ORDINANCE NO. 6949
AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING AND
DIRECTING THE MAYOR AND THE CITY CLERK OF THE CITY TO EXECUTE A
. CONTRACT WITH KENNETH RICE OF JEFFERSON CITY, MISSOURI.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOUtI,
AS FOLLOWS:
SECTION 1. The Mayor and the City Clerk of the City of Jefferson,
Missouri, are hereby authorized and directed 'to execute for and on
behalf of the City of Jefferson, Missouri, a contract with Kenneth
Rice of Jefferson City, Missouri, which contract shall be in words
and figures as follows:
CONTRACT
THIS CONTRACT, made and entered into this 7th day of
July, 1960, by and between Kenneth Rice of Cole County, Missouri,
party of the first part, and the City of Jefferson, Missouri, a
municipal corporation of the third class, situated in Cole, County
Missouri, party of the second part:

WITNESSETI3, that:
WHEREAS, First Party, as the tenant, holds a presently effecti 'e
ease on the following described premises;
The ground floor (excluding the City Cab Office) and
basement of the building located at 220 Madison Street,
in Jefferson City, Missouri,
WHEREAS, Second Party desires to have First Party cancel. and
erminate said lease on the above described premises now owned by
om Curtis and Margaret Curtis, his wife, so that Samco Business
upplies, Inc. , a corporation, might lease said premises from Tom
urtis and Margaret Curtis, his wife, and occupy aaid premises to '
conduct its business, and
WHEREAS, First Party agrees to cancel. and terminate his lease
with Tom Curtis and Margaret Curtis, his wife, upon certain consider
tions to be made by Second Party as hereinafter stated, now therefo e
't is agreed by the parties hereto as follows:
(1) First party shall terminate and cancel his lease with Tom
Curtis and Margaret Curtis, his wife, on the above described premise ,
as of June 30, 1960.
(2) Upon the execution of a lease by Samco Business Supplies, nc. ,
as lessee, and Tom Curtis and Margaret Curtis, his wife, as lessors, of
he above described premises, whereby First Party is released from a 1
f his obligations under his lease with Tom Curtis and Margaret Curtis,
is wife, the Second Parth shall:
(A) Issue a check in the amount of Ten Thousand ($10,000.00
Dollars payable to First Party and the Exchange National Bank of
efferson City, Missouri, as their interests appear on or before the
7th day of July, 1960.
(B) Arrange with the cooperation and assistance of First
arty for the sale by the 1st day of August, 1960 of all fixtures an
quipment (excluding the air conditioning equipment within, and j
xterior wall sign on front wall of the building) owned by First '
arty now located within the above described premises.
(C) Pay to First Party from the proceeds realized from the
ale of the aforementioned fixtures andequipment owned by First Part
nd from other funds, the sum of Seven Thousand Five Hundred ($7,500100)
ollars on or before the lst day of August, 1960 . 1
3. First Party shall pay off all indebtedness, whether unsecu ed
r secured by chattel mortgages on the fixtures and equipment, inclu ing
he air conditioning unit and exterior wall sign, located upon the
above described premises, and have all chattel mortgages of record
affecting said personal property released and cancelled, upon receip
f said initial Ten Thousand ($10,000 .00) Dollar payment.
4. First Party shall execute a billof sale conveying clear an4
nencumbered title to the air conditioning unit and exterior wall si n
located upon the above described premises to Samco Business Supplies
Inc. , a corporation.
5. First Party shall execute such other and further Bills of i
ale to such parties as may be designated by Second Party conveying
fear and unencumbered title to all other fixtures and equipment and
ersonal property of every description now owned by First Party located
ithin the above described premises.
