Please forward this public record request to the Custodian of Records for your agency. Pursuant to
Article 1, Section 24 of the Florida Constitution and Chapter 119.07 of the Florida Statutes I wish to make
a public records request of your agency for the following records:
Any emails reviewed by Glenn Torcivia which he references as being reviewed by him in his invoice
dated March 11, 2014
If you contend that any of the records I am seeking, or any portion thereof, are exempt from inspection or
disclosure please cite the specific exemption as required by 5119.070)(e) of the Florida Statutes and
state in writing and with particularity the basis for your conclusions as required by 5119.070)(f) of the
Florida Statutes.
I wish to receive these records as soon as possible. If some records that are responsive to my request
are obtainable sooner than other responsive records, I wish to receive those records as soon as they are
available and I wish to receive the other records as soon as they become available. I request that no
responsive records be withheld from me while waiting for other responsive records to be found.
Please take note of 5119.07(c) Florida Statues and your affirmative obligation to (1)
promptly acknowledge receipt of this public records request and (2) make a good faith effort which
includes making reasonable efforts to determine from other officers or employees within the agency
whether such a record exists and, if so, the location at which the record can be accessed." I am,
therefore, requesting that you notify every individual in possession of records that may be responsive to
this public records request to preserve all such records on an immediate basis.
If the public records being sought are maintained by your agency in an electronic format please produce
the records in the original electronic format in which they were created or received. See 6119.01(2)(f),
Florida Statutes. I prefer to receive these records in electronic format but I ask that you provide these
records in the least expensive format and method available to you.
If you anticipate the production of some of these public records will require a search of sufficient duration
as to require any deposit payment from me, please notify me of any such required payment prior to
conducting any portion of that search which would require such payment. Please first produce any
responsive records that are readily available and do not require any deposit payment prior to producing.
If you anticipate the production of these public records to exceed $1.00 please notify me in advance of
their production with a written estimate of the total cost. Please be sure to itemize any estimates so as to
indicate the total number of pages and /or records, as well as to distinguish the cost of labor and
materials.

I am litigation counsel to Mr. O'Hare. He has other attorneys, but I have been specifically
retained to handle all court/hearings. Mr. Randolph conveys the Town's position, yet he does not
explain why, after waiting 1 month, the hearing must be rushed with less than 5 days notice. He
does not allege an emergency or threat to the health, safety or welfare of the community. He
offers no reason why it must happen in 4 days. The only thing he says is "in the interest of the
Town and its residents to have these matters heard a soon as conveniently possible." Again, I
am asking that a "convenient" date for all be set with fair reasonable notice.
While Mr. Randolph may feel it is a simple matter, there are several legal issues concerning
these alleged violations such as the First Amendment protection and the Town's jurisdiction over
navigable waters without any mooring field designation. We are entitled to a full and fair hearing
that is "convenient" to all parties.
I note that Mr. randolph does not contest that reseting this matter is well within your power as
the Special Magistrate. The Town's actions are unfair.

This is in response to Mark Hanna's email to you requesting that you postpone the matters
relating to Mr. O'Hare which are scheduled for hearing on February 25, 2014. The Town
opposes the request for postponement. The violation to be considered relating to Section 38 -72
of the Town of Gulf Stream Code, relates anchoring or mooring a vessel within the Town for a
longer period of 24 hours in any consecutive 30 day period. Attached is the Notice of Violation
in regard to same which directed that the violation be corrected within 24 hours. In regard to
Mr. Hanna's alleged conflict, I know as a matter of fact that Mr. O'Hare has used other attorneys
to represent him in matters such as these involving the Town of Gulf Stream.
The other case relates to Section 70 -268 of the Town which prohibits objects d'art visible from
the street in the front yard of a person's home in the Town of Gulf Stream. A copy of that
Section is attached, along with the Notice of Violation.
It is in the interest of the Town and its residents to have these matters heard a soon as
conveniently possible. These matters are simple and direct and should require very little
preparation.
