HomeMy Public PortalAboutOrd. 21-25Orbinauce No. #217 of the Parvlg4 of (brtere#, AN ORDINANCE OF THE BOROUGH OF CARTERET ADOPTING AMENDEDMENTS TO THE FEDERAL BOULEVARD REDEVELOPMENT PLAN WHEREAS, the Local Redevelopment and Housing Law, N.LS.A. 40A: 12A -I at seq., m amended and supplemented (the "Redevelopment Law ") provides a process for municipalities to participate in the redevelopment and improvement of areas in need of redevelopment; and WHEREAS, the Borough Council has adopted an ordinance approving and adopting the Federal Boulevard Redevelopment Plan (the "Redevelopment Plan "); and WHEREAS, the Redevelopment Plan relates to certain properties within the Borough formerly known as Block 49.0 1, Lots 4, 9 and 11; Block 49.02; Lot 2, Block 64.0 1, Lots 1, 2, 3, 4.01, 4.03, 4.04, 5, 6.01, 6.02, 7 and 8; Block 64.02, Lots 1, 2.01, 2.02, 3 and 7 (collectively the "Redevelopment Area "); and WHEREAS, the Borough's Planner, Beacon Planting and Consulting Services has prepared an amendment to the Redevelopment Plan (the "Amended Redevelopment Plan "), a copy of which is attached hereto and made a part of this Ordinance; and WHEREAS, pursuant to N.J_S.A. 40A: 12A-7.c., upon introduction of this Ordinance, the Redevelopment Plan shall be referred to the Carteret Planning Board for review and issuance of a report containing its recommendations, if any, concerning the amendment to the Redevelopment Plan within 45 days of referral. NOW THEREFORE, BE IT ORDAINED AND ENACTED, by the Borough Council of the Borough of Carteret, Middlesex County, New Jersey, as follows: Section 1. The Amended Redevelopment Plan is hereby adopted as the official redevelopment plan for the Redevelopment Area. Section 2, The zoning district map of the Borough's Land Development Ordinance is hereby amended to reflect the applicability of the Amended Redevelopment Plan to the Redevelopment Area and the Borough's Land Development Ordinance as it affects the Redevelopment Area is hereby superseded by the Amended Redevelopment Plan to the extent set forth therein. Section 3. Any and all ordinance or resolutions of the Borough, or provision thereof, inconsistent with the provisions of this Ordinate shall be and are hereby repealed as to the extent of any such inconsistencies. Section 4. If any section, subsection, part, clause or phrase of this Ordinance or the Amended Redevelopment Plan shall be declared invalid by judgment of any Court of cotnpetentjurisdiction, such section, subsection, part, clause or phrase shall be deemed to be severable from the remainder of this Ordinance or the Amended Redevelopment Plan, as applicable.
