kN ORDINANCE REPEALING SECTION 171 OF THE REVISED ORDINANCES OF THE
ITY OF JEFFERSON, MISSOURI, 1956, RELATING TO THE OFFICE OF POLICE
UDGE, AND REENACTING A NEW ORDINANCE PERTAINING TO THE SAME SUBJECT
E IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOUR ,
S FOLLOWS:
ECTION 1. Section 171 of the Revised Ordinances of the City of
efferson, Missouri, 1956, relating to the office of Police Judge be
nd the same is hereby, repealed.
ECTION 2. There is hereby enacted a new ordinance relating to the
ffice of Police Judge which said ordinance shall be known as
ection 171 of the Revised Ordinances of the City of Jefferson, 1956
and which ordinance shall state in words as follows:
"Section 171. Duties of the Police Judge. -- The Police
Judge shall be a conservator of the peace, and shall
have exclusive original jurisdiction to hear and
determine all complaints of offenses against the
ordinances of the city, and no change of venue shall
be taken in any trial before the police judge for the
violation of any city ordinances. He shall keep a
docket in which he shall enter every case commenced
before him and the proceedings therein. He shall state
in such docket the name of the complainant, the nature
or character of the offense, the date of the trial, the
names of all witnesses sworn or examined, the finding of
the court or jury, the judgment or fine and costs, the
date of payment, if any, the date of issuing commitment,
if any, and all other facts necessary to show the full
proceedings in each case. He shall deliver said docket
and all books and papers pertaining to his office to his
successor.
If the police judge be absent, sicl , or
unable to act, the Mayor shall designate sume suitable
person residing within the City of Jefferson to act as
Police Judge until such absence, sickness or inability
to act shall cease.
Should any vacancy happen in the office of
Police Judge at a greater length of time than six months
before a general municipal election, then a special
election shall be held to fill such vacancy, and in case
of a vacancy in said office of police judge within less
than six months of a general municipal election, the Mayor
shall appoint some suitable competent person to fill such
vacancy. Such vacancy may occur by reason of death, refusal
to qualify, resignation or removal from the city.
Said appointee, after qualifying in like -manner
as required of the police judge, shall hold his office until
the Police Judge is able to be present and act in the
performance of his duties when the Police Judge has been
absent, sick or unable to act.
