RESOLUTION NO. 61- 9 6
WHEREAS the City of Richland Hills has heretofore adopted certain land use
assumptions, a capital improvements plan and impact fees based thereon, in order
to reimburse the City of the cost of capital improvements necessitated by new
development within the City; and
WHEREAS, the City of Richland Hills has employed consultants to determine,
as required by law, whether a need exists to update the land use assumptions,
capital improvements plan and impact fees; and
WHEREAS, the consultants retained by the City have determined that no
update is neccessary to the land use assumptions, capital improvements plan and
impact fees; and
WHEREAS, the Capital Improvements Advisory Committee of the City of
Richland Hills, Texas, has studied the material furnished to them by said
consultants, and has filed its written comments on the need for updating the land
use assumptions, capital improvements plan and impact fees before the 5th business
day before the earliest notice of the City Council's decision hereunder is to be
published; and
WHEREAS, based on the information and recommendations provided to it by its
retained consultants, and based on the written comments of its Capital
Improvements Advisory Committee, the City Council of the City of Richland Hills,
Texas, has determined that there is no need for preparation of updates to the land
use assumptions, capital improvements. plans or impact fees currently in effect
within the City.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF RICHLAND HILLS, TEXAS:
I.
That the City Council of the City of Richland Hills, Texas, hereby finds and
determines, based on information and recommendations supplied to it by its
retained consultants and by its Capital Improvements Advisory Committee, that no
changes to the land use assumptions, capital improvements plan or impact fees
currently in effect within the City are needed; and
BE IT FURTHER RESOLVED, that the City Secretary is hereby directed to
publish notice of this determination, in the form and manner provided by law, once
a week for three consecutive weeks in a newspaper of general circulation within the
county, in the form attached hereto and labeled Exhibit "A", along with a map of
the corporate boundaries of the City.

NOTICE OF DETERMINATION NOT TO UPDATE LAND USE
ASSUMPTIONS, CAPITAL IMPROVEMENTS PLAN, OR IMPACT FEES
1. The City of Richland Hills, based upon the recommendation of its consulting
engineers, Huitt-Zollars, Inc., has determined that no changes to or updates of
the May, 1990 Capital Improvements Program and Impact Fees Study are
required.
2. Specifically, the City Council of the City of Richland Hills, Texas has
determined that no change to the Land Use Assumptions, Capital Improvements
Plan, or Impact Fees adopted in May of 1990 is necessary or required.
3. The service area described in the May, 1990 Capital Improvements Program
and Impact Fees Study encompasses the entire area within the corporate
boundaries of the City of Richland Hills, Texas.
4. Prior to Thursday, June 13, 1996, any interested person may make a written
request that the that the Land Use Assumptions, Capital Improvements Plan, or
Impact Fees contained in the May, 1990 Study conducted by Huitt-Zollars, Inc.,
consulting engineers for the City of Richland Hills, Texas, be updated in
compliance with Sections 395.052-395.057 of the Texas Local Government
Code.
5. The name and mailing address of the official of the City of Richland Hills,
Texas to whom a request be made for an update of the May, 1990 Land Use
Assumptions, Capital Improvements Plan and Impact Fees is James W. Quin,
City Manager, City of Richland Hills, Texas, 3200 Diana Drive, Richland Hills,
Texas 76118.
