Councilman Presents the following Ordinance Seconded by Councilman
AN ORDINANCE OF THE BOROUGH OF
CARTERET ADOPTING AMENDEDMENTS
TO THE LOCUST - ROOSEVELT
REDEVELOPMENTPLAN
WHEREAS, the Local Redevelopment and Housing Law, N.J.S.A. 40A: 12A-1 et seq.,
as amended and supplemented (the "Redevelopment Law ") provides a process for
municipalities to participate in the redevelopment and improvement of areas in need of
redevelopment; and
WHEREAS, on February 25, 2016, the Borough adopted Resolution No. 16 -43 declaring
the properties identified on the Borough's tax map as Block 6805, Lots 1 -8 and 22 -29 as
an area in need of redevelopment (the "Original Redevelopment Area") in accordance
with the Local Redevelopment and Housing Law, N.J.S.A. 40A:12A -1 et seq. (the
"Redevelopment Law"); and
WHEREAS, on May 3, 2018, the Borough finally adopted Ordinance No. 18 -7
approving the Locust - Roosevelt Redevelopment Plan (the "Original Redevelopment
Plan"); and
WHEREAS, on December 9, 2021, the Borough adopted Resolution No. 21246
declaring Block 6805, Lots 9, 10, 11, 19,20 and 21 as an area in need of redevelopment
pursuant to the Redevelopment Law (these properties together with the Original
Redevelopment Area shall be herein referred to as the "Redevelopment Area "); and
WHEREAS, the Borough's Planner, Beacon Planning and Consulting Services has
prepared an amendment to the Locust - Roosevelt Redevelopment Plan (the "Amended
Redevelopment Plan"), a copy of which is attached hereto and made a part of this
Ordinance, to incorporate Block 6805, Lots 9, 10, 11, 19 20 and 21 therein; and
WHEREAS, pursuant to N.J.S.A. 40A:12A -7.e., upon introduction of this Ordinance,
the Amended Redevelopment Plan shall be referred to the Carteret Planning Board for
review and issuance of a report containing its recommendations, if any, concerning the
amendment to the Redevelopment Plan within 45 days of referral.
NOW THEREFORE, BE IT ORDAINED AND ENACTED, by the Borough Council
of the Borough of Carteret, Middlesex County, New Jersey, as follows:
Section 1. The Amended Redevelopment Plan is hereby adopted as the
official redevelopment plan for the Redevelopment Area,
Section 2. The zoning district map of the Borough's Land Development
Ordinance is hereby amended to reflect the applicability of the
Amended Redevelopment Plan to the Redevelopment Area and
the Borough's Land Development Ordinance as it affects the
Redevelopment Area is hereby superseded by the Amended
Redevelopment Plan to the extent set forth therein.
Section 3. Any and all ordinance or resolutions of the Borough, or provision
thereof, inconsistent with the provisions of this Ordinance shall be
and are hereby repealed as to the extent of any such
inconsistencies.

Section 4. If any section, subsection, part, clause or phrase of this Ordinance
or the Amended Redevelopment Plan shall be declared invalid by
judgment of any Court of competent jurisdiction, such section,
subsection, part, clause or phrase shall be deemed to be severable
from the remainder of this Ordinance or the Amended
Redevelopment Plan, as applicable.
Section 5. This Ordinance shall take effect upon final passage and publication
in accordance with applicable law.
