HomeMy Public PortalAboutResolution No. 001-88 01-25-1988 • RESOLUTION NO. 1- $ 8 A RESOLUTION ESTABLISHING DATE FOR RUN-0FF ELECTION FOLLOWING A REGULAR ELECTION OF THE CITY OF RICHLAND HILLS, TEXAS, FOR THE OFFICE OF MAYOR. WHEREAS, the City of Richland Hills, Texas, is a home rule city chartered under the laws and constitution of the State of Texas; and WHEREAS, the charter of the City of Richiand Hills, Texas, provides for the election of its Mayor by a majority of votes cast in a biannual election called for such purpose; and WHEREAS, Senate Bill 280 (Chapter 54, Acts of the 70th Legislature, regular session) now requires the regular annual election of officers of the City of Richland Hills, Texas, to be held on the first Saturday in May of each year; and WHEREAS, House Bill 28 (Chapter 60, Acts of the 70th Legislature, second called session) requires the City of Richland Hills, Texas, by appropriate action of its City Council, to establish either the next to the last or last Saturday in May of • each year as the date for any run-off election necessitated for the election of its Mayor; and WHEREAS, it is the desire of the City Council of the City of Richland Hills, Texas, by adoption of this resolution to establish and designate the next to the last Saturday in May as the annual run-off election date for any run-off elections required for the election of its Mayor. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RICHLAND HILLS, TEXAS, AS FOLLOWS: Pursuant to the requirements of subsection (b) of Section 2.025 of the Texas Election Code as provided by Chapter 60, Acts of the 70th Legislature, second called session, any run-off elections required for the election of Mayor of the City of Richland Hills, Texas, following a regular annual election for such office shall be held on the next to the last Saturday in May immediately following such regular annual election. The run-off election date herein designated shall apply to elections for Mayor of the City of Richland Hills, Texas, for the year 1988 and all subsequent years, unless and until hereafter modified by appropriate action of the Richland Hills City Council or as otherwise provided by law. The City Attorney of the City of Richland Hills, Texas, as its chief legal officer is further authorized and directed to submit to the Attorney General of the United States for appropriate review and approval under the provisions of Section 5 of the United States Voting Rights Act the run-off election date herein designated. ADOPTED this 25th day of January, 1988, at a regular meeting of the Richland Hills City Council by a vote of ayes, 2 nays, ~ abstentions. APPROVED: PAUL C.
