The amity of Jefferson does hereby vacate and abandon to the adJacent owners the north 12 feet of Dunklin Street between. the west line of Clark Avenue and the first alley west of Clark Avenue. Owens President of the council Uaytbr #4248 AN ORDINANCE PROVIDING FOR THE CHANGING THE GRADE OF Madison Street from a point north of Atchison Street to the south line of Frqnklin Street, and establishing a new grade therefore; providing for the Peening and establishing of a street constitu- ting an extention of Madison Street in the City of Jefferson City to the city lirnits thereof; and providing for the improvement of of the extension of present Jefferson StreetRoad from at or near Swifts Highway in a southerly direction to theCity limits,es- tablishing grades thereupon for the acquisition of private pro- perty, authorizing a contract for the building of said streets by and with the -tate Highway Department of Missouri, with an emer- gency clause, and repealing all ordinance comflicting with this ordinance. 389 BE IT ORDAINED BY THE CITY COUNCIL OF ';HE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: SECTION 1. That the grade line on Madison Street be changed as hereinafter set out from a point north of Atchison Street to the south line of Franklin Street and that there is hereby opened and established as a public highway and as a part of Madison Street in the City of Jefferson ity, Missouri, all of the land beginning a few feet north of the north fide of Atchison Street at Station 4+35 of the- plans now on file in the office of the City Clerk of cefferson City, as trepared and submitted by the State Highway ommission of Missouri, and extending to the city limits at Station 35+o8.6, as shown -on said plans and for the improvement and changes in- grade of the extention of present Jefferson Street Ropd from at or near Swifts Highway, Station 22425, ih AIisoutherly direction to the city limits, at or near Station 31129.1p as shown on said plans all with the varying widths as shown by the sketch attached to and made- a part of this ordinance, that is to say On the Easterly side of Madison Street beginning at Atchison Street Station 4.x35 use present street line which is 40 ft. from the centerline of the proposed Highway and extending to the southerly line of Franklin Street, from the southerly line of Franklin Street Station 14*49.2 the width is 40 feet to Station 21*00, and widens to 75 feet from Station 21400 and extends at said width to the city limits, or Station 35+08.6; on the westerly side of Madison Street beginning at Atchison Street Station 4x35 there is a Right-of-way of 40 ft." from the centerline of the proposed Highway to Station 21+00 and from station 2100 to the city limits centerline' Station 35+08.6 the width is 75 feet from the centerline of ' said proposed Highway; and on Jefferson Street Road beginning at or near Swifts Highway Station 22425 the width on the easteay side of said proposed Highway is 50 feet from the centerline of said proposed Highway to the' intersection of the Madison Street line at .br near Station 29407 and on the westerly side of Jefferson Street Road, the present Right-of-way line along the present road is to be used being a width of approxi- mately 50 ft. from the centerline of the new survey on the Jefferson Street line; for a more accurate and perfect description of said right-of�-way including the irregular right-of-way at intersections, easements, building restric- tions, etc., on said streets reference is hereby made to the map or plat attached hereto and made a part hereof, , and to the plans on file in the office of the City Clerk of the City of Jefferson City, Missouri. SECTION 2. That the grade of said street and highway is hereby established as follows: (a) Madison Street Line beginning at Station 4+00, said point being 75 ft. north of the center of Atchison Street, elevation xx 615.75 Missouri State Highway levels, Jefferson City elevation'187.9 thence on a vertical curve for a distance of 230 ft, to an elevation of 630.69 (city elevation 202.8) thence on a uniform grade for 470 ft. to an elevation of 631.85 ft. (City .elevation 204.0 ft.) thence on a vertical curve for 200 ft. to an elevation of 640.10 ft. (city elevation '212.2 ft. ) thence on a uniform grade to the south line of Franklin Street a distance of 149.2 ft. to an elevation of 652.04 ft. (City elevation 224.2 ft.) and establishing of grade beginning at the south line of Franklin Street to the City Limits Station 35.0.08.6, as follows, south line of Franklin Street elevation 652.o4 ft. (City elevation 224.2 ft..) thence on a uniform grade for 315.8 ft. to an elevation of 682.10 ft. (City elevation 254.2 ft.) thence on a vertical curve for 900 ft. to an elevation of 669.79 ft. (City elevation X90 261.9 ft.) thence on a uniform grade for a distance of675 ft. to an elevation of 647.32 ft. (City elevation 2" G.5 ft. ) thence on a vertical curve for a distance of 108.6 ft. to an elevation of 642.05 ft. (Cit elevation 214.2 ft. ) said last above elevation being at the city limits or Station 35+08.6. (Cityelevation 244.7 ft. ) thence on a uniform rade for a 'distance of 71.6 ft. to an elevation of 667.87 ft. Madison Street grade City elevation 240.0 ft.) and for a more detailed description of said grade elevations reference is made to the plans on file referred to inpction 1 of t1iis ordinance and made a part of the ordinance' by referenaea. SECTION 3. That the lands in said area shall be procured by the City of Jefferson City and be made avail able for the building of said road anal street aceorcing tb d'ai'c� plans at the earliest possible time. The'City of- Jefferson City will bear the entire cost of the acquiring zgxmuKh of such land , including all damabe for change of grade, if anya and will hold harmless the State Highway Commission from all claims for the taking or damag&ng of private property. , SECTION 4. It being desirable and of special benefit to the City of Jefferson City that such road be opened up and constructed, the Mayor is hereby authorized and directed to enter into a contract on behalf of the pity with the State Highway Commission of Missouri, that for and upon the considreation that the said Commission will plan and construct said dtreet upon the plans now. on file or to be filed by said State Hoghway Commission, the City of Jefferson ity will furnish at no cost to said ommission the entire right-of-way-described in the foregoing sections as therein set out. SECTION 5. For and upon the further considreation that the right- of-way department of Division 5 of the State Highway Commission will aid in the securing of said right-of-ways it is further herein provided that said right-of-way department will present to the 'Mayor and ouncil as speedily as possible tentative deeds for said right-of-way as such lands may be acquired at prices which will be epnsidered reasonable by said right-of-way department and by theMayor and council of the city, and upon such presentation so made, vouchers may be issued ppon the City Treasury t in payment of the same; provided, that if it shall be deemed advisable by the Mayor and Common council, option deeds will be taken and payment thereupon deferred until after the whole of said lands shall be placed in a position either by deeds or by condemnation proceedings where title to all lands may be acquired at one and the same time,-in which latter case appropriation of the entire amount of money will be made at the conclus- ion of the acquiring of the whole right of way. Should it be impossible to acquire said lands at reasonable prices as above set out, the City of Jefferson City will cause condemnation proceedings to be lodged in the circuit court to acquire said lands as provided by law. SECTION J. The cost of the construction including the grading and paving of Maid road or street shall be paid for by state funds or by state and federal funds, at no cost to the City of Jefferson City. The same shall be built upon the plans now 6n file in the office of the City Clerk or as may be later amended upon the recommendation of the State Highway Department. The letting of the contracts for the build- ing shall be conducted by the Missouri State Highway Deppstment and the contracts carried out under the supervision of said State Highway Department. s- SECTION . All ordinances or 7 parts of ordinances in conflict with this ordinance be and the same are hereby repealed.
