Section 16. Lnf'orcement Interpretation. his ordinance shall
be (bnforced by t`ie I;ilk Inspector in accord'anee with the interpretation
thereof contained in the 1959 edit.i on of the t',-_ited :'tntes Public
Health Service I.'ilk Code , a certified co-);r (_,f which shall. be on
file in the city clerk's of;:'ice.
Section 17. Any person violating, any of the )rovisions of
this ordi.nnnce shall be deemed --uilty of a misdemeanor and su"liect to
a fine of not more than one luindred dollars (ti; 1CC .G0) , c;r inprisonment
riot of exceed ninety (90) (lays, or both fine and iir: )risonment. Each
and every violation of the :provisions of t'-,is ordinance shall con-
stitute a separate offense .
Section 18. Repeal and Late of Effect. All ordinances and
narta of ordinances in cnn.flict with l r�is+ ort.:inance are hereby re-
peal,:ed; and t1 is otdinance shall be in full force and effect immedi-
ately upon its adoption and its publication, as provided by lmw.
Section 19. L'nconstitut.i.onalit-r Clause. should any Section,
paragraph, sentence, clause , or phrase of this ordinance be declared
unconstitutional or invelid for any reason, t:.ho remainder of said
ordina-t ce shall riot be effected t'rereby.

SECTIO?' 1. Definitions. yhw follotvinE, definiticns shall a,)ply
in the interpretation and the enforcement of this ordinance.
A. Restaurant.. `rile term "retitaurai,t" shall mean restaurant,
coffee shop, ' afeteria, short order cafe, lunc neonette, tavern, sand-
wich strn d, soda fountain, balceries end all other eat.-nf- or drinking
establishments, as well as kitchens or other places in which foor or
drink is prepared for sa;e elsewhere .
D. Itinerant restat,rant. - The term "itinerant restaurant" shall
,rcoan one o,)(-,,rating for a tc�nporary period in connection with a fair,
carnival , circus , public exhibition, or other similar -:athcring.
C . Lrn . to r e. - 1he term 'gem >loyee" shall mean any person who
handles food or drink durin`° prIe;�aration or serving;, or wl-o comes in
contact with arty eating; or cooking utensils or trho is errplo,red in a
room in which food or drink Is :)repi.ired or served.
D. Utensils. - "Utensils.1 ghnll Include any Atchenware , table-
ware , glass ware, cutlery, utnisllo, containers, or other equipment
with which food or drink comes in contact during storage , preparation,
or serving.
E. Health Officer* - 4--ho, term "health officer" shall mean the
Health Officer of the Uity of Jefferson or his authorized re-presenta-
tive.
F. Person. - The word "person" shall mean person, firm, corpora-
tion, or association.

requirements of tl,is ordinErice shall be entitled to receive and re-
tain such a -)eri-At. A -person conducting as itinerant restaurant shall
be required to secure a • ermit. much a *)erwit may be terporaAlly sus-
pended by the health officer upon the violation by the bolder of any
of the terms of t is ordinance, or revoked after an opportunity
for a 'hearing by the health officer upon serious or repeated violation.
SECTION 3. Placarding or public _dis:-)lay of grade notice.
Every restaurant shall display at all times, in a place designated by
the health officer, a notice approved by the health officer, stating
the grade of the establishment.
SEUTIO]i 4. Examination and c-,,ndemnation of unwholesome or
adulterated food. or drink. - Samples of food , drink., and other sub-
stances may be taken and examined by the health officer as often as
may be necessary for the detection of unwholesomeness or adulterat16n.
The health officer may condemn an(- forbid the sale of, or cause to
be removed or destroyed, ariv food or drink iflhich is ilnl.,holwscme or x
adulterated.
SECT 1017 5. Inspection of restaurants. - Al least once every 6
months the health officer shall inspect restaurant within the
City of Jefferson. In case the health officer discovers the viola-
tion of any item of sa.,itation reqi�ired for the grade then held,
lie shall make a second Inspection after the lapse of such time as
he deems necessary for the defect to be reiiddied and the second
spection shall be used in r!,etermining compliance with tho grade re-
q,Uireyrients Of t'- 1S Drdil'I'Mce. ny violation of the sEcrie item

item C. Toilet facilities. - Every restaurant shall be pro-
vided !-ith a0oquate and conveniently located toilet facilities for
its employees , conf orm.bng t-,iith the ordinances of the City* of Jefferson.
In restaurants hereafter constructed toilet rooms shall not o )en dir-
ectly into ainyI room in which food, drink, or utensils are Dandled
or stored. The doors of all toiletx rooms shall be self-closing. Toilet
rooms shall be kept in a clean condition, in good repair, and well
li,:hted and ventilated. handwashing si,;ns shall be ;posted in each
toilet room used by employees. In case privies or earth closets are
permitted and used, they shall be separate from the restaurant build-
ing, and shall be of a sanitary type constructed and operated in
conformit;r witht the standards of the Livision of health .
Item 7. Water tupply._ "unni- water pressure shall be
easily assessable to all rooms in which food is :> rc�pared. or utensils
are washed,, and the water supply shall be adequate, a::d of a safe ,
sanitary quality.
Item a. Lavatory facilities. - Adequate and convenient hand-
wasl;ing facilities shall be ;?rovided, including 'not and cold running
water, soap and approved sm itary towels* he use of conmm,_,n towel

without first washing his hands.
Item 9. "onstruction of utensils and e(u iprnent. - All multi-
use utensils and all show and display cases or windows, counters,
shelves, ta')les, refri-eratIng equipment, sinks, and other egl.zipment
or utensils used in connection with the operation of a restaurant shall
be so constructed as to be easily cleaned and shall be kept in good
repair. ltensils ccntnining or plated with eadmium or lead shall not
be used; Provided, that solder conta:inigg lead. may be used for

Item 10. Cleaning and bactericidal treatment of utensils and
ecuipment. All equipi'nent, including; dis_)1ay cases or windows,
counters, shelves, tables , ref. ri,- erators, stoves , hoods, and sinks,
shall be kept clean and free From dust, dirt, insects, and other con-
taminating material. All. cloths used 10IT ;aiters, chefs , and other em-
playees shall be clean. 4int, le service containers shall be used only
once.
All multi-use eating any, drinking utensils shall be thorouC.hly
cleaned and effectively subjected to an approved bactericidal process

Item 13. Refr,L..cration. - All roadily perishable: food atd_
drink shall be kept at or below 50'F. except w1• en bel.nC. orepared or

Item 14 . 17holeso-nness of f(,,od and drink. - All f od and

niblk products, ice cream , and other frozen deserts served shall be
from approved souces. Nilk and fluid milk products shall be served
in the individual original containers in which they are received from
the distributor or from a bulk container equipped with an appioved
dispensing device: Provided, thst this requirement shall not apply to
cream., which may be -erved from the original bottle or from a dis-

- Grade B. rostaur,,)rats. - Gyrc•de B restauruants are those which fai
to comAy wit:.h item 1,2,4 , 5, or 17, but which conform with all other
items of sanitation required for itrade A restaurants.
Grade C restauarants. - Itinernrat restaurants shall be con-
structed and operated in an approved manner.
SECTICE' 7. ,T,ndes if restaurants which may o�_)erate. - From and
after 12 months from the date on which tt-:is ordinance takes effect no
