by and between the City of Jefferson, t.'.issourij a municipal cor-
poration existing pursuant to the 'laws of the State of Mlssouri
hereinafter referred to as the "Cityll,, ?arty of the First Part:
and William Smith, John Newberry and Paul Stark, of Jefferson
City., Cole County, Missouri, hereinafter referred to as the Real
Estate Sales Agents, parties of the Second Part:
WITHESSETH:
That Whereas the Real Estate Sales Agents are desirous to have
Hawthorne Drive paved., and
Whereas the City owns a tract of land at the northeast corner of
the intersection of Linden Drive and T-Tawthorne drive, the souther=,
y line of which runs for 51.39 feet on Linden Drive the westerly
line lying 108.29 feet on Hawthorne Drive, and the northerly being
the southerly line of lot nuinber 6 fronting on Hawthorne Drive, all
as shown in Plat Book No. 4 at Pages 0-10, Cole County Recorder's
Office.,
IT IS TuEREFORE AGREED:
1. That the Real Estate Sales Agents shall nay to the
City one third (1/3 ) of the cost, as determined by the City Engin-
eer., assessed against the City for the paving of the City pro-
perty for a distance of 108.27 feet on Hawthorne Drive.
2. The City, by the appropriate ordinances and resolu-
tions shall order Hawthorne Drive nerved.
3. Said one third (1/3) cost of the pavement of Hawthorne
Drive shall be made to the City by the Roal Estate Sales Agents
an of L)c-fore thirty (30) days after the issuance of tax bills
therefor,, or, within forty-five (45) days after acceptance of the
work by the City, whichever event is earlier.
IN WITNESS WHEREOF, the parties hereunto have set their
hands on the day and year first above written.
