HomeMy Public PortalAbout19400711CCMeeting53 Savannah Beach, Tybee Island, July llth, 1940 The regular meeting of Town Council was held today at S p.m. in the Council Chamber and was attended by Mayor Jones, who presided, and Councilmen Daniels, Griffin, Henry, Slotin and Ferguson, and Town Attorney Dutton. Also Mr. Q.B. Wagner and Dr. C.C. Hedges and Dr. Boston. Mr. Wagner of the J.B. McCrary Company, presented plans IFfAeloo and estimates of several sewerage disposal systems that his Prpo1 Company has erected elsewhere. After covering quite a lengthy �I'tah�,�. description, Mr. Wagner informed Council that his Company would come in and make a survey of the cost and etc. of what waa_needed on Tybee, the cost of which would be $300.00 to the Townie" Counc 'man Griffin moved that the following resolution be adopted, and also that the cost of the survey should not exceed $300.00. Councilman Ferguson seconded and the motion passed. The Town Attorney was then requested to pass on the legality of the contract. RESOLUTION B.E IT RESOLVED THAT the foregoing agreement with J.B. McCrary Company, be entered into and that the Mayor and Clerk of Council be authorized to execute same on behalf of the Town of Savannah Beach, Tybee island. STANDARD MUNICIPAL ENGINEERING CONTRACT The following agreement made between J.B. McCrary Company a corporation duly chartered under the Laws of Virginia, herein- after designated ENGINEERS, and the. Town of Savannah Beach, Tybee Island, Georgia, hereinafter designated CLIENT, witnesseth: (1) That whereas the CLIENT is considering the install - ation of a SEWERAGE SYSTEM, and desires to engage the services of the ENGINEERS in connection with these proposed improvements the parties to this agreement mutually contract, agree and covenant as follows: (2) The ENGINEERS agree to furnish said services in accordance with modern municipal engineering practice and will (a) Make accurate and comprehensive preliminary surveys, investigations and studies, and prepare the necessary preliminary maps, reports and estimates of cost of the proposed improvements. (b) Confer with the CLIENT ans furnish the necessary engineering advise and information to enable the CLIENT to determine the nature and extent of the improvements and the amount of funds required. (c) Confer with the State Department of Health and other organizations having jurisdiction over or interest in the proposed improvements. (d) If requested by the CLIENT, prepare an application for financial assistance from such Federal or other agency as may be considered advisable. (e) Prepare final construction plans and specifications as soon as the CLIENT has obtained the necessary funds. (f) If any part of the work is to be constructed by contract, furnish copies of the advertisement for proposals to the CLIENT for him to insert in such journals as he may elect, the cost of such advertising to be borne by the CLIENT; furnish prospective bidders with a copy of the plans, specifications and proposals for the purpose of handling all matters in connection with the opening, reading, tabulating, checking and evaluating of the proposals and for furnishing the advise necessary to enable the CLIENT to make the most advantageous awards; prepare the necessary contract documents after the CLIENT has awarded the contract. (g) Furnish the necessary engineering supervision and inspection on all construction work, the cost of the same to be borne by the CLIENT as set forth in paragraph (3) (d)4 below. (h) Prepare monthly statements of the value of the work constructed, and final statements upon completion of the improvements. (1) Prepare a permanent record map of the improvements constructed and furnish the CLIENT with a blue -print copy of same. The ENIGNEERS agree that all cost and expents in connection with the foregoing enumerated services will be borne by them except as indicated. (3) The CLIENT agrees to accept and pay for the foregoing enumerated engineering services in the following manner: (a) $300.00 upon delivery to the CLIENT of a preliminary map, report and estimate, together with application for financial assistance if such is requested by CLIENT. (b, An amount equal to 2% of the estimated cost of the improvements upon delivery to the CLIENT 'of final construction plans and specifications. (c) An amount equal to i % of the cost of the improvements constructed each month, payment to be made monthly on the basis of the cost of the improvements constructed during the previous month. 55 (d) The sum of $175.00 per month to cover the cost of one resident engineer and the office overhead and expenses in connection with the work. (e) Upon completion of the improvements any amount which added to the paytent made under clauses (a) , (b) and (c) will equal 40 of the final construction cost, said cost to include the cost of all labor, material, machinery, equipment and purchase of existing utilities or other equipment, but not to include the administrative expense of such as legal, engineering, preliminary, miscellaneous or real.estate and right -of -way costs. (14) It is understoon and agreed that all data furnished by the ENGINEERS shall be construed as the instruments of service and the right to copy or use them or allow them to be used, other than as above indicated, shall not pass from the.ENGINEERS until full payments as set out above are made. (5) It is understood and agreed that if, prior to the delivery of final construction plans and specifications, the CLIENT desires to terminate this agreement, he may do so by returning all data furnished and by paying the ENGINEERS an amount,equai to 10 of the estimated cost of the proposed improvements in conplete settlement for services rendered. (6) It is understood and agreed that no verbal agreements exist outside of the stipulations herein set forth this instrument constituting the entire agreement and under- standing between the CLIENT and the ENGINEERS relative to the subject matter hereinbefore expressed. In.witness whereof the parties hereto have caused their names to be signed and their seals hereto affixed by their duly authorized agents, in DUPLICATE Totem, of Savannah Beach, Georgia J.B McCrary Company Signed Mayor Seal. Seal Dr. Boston was present and was requested to look into the Towns Garbage disposal method as presently used with the view to making suggestions for improving=_it. A committee composed of Councilmen Henry, Ferguson and Daniels was appointed to meet with Dr. Boston. Minutes of the meetings of June 7th, June 18th and July 8th were read and approved. Councilman Slotin read a financial report for the month of June which showed a balance of 48,.490.00. June bills amounting to $1,696.94 were presented. Councilman Griffin moved that these bills be paid. Councilman Henry Seconded, and the motion passed. t U� Councilman Griffin move, that the books of the Town be supervised quarterly by an Auditing Concern for a sum not to exceed $225.00 per year. Councilman Henry seconded and the motion passed. Councilman Slotin moved that several items carried op the books as assets be charged off.as follows: $10.00 charg to Parking Spaces. Check of H. orovitz for 25.00 Check of T.D. Harris for $25.00 Check of Town made payable to Tybee Contracting Company for $57.13. and the following tax items: E.P. Edwards " 657 1939 " 1.12 Councilman Ferguson seconded and the motion passed. f,31 Councilman Slotin moved that the balance of $437. ;) in the Town Hall fund be transferred to the general fund. Councilman. Griffin seconded and the motion passed. Councilman Slotin move, that the balance of $276.21 less $72.64 due Savannah Eie ctric & Power Company, leaving a total of $202.57 be closed out and transferred to the general fund. Councilman Ferguson seconded and the motion passed. Councilman Slotin moved that the finance committee be authorized and empowered to advertise and collect delinquint taxes. Councilman Griffin seconded and the motion passed. Councilman Henry moved that Mrs. Marion W. Councilman Slotin moved that Mrs. Meeks be placed under $1000.00 bond to expire as of May first, 1941. Councilman Henry Seconded and the motion passed. A petition signed by thirteen operators of Merchandise vending machines was presented requesting that the license on Merchandise Vending machines be reduced. Councilman Griffin moved that the present license of $25.00 per machine remain as is. Councilman Ferguson seconded and the motion passed. It was the sense of Council that all unpaid business licenses be paid by 5 p.m., July 15th, 1940.' Councilman Griffin moved that the tax ordinance for 1940 be amended to reduce the fee on penny cigarette. vending 57 machines to $5.00. Councilman Henry seconded and the motion passed., Councilman Griffin moved that the license issued to operate an automatic phonograph at Brigham's Cottage on Inlet Avenue, just South of 16th Street, be revoked, and that hereafter no further license be issued extent for s rooming house. Councilman Daniels seconded.' Those voting -=yes: Councilmen Henry, Griffin, and Daniels. Those voting no: Biotin:. Not voting: Ferguson. A letter was read from Councilman Lovell giving the cost, etc, of- paving several streets.on the Island. Received as information. A request from Dan J. Sheehan that he be given a letter advising him that he would be protected against any damage that may occur due to the sewer line running under his lot on Tybee Inlet was referred to Town Attorney Dutton for handling. Councilman Daniels moved that a telephone be installed in Fire Chief' Solomon's home for use of the Fire Department, at the Town's expense. Councilman Griffin seconded and the r: motion passed. It was the sense of the meeting that Fire Cheif Solomon was using the fire engine on occasions other than for fire emergency purposes. The matter was referred to the Fire and Lights Committee to make rules and regulations, and look after the conduct of the Fire Chief and the Fire Department. Councilman Griffin moved that Officer W.G.. Kendrieks be paid on a basis of 8100.00 per month, retroactive to June 16th, 1940. Councilman Daniels seconded and the motion passed. Councilman Griffin moved that the Savannah Beach Library be paid 810.00 per month for the ensueing year, effective as of May first, 1940. Councilman Henry Seconded and the motion passed. Thomas Reed, formerly Superintendent of Public Works, when he resigned; left a pair of wheels and axel that were bolted on one of our garbage dumps, the wheels and axel being his property. He offered them to the Town for 815.00. Councilman Henry moved that they be purchased. Councilman Slotin Seconded and the motion passed. The number of plumbing fixtures at the DeSoto Beach Club never having been arrived at, the Building inspector was instructed to check on the number there, and report back. Mr. H.F. Sharpley complained about the low area created around his house by the raising of the parking spaces in the vicinity of 18th Street, and requested that a ditch be dug so as to get rid of surplus water. The matter was referred to the Public Works Committee. Councilman Griffin moved that a bill submitted by the 58 Town Attorney for $32.15, covering expenses of a trip to Atlanta in the interest of the Town, be paid. Councilman Slotin seconded and the motion passed. Councilman Griffin moved that in an effort to get W.P.A. help on several proposed projects that would be beneficial to the Town, that Attorney Dutton be requested to go -to Washin4ton to see about getting the projects put through. Councilman Henry seconded and the motion passed. Councilman Griffin moved that the Public Works Committee be authorized to purchase an all steel dump type truck for not more than $1500.00. Councilman Daniels seconded and the motion passed. Councilman Henry moved that M.A. Goette be allowed gas end oil to be used in connection with his duties. Councilman Griffin seconded and the motion passed. Councilman Ferguson stated that he had '.a letter from the Library Committee and also plans for a modern up -to -date library, and asked for advicee on the new Library. It was the Bence of Council that he answer the letter advising that the matter is still pending. It was noted that some of those who had signed an agreement to pay their pro -rata share of the cost of the proposed sea -wall from 2nd Street to 14th Street, have not paid the money they agreed to pay. It was the sense of the meeting that steps be taken immediately to collect this money. A protest was filed by David H. Davis complaining about the noise of the bowling alleys and the shooting gallery on 15th Street and Butler Avenue. Councilman Siotin moved that Councilman Daniels be appointed a committee to make an effort to get Mr. Davis and Mr. Fred Garis together with the view to adjusting the matter amicably. Councilman Griffin seconded, and the motion passed. There being no further business, the meeting adjourned subject to the call of the Mayor.
