AN ORDINANCE REGULATING THE PARKING OF MOTOR VEHICLES ON THE WEST
;SIDE OF MADISON STREET BETWEEN MILLER STREET AND McCARTY STREET.
;BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI,
U4S FOLLOWS:
31ECTION 1. It shall be unlawful for the operator of a motor vehicle
o permit the same to be parked for a period of time in excess of
two hours, between the hours of 9:00 A.I . and 5:00 P.M. , Monday
through Friday inclusive on the west side of Madison Street between
'Miller Street and McCarty Street.

6F.CTION 2. Anyone violating any of the terms of this ordinance sha
e deemed guilty of a misdemeanor.
PECTION 3. This ordinance shall be in force and effect from and
ter its passage and approval.

AN ORDINANCE AUTHORIZING VERNON 0. BURKHALTER TO EXECUTE AN OPTION
FOR THE PURCHASE OF CERTAIN REAL PROPERTY, AS THE AGENT OF THE CITY
,OF JEFFERSON, MISSOURI, FOR AND ON BEHALF OF THE CITY OF JEFFERSON,
MISSOURI, FOR AND ON BEHALF OF THE CITY OF JEFFERSON, MISSOURI, WITH
1IEDWARD B. GERLING AND HAZEL M. GERLING, HIS WIFE, SAID PROPERTY TO
IBE USED AS RIGHT OF WAY FOR THE CIRCUMFERENTIAL ROUTE IN THE EXTENS ON
I OF CITY PUBLIC THOROUGHFARES.
jBE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSO I,
AS FOLLOWS:
SECTION 1. Vernon 0. Burkhalter, as the agent of the City of Jeffe so
lMissouri, is hereby authorized and directed for and on behalf of
the City to execute an option contract for the purchase of certain
real Estate by the City of Jefferson, Missouri to be used as right
of way for the construction -of a public road as a part of the
Icircumferential route in the extension of existing city public
'streets.
SECTION 2. Said option for the purchase of said real estate shall
(read in words and figures as follows:

THIS AGREEMENT Made and entered into this 2nd day of September, 196
by.--and between Edward B. Gerling and Hazel M. Gerling, his wife of
Pefferson City, Mo. , hereinafter referred to as the "Owners" and th
` City of Jefferson, Missouri, acting through V. 0. Burkhalter,
Expediter of the Bond Issue Advisory Committee of the City of
jJefferson, Missouri, hereinafter referred to as the "City",
.WITNESSETH THAT:

1; 1. For and in consideration of the sum of $5.00 dollars paid by the
)City to the Owners, the receipt of which is hereby acknowledged,
said Owners give and grant to the City the exclusive right and
tprivilege of purchasing the following described property belonging
Owners, to-wit:
I Part of the east half of the northeast quarter of the
,northwest quarter of Section 24, Township 44, Range 12, particularly
' described as follows: From the quarter section corner on the north
side of Section 24, Township 44, Range 12; thence west along the section
line 10.35 chains, more or less, to the northwest corner of the east
half of the northeast quarter of the northwest quarter of Section 24,
Township 44, Range 12; thence south along the west line of said east
half of the northeast quarter of the northwest quarter to the north ',
$/W line of the Circumferential Route as shown on plans in the City :;
Clerk' s office, of the City of Jefferson, M ssouri, and the begin-
ning point of this description; thence continuing south along the
west line of said east half of the northeast quarter of the northwest
quarter to the west line of State Highway #54, thence in a northeasterly
direction along the west line of said Highway to the north R/W line "of said
Circumferential Routes thence northwesterly along the north R/W of
said Circumferential Route on a curve to the left to the point of
beginning.
2. The option price for said property is $11,761.00 dollars and if :,
City elects to purchase, a warrant on the City Treasury for said
amount shall be delivered to Owners at Jefferson City, Mo. or to
as their agent, and the owners shall at the same time and place ii
deliver to City or its agent a good and sufficient warranty deed to '�'
said property.
3. Notice of City' s election to pmhase hereunder may be given at :1
any time before September 12, 1960, to any of the Owners or to said !1
as their agent, by a writing signed by V. 0. Burkhalter.
4. Upon notice of election to purchase being given to Owners, theyll
shall within 10 days thereafter, at their own cost and expense, fur "Ish
and deliver to the City at City Attorney' s Office an abstract and
unlimited certificate of title to said property by a competent
abstractor satisfactory to the City. City shall have thirty (30) 111
days from and after delivery of said abstract and certificate within
which to examine the same. If City's attorney finds that the title 'i
to said property, as shown by said abstract and certificate, is
11 vested in Owners and is free and clear of and from any and all ,,
defects, liens, encumbrances, taxes and assessments, then the parties
ereto shall, within 20 days after City notifies owners that the
title is satisfactory, perform the provisions of Paragraph 2 above; l'i
ut if the title shall be otherwise than as above stated, then thisioption
shall be at an end and owners shall, upon demand, pay back to City
11 money theretofore paid by City to Owners on account of this
loption; however., Owners shall have 30 days from and after notice inli
writing to them is received of any legal ground for rejecting said 11
title within which to cure any defect in said title and remove saidil
round or grounds of rejection.
5. All taxes or assessments levied or assessed upon said property
fter notice of election hereunder shall be paid by the City of
Jefferson, Missouri.
6. The City shall be entitled to take possession of said property
180 days after delivery of the purchase price warrant drawn on the
Pity Treasury as above stated and provided.
I WITNESS WHEREOF, the parties have executed the above option
ontract this 2nd day of September 1960.
