter as requested by the First Party. 8. First Party shall deliver its check in the amount of Fifte n Thousand ($15,000) Dollars to Second Parties on April 1, 1960; provided, in the event the First Party fails to deliver a check for the purchase price to the Second Parties on April 1, 1960, then the First Party will pay to the Second Party the sum of One Hundred Twenty-Five ($125.00) Dollars per month for each month which passes between April 1, 1960 and the date of payment of the purchase price to the Second Parties. 9 . Second 'Partkes shall contribute and pay the sum of Fifty ($50.00) Dollars for the demoiition and razing of all structures wh ch are entirely or partially located on the above described premises to the contractor engaged to demolish or raze said structures.
