HomeMy Public PortalAbout463CITY OF MEDINA ORDINANCE NO. 463 AN ORDINANCE AMENDING ORDINANCE NO. 455, AN INTERIM ORDINANCE REGARDING RELIGIOUS INSTITUTIONS AND FACILITIES. THE CITY COUNCIL OF THE CITY OF MEDINA ORDAINS AS FOLLOWS: Section 1. Background. 1.01. On February 3, 2009, the city of Medina (the "City") adopted Ordinance No. 455, an interim ordinance declaring a moratorium regarding religious institutions and facilities within the entire city. 1.02. The City's purpose in adopting the interim ordinance was to protect the on -going planning process associated with the review and amendment of the City's official controls in connection with the amendment of the City's comprehensive plan. 1.03. Since the adoption of the interim ordinance, the City has finalized its review of religious institutions and facilities within the rural areas of the community. This effort has resulted in the adoption of an ordinance which establishes a new rural public/semi-public zoning district which permits religious institutions and facilities as conditional uses and which eliminates such uses from the rural residential, rural residential-1 and rural residential-2 zoning districts. The ordinance was adopted by the City on June 16, 2009, and will be effective upon publication. Section 2. Findings. 2.01. In light of the conclusion of the planning process regarding the regulation of religious institutions and facilities within the rural areas of the community, it is hereby found and determined by the City that the moratorium on religious institutions and facilities is repealed as it applies to areas of the community within the rural public/semi-public, rural residential, rural residential -urban reserve, rural residential-1 and rural residential-2 zoning districts. 2.02. City staff may henceforth accept and process applications regarding religious institutions and facilities on properties within the rural public/semi-public zoning district, subject to such restrictions and processes generally imposed by the City's ordinances and other law. 2.03. Except as specified by this ordinance, the provisions of Ordinance No. 455 shall remain in full force and effect. Ordinance No. 463 July 7, 2009 Section 3. Effective Date. 3.01.
