HomeMy Public PortalAboutResolution No. 025-89 05-22-1989 RESOLUTION NO. 25-89 RESOLUTION CALLING AN ELECTION • THE STATE OF TEXAS COUNTY OF TARRANT CITY OF RICHLAND HILLS WHEREAS, the City Council deems it necessary and advisable to call the election hereinafter ordered. THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RICHLAND HILLS, TEXAS: 1. That an election shall be held between the hours of 7:00 A.M. and 7:00 P.M. on August 12, 1989, in said City, at the following designated polling place: City Hall Richland Hills, Texas Said City shall constitute a single election precinct for said election, and the following election officers are hereby appointed to hold said election: Presiding Judge: Russ Miller Alternate Presiding Judge: Ola James 2. That the Presiding Judge shall appoint not less than two nor more than five qualified election clerks to serve and assist in conducting said election; providing that if the Presiding Judge actually serves as expected, the Alternate Presiding Judge shall be one of such clerks. 3. That absentee voting shall be conducted by personal appearance and by mail at the City Hall, Richland Hills, Texas, and during the period absentee voting is required or permitted by law, being July 23, 1989 through August 8, 1989, the hours designated for absentee voting by personal appearance shall be from 8:00 A.M. to 5:00 P.M. on each day except Saturdays, Sundays and legal state holidays; and the absentee voting clerk shall keep said absentee voting place open during such hours for absentee voting by personal appearance. The absentee voting clerk for said election shall be the City Secretary. A Special Canvassing Board shall be appointed by the City Council, as provided by law, to count and canvass all absentee votes and ballots cast at said election. A paper ballot/scanning machine voting system shall be used both for absentee voting and for voting at the regular polling place at said election. 4. That all resident, qualified electors of said City shall be entitled to vote at said election. 5. That notice of said election shall be given by posting a substantial copy of this Resolution at three public places in the City and also at the City Hall, not less than 15 days prior to the date set for the election; and a substantial copy of this Resolution also shall be published on the same day in each of two successive weeks in a newspaper of general circulation published in said City, the date of the first publication to be not earlier than the 30th day or later than the 14th day prior to the date set for said election. 6. That at said election the following PROPOSITION shall be submitted in accordance with law: PROPOSITION Shall the City Council of said City be authorized to issue the certificates of obligation of said City, in one or more series or issues, in the aggregate principal amount of $1,000,000, with the certificates of obligation in each such series or issue, respectively, to mature serially within not to exceed forty years from their date, and to be sold at such prices and bear interest at such rates in accordance with law at the time of issuance as shall be determined within the discre- • tion ~of the City Council, for the purpose of paying, in whole or in part, contractual obliga- tions to be incurred for the construction and equipment of a police station and an addition to the City's Community Center, and to pay all or part of the legal, fiscal and professional fees rendered in connection therewith; and shall said City Council be authorized to levy and cause to be assessed and collected annual ad valorem taxes on all taxable property in said City, and pledge the surplus revenues of the City's Waterworks and Sewer System, in an amount sufficient to pay the annual interest on said certificates of obligation and provide a sinking fund to pay said certificates of obligation at maturity? 7. That the official ballots for said election shall be prepared in accordance with the Texas Election Code so as to permit the electors to vote "FOR" or "AGAINST" the aforesaid PROPOSITION, with the ballots to contain such provisions, markings and language as required by law, and with such PROPOSITION to be expressed substantially as follows: • PROPOSITION FOR ) THE ISSUANCE OF NOT TO EXCEED $1,000,000 IN CERTIFICATES OF OBLIGATION FOR THE PURPOSE OF PAYING, IN WHOLE OR IN PART, CONTRACTUAL OBLIGATIONS TO BE INCURRED FOR THE CONSTRUCTION AND EQUIPMENT OF A POLICE STATION AND AN ADDITION TQ THE TO THE CITY'S COMMUNITY CENTER, AND TO PAY ALL OR PART OF THE LEGAL, FISCAL AND PROFESSIONAL FEES RENDERED IN CONNECTION THEREWITH AGAINST ) 8. That said election shall be held in compliance with the Texas Election Code. • •
