BE IT ORDAINED BY THE CITY COUIICIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: SECTION 1, That the grade line of the roadway of Church Street from a point 20 feet north of the cneter line of Missouri State High- way No. 50 to the south curb line on High Street, be and is hereby established as follows: Beginning at the center of Church Street and aqF point 20 feet north of the center line of Missouri State Highway No. 50, where the elevation of the grade shall be, 198.70; thence 155 feet on a uniform grade where the elevation of the grade shall be, 214.40; thence 35 feet on a vertical curve where the elevation of the grade shall be, 216.91; thence 50 feet on a vertical curve where the elevation of the grade shall be, 216.87; thence 50 feet on a vertical curve where the elevation of the grade shall be, 212.60; thence 15 feet on a vertical curve where the elevation of the grade shall be 210.48.• thence 55 feet on a uniform grade to the south curb line of High S-Ireet, where the elevation of the grade shall be, 202.04. SECTION2. All Ordinances or parts of ordiannces in conflict with this ordinance are hereby repealed. SECTION 3. Owens Mayor # 4300 AN ORDINANCE PROVIDING FOR THE REGULATINN LICEPtSING, OPERATION ARID EQUIPMENT OF BICYICLES WITHIN THE CITY OF JEFFERSON, MISSOURI, FIX- ING A PENALTY FOR THE VIOLATION THEREOF AND REPEALING ALL OTHER ORDINANCES OR PARTS OF ORDINANCES IN CONFLI,CT HEREWITH, AND FIXING THE TIME WHEN SAID ORDINANCE SHALL BECOMIE EFFECTIVE. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF JEFFERSON, I;IISSOURI, .� AS FOLLOW : SECTIONI. It shall be unlawful for QAy person to operate or use a bicycle propelled wholly or in part by muscular power upon Jim any of the streets, alleys, or public highways of the City of Jefferson, without first obtaining from the police department a license therefor. SECTION 2. The Police departmwit is hereby authorized and d±mz directed to issue, upon written application, bicycle licenses, which shall be ;br the current year of 1940, to and including the 31st day of December, 1940, and thereafter said 'licenses shall issue for the cur- rent year commencinj: with the lst day of January of each call ender year and ending with the 31st day of December of each year. Said licenses when issued shall entitle the licensee to operate such bicycle ' for which said license has been issued upon the streets, alleys, and 9c public highways, exclusive of the sidewalks, in the City of Jefferson, excepting as hereinafter provided. SECTION 3. The City Of Jefferson shall provide, each year :metrallyic licnese plates or seals together with registration cards and isinglass, holders therefor, said license plates and cards to be issued only to those who have passed a written test in the operating of a bicycle and also an actual riding test in the operation of a bicycle with the percentage of ninety ;.er centor better in registration cards issued by' the chief of police or assistants designated by him. The metalidc license plates or seals in numerical order, beginning with number one, 431 indicating the year for wiiich the same are issued and such other letters or figures as may be desiCnated by the chief of police or his assistants; such metallic license plates or seals shall be suitable for attachment upon the bicycles, at a place desil.nated by the police department and it shall be the duty of the police department to attgch one or two metallic license plates to the front and or rear of each bicycle and to issue a corresponding registration card to the licensee upon the payment of the licensee of twenty five (25) cents. Such metallic license plates or seals shall remain attached during the existence of such .license. The police depart- ment shall also keep a record of the date of issue and number of such license and to whom issued. SECTION 4. No person shall ride or operate any bicycle up- on any street, alley, or public place within the corporate limits of the City of Jefferson during the period of a half hour after sunset to a half hour before sunrise, and all times when fog or other atmospheric conditions render the operation of said bicycle dangerous to traffic or the use ofstreets, or at any other time when there is not sufficient light to render clearly di.scerrilble any person on the streets a distance of two hundred dieet ahead without having a lighted lamp affixed on the front of said bicycle and also a reflex mirror or lighted lamp on the rear of said bicycle exhibiting a red light visible under like conditions foram a distance of at least two hun- dred feet to the rear of such bicycler. SECTIONIA. 5.All persons engaged in the business of buying se- cond hand bicycles are heeeby required to make a report to the police department of the purchase giving the name, address and person from whom each bicycle is pv%chased, the description of each bicycle pure.,-,a chased, the .ltame number thereof and the number of the metallic lic- ehse plate found thereon, if anyo All persons engaged in the business of selling new or second hand bicycles are hereby required to make a report -to the police department giving a list of all sales made, which list shall include the name and address of each person to whom sold, the kind of bicycle sold to gBther withxa. description and the frame number thereof and the number of the .:.etallic license plate or seelz attached thereto, if any,P Said reports shall be made within twr;ety four hours from the date of the sale. SECTION 6. It shall be the duty of every person who sells or transfers ownership of any bicycle to report such sale or trans- fer by returning to the police departrriant the registration card issued to such pez-son as licensee thereof, together with the name address of the person to whom said bicycle ►gas sold or transferred, and such report shall be made within five days of the date of said sale or transfer. It shall be the duty of the purchases, or transferee _ of such bicycle to apply for a transfer of registration .thereof within five days of said sale or transfer. SECTION 7. All persons who rent., -hire or loan bicycles shall first obtain license tag or tags to be used on such bicycles by pay- ing therefor the regular fee, which tag or tags shall be attached to the bicycle in a manner so that it may be transferred from one bi- yycle to another to suit the convenience of the owner of said bicy- cles. Persons requiring such tags may secure t:l-e same from the chief of police of said city. SECTION 8. No person shall operate or ride on any bicycle upon the streets, alleys, or public highways in the City of Jefferson with two or more persons upon the same bicycle, provided, however, that this restriction shall not apply to tandem bicycles or other bicycles equipped for two or more riders and no 'ersone shall be permitted to operate a bic,rcle with the passenger in front of the MMr operator. SECTION q. No person, while riding or operating a bicycle on any street, alley or public highway in the' City of Jefferson, shall hold on tb any other vehidle. tr ,•��� SECTION 10, No person shall ride or operate any bicycle on any sidewalk in the City of Jefferson except bicycles used for delivery of :A papers or merchandise and then only in the residential sections of the city when the sidewalk is not being used by pedestrians. SECTION 11. Every person riding or operating a bicycle on any l street, alley or public place!,�n.,..the City of Jefferson shall keep his bicycle on the extreme right of the traffic lane, and it shall be un- lawful for two or more operators of bicycles to travel abreast on any street, alley or public place in the City 'of Jefferson or to operate said bicycle on traffic lanes otherwise than in single file. SECTION 12. Every person riding or operating a bicycle on any street, alley or public place in the City of Jefferson shall be sub- ject to all provisions of the laws of the State of M., ssouri and the ordinances of the City of Jefferson applicable to the drivers of vehicles, except the provisions thereof thatby their very nature can have no application. SECTION 13. It shill be unlawful for 4A y person or persons to run or engage or cause to run or to be engaged in any bicycle race on any street, alley, or •public place within the corporate lim.',ts of the City of Jefferson, except under permit from and supervisions of the chief of police of said city, and every bicycle shall be operated with reasonable regard to the safety of the operator and other persons upon the streets and highways of the city. SECTION 14. Any person who shall violate any of the provisions of this ordinance shall upon ,conviction thereof in the police court of the City of Jefferson be puni,4ched by a fine of not more than $100.00 or by imprisonment. in the city jail not more than ten days, or by both such fine and •imprisonment. In addition to such penalty, the chief of police or poice judge may, either in lieu thereof or in addition to such fine and imprisonment, prohibit the operation upon the streets, alleys, and public places of the City of Jefferson for a period not exceeding thirty days of the bicycle so used in such violation, in which event the bicycle so used in such violation shall be impounded with the chief of police and retained by him for the period that the operation thereof is prohibited, or the owners card or certifiebte shall be held for the period during which the operation of the bicycle is ,prohibited. SECTION 15. No person shall deface, w*i. ilate or remove a license tag placed upon any bicycle, nor shall any person take any bicycle for the purpose cf riding or propelling the same upon the streets or public highways without the consent of th,: owner. SECTION .6. Tags shall not be transferred from one bicycle to another and no person shall attach to any bicycle a tag not issued for use thereon. Upon loss of any such tag or duplicate and upon application and satisfactory evidence of such loss a new tag or a new duplicate shall be issued upon payment of a fee of twerity-five (25) cents in the manner thereiribefore provided. SECTION 17. All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed and this ordinance shall be in force and effect from and after its passage and approval.
