Councilman Presents the following Ordinance Seconded by Councilman
AN ORDINANCE OF THE BOROUGH OF CARTERET
AUTHORIZING THE ACQUISITION OF PROPERTY
COMMONLY KNOWN AS 1179 AND 1235 -1239 ROOSEVELT
AVENUE AND IDENTIFIED ON THE BOROUGH'S TAX MAP AS
BLOCK 2701, LOTS 12,13,14.01 AND 14.03 AND BLOCK 701,
LOT 1 FOR REDEVELOPMENT PURPOSES
WHEREAS, pursuant to the Local Redevelopment and Housing Law, N.J.S.A.
40A:12A -8, the Borough of Carteret (the "Borough ") is authorized to acquire property
located within a designated redevelopment area by negotiation or condemnation; and
WHEREAS, pursuant to N.J.S.A. 40A:12A -5, the Minue Street Redevelopment Area
was determined to be an area in need of redevelopment by the Borough; and
WHEREAS, pursuant to N.J.S.A. 40A: 12A-7, the Minue Street Redevelopment Plan has
been adopted by the Borough; and
WHEREAS, the Minue Street Redevelopment Plan identifies certain properties to be
acquired for redevelopment; and
WHEREAS, the Borough has determined that it would serve the purposes of the
Borough and the Local Redevelopment and Housing Law for it to acquire property
commonly known as 1179 and 1235 -1239 Roosevelt Avenue and identified on the
Borough's tax map as Block 2701, Lots 12, 13, 14.01 and 14.03 and Block 701, Lot 1
(the "Property ") for redevelopment purposes; and
WHEREAS, the Borough wishes to negotiate for the acquisition of the Property and if
negotiated purchase cannot be effectuated, to initiate an eminent domain action to acquire
title to the Property.
NOW THEREFORE, BE IT ORDAINED AND ENACTED, by the Borough Council
of the Borough of Carteret, Middlesex County, New Jersey, as follows:
Section 1. The acquisition by negotiation and/or eminent domain of property
commonly known as 1179 and 1235 -1239 Roosevelt Avenue and
identified on the Borough's tax map as Block 2701, Lots 12, 13,
14.01 and 14.03 and Block 701, Lot 1 is hereby authorized.
Section 2. The Mayor, the Chief Financial Officer and the Director of Law
are each hereby authorized to sign any document necessary to
effectuate the acquisition of such property.
Section 3. Any and all ordinance or resolutions of the Borough, or provision
thereof, inconsistent with the provisions of this Ordinance - shall be
and are hereby repealed as to the extent of any such
inconsistencies.
Section 4. If any section, subsection, part, clause or phrase of this Ordinance
or the Minue Street Redevelopment Plan shall be declared invalid
by judgment of any Court of competent jurisdiction, such section,
subsection, part, clause or phrase shall be deemed to be severable
from the remainder of this Ordinance or the Minue Street
Redevelopment Plan, as applicable.

Section 5. This Ordinance shall take effect upon final passage and publication
in accordance with applicable law,
Section 6. Upon the final adoption hereof, the Borough Clerk shall forward
certified copies of this Ordinance to Matthew C. Karrenberg, Esq.,
DeCotiis, Fitzpatrick, Cole & Oiblin, LLP, Special Redevelopment
. Counsel to the Borough.
