HomeMy Public PortalAboutORD06987 40 RDINANCE NO. 6987 V ORDINANCE REPEALING SECTIONS 618 - 626 OF THE REVISED ORDINANCES (I ,F THE CITY OF JEFFERSON, MISSOURI, 1956 (BEING SECTIONS 1 - 5 OF ARTICLE 9 OF ORDINANCE NUMBER 2748 AND BEING SECTIONS 2 - 5 OF RDINANCE NUMBER 6143 OF THE CITY OF JEFFERSON, MISSOURI) RELATING 0 JUNK YARDS AND JUNK DEALERS, AND ENACTING A NEW ORDINANCE EGULATING JUNK DFALERS, JUNK YARDS, AUTO WRECKING DEALERS AND UTO WRECKING SHOPS, AND PROVIDING A PENALTY FOR VIOLATION. E IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI ., S FOLLOWS: ECTION -1. Sections 618 .- 626 of the Revised Ordinances of the City f Jefferson, Missouri, relating to junk dealers and junk yards be, Id he same are hereby, repealed. ECTION 2. Definitions. As used hereafter in this ordinance the ollowing terms shall have the following meaning: ii A. Junk Dealer - Any person, firm or corporation keeping or intaining a junk yard within the corporate limits of the city. B. Junk Yard - Any place of business where scrap iron, metal, tin, wire, rages, paper, cardboard, rubber, glass, and other articles .Cif a similar nature, shall be gathered together and stored for the I purpose of resale to persons and firms dealing in the purchase of suc� c ommodities. C. Auto Wrecking Dealer - Any person, firm or corporation, Heaping or maintaining an auto wrecking shop within the corporate li is of t e city. D. Auto Wrecking Shop - Any place of business where motor vehicles are acquired and stored for the purpose of dismantling or ftripping same to (1) sell or expose to sale to the public any parts or portion thereof, or (2) use any part or portion of said dismantled, for vehicle in conjunction with the operation of an automobile 2epair shop or garage in the repair of other automobiles. ICTION CTION 3. Junk Dealers & Auto Wrecking Dealers, Licenses. Every nk dealer and every auto wrecking dealer in this city shall, beforegaging in either of said businesses, obtain from the City Collector a cense therefor for which the charge. shall be the sum of Fifty ($50. 0) llars per year. 4. Junk Dealers - Storage of Materials. All junk dealers all observe the following regulations in operating junk yards. , A. The premises constituting the junk yar d shall be enclosed wLthin a building or the front side of• said premises and the sides dtiereof to a depth of fifty (50) feet, or such other depth specified the Council, shall be enclosed ,by a wooden, metallic or plastic fence not less than eight (8) feet in height and in which the opening or cracks are less than fifteen (15%) percent of the total area. B. Rags, paper and cardboard shall be stored within a suitable a -ructure or enclosed by a fence to prevent their escape when blown b t e wind. C. No rags, paper, cardboard, rubber or other flammable terials shall be stored on the premises within seventy five (75) r f .et of any oit, gasoline or other flammable liquids of the operator I o ,* any other adjoining property owner or lessee. D. An unobstructed and usable roadway must be maintained in g )od condition at all times into and within the confines of the premi es t permit ready and quick access to all points on the premises where I r gs, paper, cardboard and all other flammable materials are stored so tiat any fire may be quickly extinguished. E. All exterior areas on the outside of the walls or fences sirrounding the premises to be used as a junk yard shall be kept in a clean and neat condition free from any of:--ithe materials stored within t Junk yard. 41 SECTION 5. Auto Wreckin& Dealers - Storeage of Materials. All auto wrecking decilers shall observe the following regulations in thel operation of auto wrecking shops: A. The entire premises constituting the auto wrecking shop shall be enclosed within a building or by a wooden fence not less than eight (8) feet in height and in which the openings or cracks onstitute less than fifteen (15%) percent of the total area. B. All exterior areas on the outside of the building, walls ij or fences surrounding the premises to be used as an auto wrecking bI shop shall be kept in a clean and neat condition free from any of �Ithe materials stored within the area used as an auto wrecking shop. I' (SECTION 6. Location of Junk Yards and Auto Wrecking Shops. All jun yards and auto wrecking shops hereafter started in this city .-shall (Oe located only in such districts as may be provided under Zoning rdinance No. 5880, as amended, and the Zoning Map of the city as (incorporated into said ordinance. �ECTION 7. Licensing of Junk Yards and Auto Wrecking Shops. The City Collector shall submit any application to secure a license to operat� junk yard or an auto wrecking shop to the License Inspector, uilding Commission and Fire Inspector for purpose of investigation ,to determine that the applicant' s place of business meets the equrements of this' ordinance. All holders of licenses to operate junk yards or auto wrecking shops within this city of Jefferson City on the date of the passage land approval of this ordinance must comply with the provisions of this ordinance before securing a new license to continue a junk yar l r auto wrecking shop business. �f (SECTION 8. Junk Yards Auto Wrecking Sho s Ins ection. The Licens�' (Inspector, Building Commissioner and Fire Inspector of the city ! shall make an inspection of each junk yard and auto wrecking shop within the city at least once every six months, and more frequently if deemed necessary, to determine that the operators thereof are in compliance with the provisions of this ordinance. Any violations �of the terms of this ordinance shall be reported to the City Attorn y. I' IiSECTION 9 . Penalty. Any junk dealer or auto wrecking dealer ''violating the terms of this ordinance shall be deemed guilty of a (misdemeanor, and upon conviction thereof, shall be punished by a fine of not less than Ten ($10.00) Dolalrs not more than One Hundred !($100.00) Dollars, or by imprisonment in the county jail for not les� 1;than ninety (90) days, or by both such fine and imprisonment. the junk dealer or auto wrecking dealer convicted of violation iof the terms- of this ordinance on three different occasions within , any• twelve month period shall have his license to operate the !,business of a junk yard or auto wrecking shop revoked by the Police 1Judge upon notification to the -holder of the license and the City Collector. No Jiunk dealer or auto wrecking dealer whose license has been revoked under the terms of this ordinance shall be entitled to eceive a new license to operate a junk yard or auto wrecking shop ithin a period of one (1A year from the date of revocation of the license. , i Any junk dealer or auto wrecking dealer whose license has been evoked under the terms of this ordinance shall not be entitled to �lany refund of the Fifty ($50.00) Dollar fee paid to the City Collect r of the city for the original issuance of said license.
