RESOLUTION RESCINDING RESOLUTION #98-214
IN PART AND PROVIDING FOR THE EXECUTION
OF AN AGREEMENT WITH SERENITY CONTRACTING
GROUP, 1NC.
WHEREAS, BY RESOLUTION #98-214 THE BOROUGH COUNCIL OF THE
BOROUGH OF CARTERET (The "Council") awarded a bid to Serenity Contracting
Group, lnc. ("Serenity") for the construction of a Library and Community Center; and
WHEREAS, Resolution #98-214 provided in part that the Mayor and Municipal Clerk
were authorized to execute the contract with Serenity; and
WHEREAS, the Mayor has indicated publicly that he will not execute the agreement
with Serenity on behalf of the Borough of Carteret (The "Borough"); and
WHEREAS, the Council believes the Library and Community Center is an important
step in improving the quality of life for the people of the Borough and should not be
delayed by the Mayor's refusal; and
WHEREAS, N.J.S.A. 40A:l 1-14 provides that the governing body of any contracting
unit may, subject to requirements of law, prescribe the form and manner in which
contracts shall be made and executed ..."(emphasis added)"; and
WHEREAS, N.J.S.A. 40:48-I et seq. (the "general law") provides that "the governing
body of every municipality may ...prescribe the form and manner of execution and
approval of all contracts to be executed by the municipality...';
NOW, THEREFORE, BE 1T AND IT IS HEREBY RESOLVED BY THE
BoROuGH COUNCIL OF THE BOROUGH OF CARTERET that the portion of
Resolution #98-214 which authorized the Mayor to execute the agreement with Serenity
to construct the Library and Community Center is hereby rescinded;
BE IT FURTHER RESOLVED that the Council President and Municipal Clerk are
hereby authorized to execute the agreement between the Borough and Serenity for the
construction of the Library and Community Center;
BE IT FURTHER RESOLVED that except as specifically stated above, Resolution
#98-214 shall in all other respects remain in full force and effect;
BE IT FURTHER RESOLVED that this Resolution shall take effect immediately.
Adopted this 27th day of July, ! 998 and certified
as a true copy of the original on July 28, 1998.
