OFFICH OF '1/EIU1!..AST=,R. - At the first meeting of the City `ouncil after the regular April election in 1941, and every year there the Yayor, V-ith the consent of the Council, shall 129 appoint some suitable person t6 tn(--,- office of Weighmestero who shall hold his office for the terri of one (1) year, and until his successor is appointed and quaIJ.f'j.(-,,d. SECTICN ci89. BOTM AND OATH OF OFFICE. SECTIOV 9c,0. DUTIES OF TFF CITY WEIGHT]ASTER. It shall be the duty of the City Weighmastei to take charge of the city scales and to see that they are kept in condition t-- furnish exact weights and remain in attendance at said scales fcr the performance of hit duties hereunder. SECTION 091. WEIGH11"ASTER SHALL GIVE CERTIFICATE OF WEIGHT . The Weigh:.,aster shall procure from the City "lerk weight blanks whi6h shall be furnished by the city, Said clerk shall charge the 1,11eigh- master with all Dlanks so furnished and credit him with the number of blanks returned at each settlement. The weighmaster shall furnish the party having his corinoditiy weighed,, with a certificate of weight upon the weight blanks aforesaid. The said blanks shall be of the form prescribed by the City "ouncil and shall be numbered serially. SECTION 992. ACCOUNTING AND SETTLEMENT OF CITY WEIG141.11ASTER. It shall be the duty of the City Weighmaster to acount for and pay ovel. to the City Treasurer at the end of each month,, all monies that he has received for weighing., ehd take the treasurer' s receipt t-,hcrefor on the first day of each month. FEES TO FE 6FARGFD AT CITY SC •AES . SECTI('.)IJ c)97. 1,7E'IGHIN G OVER SCALES OF PRII,,-ATE COOL DEALER. It shall be the duty of the City 71eighmaster to check, test and determine the accuracy of any scales of any coal dealer or mine owner within a radius of five miles - f the City of Jefferson, and when such scales are so ' �,sted and found to be true @nC, to weich accuately the owner of such scales as a coal dealer or mine owner may weigh the coal) fuel or coke which he sells in Jefferson City over such scales. All other perscns,, firms ur corporations selling copi within the city limits of the City of Jefferson shall have Jt. *,,,.e same eighed upon the city sclaes and shall bn demand produce the City 17eiw, gh. aster weight certifucate therefor. SECTION 998. PERSONS SELLI1-JG FUEL TC FURPISli DRIVERS DFLIVrRY TICKETS. Every person, firm or corporation engaged in the business of selling or delivering coal., Charcoal or coke to another in less than carload lots Mitch are sold on a basis of railroad or mine scale weights, shall provide the driver., or other person in charge of the vehicle containing any such fuel so being sold or delivered with a duplicate delivery ticket bearing the name of the person, firm or corporation selling or 6elivering such fuel and showing the kine the county and state in which mined and the gross., tare and net weight of the fuel, the place of delivery Fnd the name of the purchaser thereof., such weights so shown to be made only on a scale or scales tested by or under the jurisdiction of the City Weighmaste • of the City 6f Jefferson and such driver or other persin while said fuel is in transit shall keep said delivery ticket in his possession and pro- udce and exhibit the setae upon demand as provided in Section of this article. and he shall deliver the same to the purchaser of such fuel or to his agent or representative at the time oo delivery thereof. Every person . form or pa)rp(.,rat!on who shall. neglect or refuse to provide such driver with the 6uplicate delivery ticket herein re- quired, shall be deemed guilty of a misdemeanor and upon conviction be fine not less than five dollars nor more than one hundred and fifty dollars. SECTION: 999. DELIVERY OF FUEL TO OTHER THAN, PURCT7ASER PET!ALTY. 1. .9 AZzy driver or' other person in charge of any v hicle containing any such fuel being delivered to the purchaser thereof who shill, while the same id in transit, throw off or deliver any part of such fuel to any other than purchaser thereof shall be deemed guilty of a misdemeanor and, be fined not less than five nor more than fifty dollars. SFCTION 1000. YAY BE BTF.'EIGHED UPON CITY T7,ZTED SCALES; INHEN. Each driver or other rerson in charge of any vehicle used- in delivering any such fuel shall, on demand of any officer of the Gity of Jefferson., or the purchaser or intended purchaser of such fuel, produce and de- liver said duplicate delivery tickets to such officer or purchaser) and shall upon the request of any such officer or purchaser forthwith conv convey the said fuel to t, e nearest city tested scales, other tlian the scales belonging to the seller of suchfuel, in the neighborhood of the plave where such demand is made., and have the same weighbd on such scales for the purpose of ascertaihning the gross weight thereof., and shall) after the delivery of such fuel,, return to the same scale and permit weighing of said vehicle and equipment for the purpose of ascer- taining the net weight (;f such fuel as verified by such city tested scales. If the net weight of the lead equals the net weight as shown on the city scales., then the person requesting said weight on the city scales shall pay the fee therefor; except, however, it will not be necessary fo: any police officer of the city or state to pay- said fee.
