AN ORDINANCE, OF THE BOROUGH OF CARTE RE,
ADOPTING AMENDEDMENTS TO THE' WASHINGTON
AVENUE REDEVELOPMENT PLAN
WITCRE,AS, the Local Redevelopment and Housing Law, N.J.S.A. 40A:12A -1 et seq.,
as amended and supplemented (the "Redevelopment Law ") provides a process for
municipalities to participate in the redevelopment and improvement of areas in need of
redevelopment, and
WHEREAS, on June 12, 2006, the Council of the Borough of Carteret, a municipal
corporation in the County of Middlesex and the State of New Jersey (the "Borough "), in
accordance with the Redevelopment Law, duly adopted Resolution No. 06 -38 designating
sixty-four properties along Washington Avenue as an area in need of redevelopment (the
"Original Redevelopment Area'); and
WHEREAS, on June 15, 2006, in accordance with the Redevelopment Law, the Borough
finally adopted Ordinance No. 06 -33 adopting the Washington Avenue Redevelopment
Plan for the Original Redevelopment Area; and
WHEREAS, on December 9, 2021, the Borough adopted Resolution No. 21- 246
declaring Block 6804, Lots 8 and 9 as an area in need of redevelopment pursuant to the
Redevelopment Law (these properties together with the Original Redevelopment Area
shall be herein referred to as the "Redevelopment Area ") ; and
WHEREAS, the Borough's Planner, Beacon Planning and Consulting Services has
prepared an amendment to the Washington Avenue Redevelopment Plan (the "Amended
Redevelopment Plan'), a copy of which is attached hereto and made a part of this
Ordinance, to incorporate Block 6804, Lots 8 and 9 therein; and
WHEREAS, pursuant to N.J.S.A. 40A:12A -7.e., upon introduction of this Ordinance,
the Amended Redevelopment Plan shall be referred to the Carteret Planning Board for
review and issuance of a report containing its recommendations, if any, concerning the
amendment to the Redevelopment Plan within 45 days of referral.
NOW THE, RE,I, ORE, BE IT ORDAINED AND ENACTED, by the Borough Council
of the Borough of Carteret, Middlesex County, New Jersey, as follows:
Section 1. The Amended Redevelopment Plan is hereby adopted as the
official redevelopment plan for the Redevelopment Area.
Section 2. The zoning district map of the Borough's Land Development
Ordinance is hereby amended to reflect the applicability of the
Amended Redevelopment Plan to the Redevelopment Area and
the Borough's Land Development Ordinance as it affects the
Redevelopment Area is hereby superseded by the Amended
Redevelopment Plan to the extent set forth therein.
Section 3. Any and all ordinance or resolutions of the Borough, or provision
thereof, inconsistent with the provisions of this Ordinance shall be
and are hereby repealed as to the extent of any such
inconsistencies.

Section 4. If any section, subsection, pall, clause or phrase of this Ordinance
or the Amended Redevelopment Plan shall be declared invalid by
judgment of any Court of competent jurisdiction, such section,
subsection, part, clause or phrase shall be deemed to be severable
from the remainder of this Ordinance or the Amended
Redevelopment Plan, as applicable.
Section 5. This Ordinance shall take effect upon final passage and publication
in accordance with applicable law.
