to the intersection of the centerline of High Street and Bolivar
Street and also Walnut Street from a point 237 feet north of the
centerline of High Street thence running south along and with WalAut
Street 527 feet; setting out the mmaes of the owners of the several
lots or parcels of land, if known, or if unknown, a correct description
of the parcels whose owiiers are unknown, and praying the appointment
of three disinterested commissioners , freeholders of property in the
County of Cole., to assess the benefits and damages which the owners may
severally sustain by reason of the tdring of damaging of such pro-
perty or rights therein all as shown on the plans for the improvement of
said streets as prepared and submitted by the State Highway Comwission
of Missouri., which said plans are on file in the office of the ity
Clerk of the City of Jefferson, and the City Attorney is further
authorized and directed to fileall proper pleadings aiid papers in
connection with the said condemnation proceedings, and to prosecute
said condemnation suit to a final conclusion.
Section 2. The Council deterrines that hb special beiiefit
district can be ascertained or provided., and all damages wBnich may
be found are hereby declared to be nroper charges against thetreveiiues
of the City of Jefferson and shall be paid out of any funds
available in the City Treasury without any assessment for beiiefits
to any district, as provided by Section 7010, R. a. MO. 1939.
Section 3. -his being ail ordiitance providing for public work
and improvement., anLemergericy is hereby declared to exist within
the meaning of the law governing said city and t'!-iis ordinance shall
become effective immediately upon i-.Os passage acrd approval .by the
Mayor.
Section 4. All ordinances of parts of ordinances in conflict
herewith are hereby repelaed.

AS FOLLOWS:
Section 1. The Mayor of the vity of Jefferson, T4__ssouri,, a
munic4al corporation, is hereby authorized and directed to sign
and execute on behalf of the pity of Jefferson M ssourio a certain
agreement, the terms of said agreement to be as 2611-ows it to wit:
A copy of said agreement is herewith marked Exhibit "A and made
a part of this ordinance.
RIGHT OF ViAY AGREEMENT
THIS AGREEMENT made aiid entered into on this the 16th day of April.,
1949, by and betweeii Velma Gentry, a single person, of Jefferson
City,, Missouri ,, party of the first part (hereinafter called Owner)
and the City of Jefferson pity) ,municipal corporation,, party of the second
part (hereinafter called WITNESSETH:
In considerationof the sum of One Dollar ($1.00) ., in hand
paid to said Ov.ner by said City., receipt of which is hereby ack-
nowledged, atid of the further benefits, coveiiants aid agreements
hereinafter set out, said Owner agrees that she is the owner in fee
simple of a treat of land described as a part of Inlot 1,1o. 423
in the City of Jefferson, Missouri Said Owner further-agrees that
she has eiitered into a contract with the Roy Scheperle -onstruction
