AN ORDINANCE AUTHORIZING CONVEYANCE OF PROPERTY KNOWN AS
BLOCK 6704, LOT 6.02 ON THE OFFICIAL TAX MAP OF THE BOROUGH OF
CARTERET TO THE COUNTY Or MIDDLESEX OR ITS DESIGNEE
WHEREAS, pursuant to N.J.S.A. 40A: 12- 13(b)(1) a municipality may sell or exchange any real
property not needed for public use at private sale to any political subdivision, agency, department,
commission, board or body corporate and politic of the State of Now Jersey; and
WHEREAS, pursuant to N.J.S.A. 40A:12 -13.4 a municipality may sell any real property not
needed for public use at private sale to the county in which such property is located for a
consideration which may be nominal, provided the said lands or buildings shall be used only for
public purposes of the county and that if the lands are not used in accordance with such
limitation, title thereto shall revert to the municipality without any entry or reentry made thereon
on behalf of the municipality; and
WHEREAS, Block 6704, Lot 6.02 is Borough owned property and contains a public parking
garage (the "Property"); and
WHEREAS, Middlesex County, or the Middlesex County Improvement Authority as its
designee (collectively, the "County") desires to acquire the Property for the continued use as a
public parking garage; and
NOW, THEREFORE, BE IT ORDAINED AND ENACTED by the Borough Council of the
Borough of Carteret, County of Middlesex, New Jersey, as follows:
Section 1. A private sale to the County of the Property known as Block 6704,
Lot 6.02 for $5,500,000 is hereby authorized pursuant to N.J.S,A.
40A:12 -13.4, conditioned upon the fact that the Property shall be
used by the County for a public purpose as set forth herein and that
should the County fail to use the Property for such public purpose,
title in and to the Property shall revert to the Borough without any
entry or reentry made thereon on behalf of the Borough.
Section 2. The Mayor, the Chief Financial Officer or the Director of Law,
along with the Borough Clerk, are each hereby authorized and
directed to execute the necessary Purchase and Sale Agreement,
Deed and any other documents required to transfer ownership of
the Property described herein.
Section 3. All actions of the Borough and its officers taken prior to the dale of
adoption hereof in connection herewith are hereby ratified and
approved.
Section 4. This ordinance shall take effect upon final passage and publication
as required by law.
