i APB ORDINANCE of the Laity of Jefferson, Yissouri, vacating and dis-
continuing as a public thoroughfare all that part of the public
� alley lying on the lying on the westerly side of lots 9 and 16
inclusive of a subdivision of Irilot 326, being more particularly
described as: A strip of land 10 feet in width, fronting of Esst
Capital Avenue and running back southerly 198 feet 9 inches, the
eaaterly line lying 59 feet 42 inches westerly of and parallel to
the westerly line of Jefferson Street, as shown on the original
plat of said subdivision and recorded in Warranty Deed Book R. Wage
481 C61e "ounty Recorder' s Office, and authorizing and directing
the Mayor of the t'ity of Jefferson, Missouri, to execute all nec-
essary instruments to the owners of the adjacent lots to and for
isaid alley so vacated, as the parties entitled thereto, as shown
by the record title to said adjacent, gnd abutting property and de-...,. _

WHEREASs It has been shown to the City Council of the City of
Jefferson, Missouri, that the owners of the alley lying on the
westerly side of lots 9 to 16 inclusive of a subdivision of Inlet
326, being more particularly described as: A strip of land 10 feet In
width, fronting pit East Capital Avenue and dunning back douthegly
198 feet 9 inches,the easterly line lying 59 feet 4-15* inches west-
( erly of and parallel to the westerly line of Jefferson Street, as
shown on the original plat of said subdivision and recorded in

! used, improved and occupied and are now using and occupying said
abutting and adjacent land so that said portion of said alley has
ceased to be of en y use or benefit as a public thoroughfare and tha
it would not inconvenience the public or the citizens of the City '
of Jeffers gin, Missouri , to discontinue and vacate said alley as a
public thoroughfare, therefore: (I
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSO1',
PrISSOURI, AS FOLLOWS:

SECTION 1. It is hereby declared that the City Uouncil of the City
I of Jefferson, Missouri, deems it necessary ande xpedient to vacate
and discontinue the alley lying con the westerly side of lots 9 to l
inclusive of I"lot 6269being more particularly described as: A stri �
of land 10 feet in width, fronting on East Capital Avenue andrxrun-
ning back southerly 198 feet 9 inches, the easterly line lying
59 feet 42 inches westerly of and parallel to the westerly line of !
Jefferson Street, as shown on the original plat of said subdivision )
and recorded in warranty Deed Book 5 ` age 481 Cole County Recorder' s
Office, All the owners of the property and adjacent lots abutting
on and adjacent to said alley having petitioned the said City Counc 1
to vacate and disc ontinue said alley as a part of the public
thoroughfare of said City, and said alley is forever vacated and
discontinued as a public thorotghfares and the power and right of
reversion of said alley to the adjacent and abutting owners as is
provided by Statutes of the State of Nissouri , is hereby fully con-„
firmed and approved, and the Mayor of this City is herebyrauthorize
{ and directed to execute and deliver all proper and sufficient writ-
ing, or instruments for, on behalf of or in the name of the City to i
fully and completely establish and guarantee to the adjacent and
I abutting property owners tjeir legal rights in connection with
the above vacation.
I SECTION 2. All Ordinances or parts of Ordinances contrapy,,to in co Ali
! with or inconsistent with the provisions of this Ordinance are here y
repealed.
