Councilman Presents the following Ordinance Seconded by Councilman
AMENDING & SUPPLEMENTING CHAPTER 38 OF THE CODE
OF THE BOROUGH OF CARTE RE,
IT ORDAINED by the Mayor and Council of the Borough of Carteret that § 38 -5, entitled
idency requirements, of Chapter 38, is hereby amended and supplemented to add the
)wing three (3) new paragraphs as follows, with the exiting §38 -5 recast as paragraph "A ":

B. Whenever the Appointing Authority shall determine that there
cannot be recruited a sufficient number of qualified Borough residents,
the Borough shall advertise for other qualified applicants,
classifying all qualified applicants for appointment in the following
manner:
(1) Other residents of Middlesex County.
(2) Other residents of contiguous counties.
(3) Other residents of the State.
C. The foregoing notwithstanding, and as otherwise provided for by
law, the Appointing Authority shall have the discretion to appoint
qualified applicants to specific positions and employments within
the Borough in the in following circumstances:
(1) The position or employment requires special knowledge,
education, training, experience, talent and/or technique
necessary for the operation of the local government.
(2) The nature of the position or employment is such as to
necessitate residence outside of the Borough.
D. With regard to any initial appointments to fill positions within the police
or fire departments, all duly qualified applicants shall be classified in the
following classes in accordance with N.J.S.A. 40A: 14 -123.1 a and
N.J.S.A. 40A: 14- 10.1a, respectively:
(1) Residents of the Borough.
(2) Other residents of Middlesex County.
(3) Other residents of the State.
(4) All other qualified applicants.
Again, said residency shall be required and determined as of
the date of appointment. (N.J.A.C. 4A: 4- 2.11).
2. All Ordinances or parts thereof inconsistent with the provision of this
Ordinance are hereby repealed limited to the extent of any such
inconsistency.

3. If any section, paragraph, subdivision, clause or provision of this
Ordinance is adjudged invalid, such adjudication shall apply only to the
section, paragraph, subdivision, clause or provision so adjudged and the
remainder of this Ordinance shall be deemed valid and effective.
4. This Ordinance shall only take effect upon passage and publication
according to applicable law.
