SECTION. 1. Whereas, it wos heretofore fo nd and declared
by the City Council, by its resolution, gassed and approved on
February 5th o ,1940- necessary to-pave with penetration bi-
tuminious macadam the roadway of Si. . Mary' s Boulevard between
the curb lines from a point 145 feet east of the east curb line
of Waverly Street to the center of the intersection of S . Mary' s
Boulevard and Giffert Lane and it appearing to the City Council that
said resolution has been duly published according to the law for
mgre that seven (7) consecutive dasertions, in the Jefferson City
Post-Tribune , a daily newspaper, printed and published in
tRe City of Jefferson, tlissouri, and a majority of the residents
owners of property along said section of St. Mary' s Boulevard
liable for the costs of said improvement, and who own a majority
of the front feet on said ST. Mary' s Boulevard intended to be
improved, have not filed with the City Clerk a protest against
said contemplated improvement.
SECTION 2. That the said road of St. Mary' s Boulevard
between the curb lines from a point 145 feet east of the east
curb line of Waverly Street to the center of the intersection
of St. Mary' s Boulevard and Giffert Lane, be graded, curbed where
necessary with cement material and paved with penetration bi-
tuminious material in accordance with the plans and specifications
bubmitted by the City Engineer and filed in the office of the
City Clerk, and that the total cost of the work aforesaid shall
be charged and levied as a special assassment against the real
estate abutting and fronti ng on said contemplated improvement,
add special tax bills shall be issued therefor, as provided in the
City Charter, and in Section 822,823,824 and 825 of Chapter 44
of the Revised Ordinan ces of the City of Jefferson, Misso!.iri,
1925, and of the Revised Statutes of the State of Missouri, 1929, and
amnedments thereto.
SECTION 3. The City Engineer is hereby instructed to advertise
for bids for this improvement.
SECTION 3. This Ordinance shall tike Gffect and be in force
from and after its passage and approval.

AN ORDINANCE PROVIDING FOR THE SUBMISSION AT THE GENERAL ELEC-
TION TO HE HELD IN THE CITY OF JEFFERSON CITY, I.ZISSOURi, ON THE
2ND DAY OF APRIL, 1940, OF A PROPOSITION TO INCUR AN INDEBTEDNESS
AND ISSUE BONDS OF SAID CITY IN EVIDE,^TCE THEREOF IN THE AA�OUNT OF
NINETEEN THOUSAND DOLLARS ($19,000) for the purpose of purchasing,
additional equipment useful in the extinguishing of fires; pro-
viding for said election and the notice thereof and the form of
ballot to be used thereat.
WHEREAS, the City Council of the City of Jefferson City,
in Cole;'Co;znty, Missouri., fii:ds and deems it necessary for the
maintenance of the fire department of said City, to purchase
additional apparatus useful in the cxtinguislhing of fires; and
WHEREAS, the City Council does now find and deter,::ine
that the cost bo the City of the aforesaid improvement will be
approximately 1Yirieteeih Thousand Dollars ($1( ,000) ; and
WHEREAS, there are not sufficient funds in the treasury

of said City out of which to pay said sum; and
V1IiEREAS, SAID sum, when added to current expenditures,
exceeds the, income and revenue of said City for the year 1940;
and
WHEREAS, the said City is aut)jorized to incur an indebtedness
fpr said purpose upon the of two-thirds (2/3 or more of the

qualified voters of said City voting at an election called and
held for that purpt_-se, provided t rt the indebtedness so incurred,
together with all other indebtedness existing acid outstanding
against the said City, does not exceed five per centum (>p) of the
assessed valuation of taxable property in the City as ascertained
by the assessment for State and County purposes made as of June lst,
1937; and
WHEREAS, the assessed valuation of taxable property in said
City, 2s ascertained by the assessment for State and County purposes,
made as of June 1, 1937, being the assessment next before the last
fully ampleted and equalized assessment of taxable property is

WHEREAS, the said City has outstanding the following indebted-
ness, and none other:

to the aforesaid outstanding indebtedness will not In the aggregate
exceed five per centum (5p) of the assessed valuation of taxable
property aforesaid, and will riot exceed any constitutional or
statutory limitation of indebtedness; and

to the qualified voters of laid City, at the next general municipal
election to be held on Tuesday, the 2nd day of April, 1940, the

of the City of Jefferson City, at the next general municipal election

PROPOSITION
To increase the indebteddess of the City of
Jefferson City, County of Cole, M., sso ri, in the
amount of Nineteen Thousand Dollars ($19,000) for
the purpose of purchasing additional apparatus
useful in the extinguishing of fires, and to author-
ize ti:e issuance of bonds of said City in said
amount for said purpose.
SECTION 2. That sAid election shall be held in all
wards and precincts of said City, at the places designated as the
polling places for said general municipal election, end shall be
conducted by the judges and clerks designated to act as such in
said general election, and shall be held and conducted in accord-
ance with the law.
SECTION 3. That the City Clerk be and is hereby authorized
and directed to give notice that slid proposition will be submitted
to the qualified boters of said City at the general election to
be held April 2nd, 1940, as aforesaid, by publication in The Dailv
Ca itol Newer , , Said notice shall be published once a week for
three ' (3) consecutive weeks, and the first publication thereof shall
be at least twenty-one (21) days beofre the date of said election.
The last publication shall be within two weeks of said date. Said
notice shall be in substantially the following form:

election to be held in Jefferson City, 1.1issouri on
Tuesday, April 2, 1940,
There will be submitted, pursuant to an ordinance duly
adopted by the City Council of said City, the following
proposition:
PROPOSITION
To increase the indebtedness of the City of
Jefferson City, County of Cole, 14. ssouri, in
the amount of Nineteen Thousand Dollars ($19,000)
for the purpose of purchasing additional apparatus
useful in tiie extinguishing of fires, and to auth-
orize the issuance of bonds of said City in said
amount for said purpose.
