N ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR AND THE CITY CLERK
F THE CITY OF JEFFERSON, MISSOURI, TO EXECUTE A CONTRACT, FOR AND
N BEHALF OF THE CITY, WITH HUGH STEPHENS AND BESSIE MILLER STEPHENS
F JEFFERSON CITY, MISSOURI, UNDER THE TERMS OF WHICH CONTRACT THE
ITY OF JEFFERSON, MISSOURI, SHALL BE GIVEN AND HAVE THE RIGHT OF
URCHASING CERTAIN DESCRIBED REAL ESTATE AND THE IMPROVEMENTS THEREO
OR MUNICIPAL OFF STREET PARKING LOT PURPOSES, AND AUTHORIZING THE
YOR OF SAID CITY TO ACCEPT A WARRANTY DEED FROM HUGH STEPHENS AND
ESSIE MILLER STEPHENS WITHIN THE TIME MENTIONED IN SAID CONTRACT, AZD
URSUANT TO THE TERMS OF SAID CONTRACT TO PAY HUGH STEPHENS AND
ESSIE MILLER STEPHENS THE SUM OF ONE HUNDRED AND SEVENTY ($7.70,000. 0)
'HOUSAND DOLLARS AS THE PURCHASE PRICE OF SAID REAL ESTATE AND
IMPROVEMENTS THEREON.
E IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOUR ,
S FOLLOWS:
ECTION 1. The Mayor and the City Clerk of the City of Jefferson,
.seouri, are hereby authorized and directed for and on behalf of
he City to execute a written contract with Hugh Stephens and
essie Miller Stepehns relating to the purchase by the City of
efferson, Missouri, and the sale by Hugh Stephens and Bessie Miller
tephens of certain specifically described real estate for munidipal
ff street parking lot purposes.
ECTION 2. Said contract shall read in words and figures as follows
CONTRACT FOR SALE OF REAL ESTATE
This agreement made this day of April, 1960, by and
etween Hugh Stephens and Bessie Miller Stephens of Jefferson City,
issouri, hereinafter called First Parties, and the City of Jefferson,
issouri, a municipal corporation, hereinafter called The City,
iTNESSETH:
WHEREAS, The City has heretofore determined that it desires to
acquire the property of First Parties hereinafter described for a
unicipal off-street, public parking lot under the authority of
ection 71.350 R.S. Mo. 1949, and has taken appropriate action to
cquire said property, has notified First Parties of its intention
o acquire said property and has made First Parties an offer to
urchase the said property, and,
WHEREAS, First Parties have determined that they will sell sai
roperty to the City, without requiring The City to resort to
ondemnation proceedings:
NOW THEREFORE, It is agreed by and between the Parties hereto s
ollows:
1. First Parties hereby agree and bind themselves to -sell, an
o hereby sell, and The City does hereby agree to bind itself to buy ,
he following described property to The City, said property being to
ated in Jefferson City, Cole County, Missouri, and being described
S follows:
Part of Inlots No. 339 and 340 of the City of Jefferson,
County of Cole and State of Missouri, dexcribed as follows:
Beginning at a point at the northwest corner of said Inlot
No. 339, thence eastwardly along the southern line of
Capitol Avenue (formerly Main Street) 156' 6-3/4" to a
point, thence southwardly 204' , more or less, to the
southern line of Inlot No. 340, thence westwardly along
the southern line of said Inlot No. 340- a distance of
42' 2-1/4" to the eastern line of a strip 10' wide in the
Southwestern corner of said Inlot No. 340 as set forth in
deed recorded in Book 5,, page 6, in Cole County Recorder' s
Office, thence northwardl.y along the eastern line of said '
strip and parallel. with Madison Street 67' to a point, +�
thence westwardly parallel with the southern line of Capitol
Avenue (formerly Main Street) 104' , more or less, to the
eastern line of Madison Street and thence northwardly along
the eastern line of Madison Street 138' 6" to the point of
beginning. Together with all right in the strip of land in
the southwesterly corner of above Inlot which is 10 feet wide
on the south line by 67 feet on the west line which inures
by and through the deed which is recorded in Book No. 5,
page 6, Cole County Recorder' s Office, subject to all
outstanding valid leases thereon.
2. The purchase price for said real estate ;shall be the sum of
ne Hundred Seventy Thousand Dollars ($170,000.00) . The City shall
ay to the First Parties the sum of Fifty Thousand Dollars ($50,000.00)
pon execution and delivery of a Warranty Deed, and shall pay the
alance of the purchase price on or before December 31, 1960.
3. The closing date of the purchase and sale shall be on or bef re
pril 30, 1960. It is understood by The City that First Parties have
ented certain portions of the premises herein described on a month-
o-month basis and that it will be -necessary to give such tenants
tatutory notice to vacate said premises, and that it will be the
ity' s obligation to give such notice.
4. First Parties represent that they hold merchantable .title to
aid property.
5 . This agreement shall be binding upon the heirs, executor and
dministrators of First Parties.-
IN WITNESS WHEREOF, The Parties have executed this agreement in
uplicate the day and year first above written.

ECTION 3. The Mayor of the City of Jefferson, Missouri is hereby
uthorized for and in behalf of said City to accept delivery of the
warranty deed provided for under the terms of said contract within
he period of time mentioned in said contract.
ECTION 4. Upon receipt of the warranty deed mentioned in said
ontract, the Mayor and the City Clerk of the City of Jefferson,
ssouri, are hereby authorized and directed to execute a warrant of
he City in the amount of Fifty Thousand ($502000.00) Dollars as a
artial payment of the purchase price of the real estate described i
aid contract, and further, are authorized and directed to execute
urther warrants totaling in all the sum of One Hundred and Twenty
ousand ($120,000.00) Dollars in favor of Hugh Stephens and Bessie
iller Stephens and to deliver - the same to the payees on or before
ecember 31, 1960.
ECTION 5. This contract shall be in force and effect from and afte n
