GL'1�1.)i01:v BE IT -RESOLVED BY THE GlTY u uuNuib OF THE CITY OF JEFFERSON, AS FOLLOWS: Section 1, Section 835, Revised Ordinances of the City of JefTerson, 1941, is hereby repealed. Section 2. CERTIFICATES OF CONVENIENCE AND NECESSITY.- Hereafter it shall be unlawful for any person, firm, association or corporation to engage in the business of operating a taxicab business unless such person, firm or corporation shall first ac- quire from the City of Jefferson a certiricate of convenience and necessity; provided, however, that those persons, firms =r cor- porations engages in the taxicab buismess at tree time of Lne passage ofttiiis ordinance shall be presumed to be convenience and necessity to$ the public welfare and shall be permitted to operate until their applications are passed on by the Police `'oard fob the City of Jefferson, Before additional licenses are issued by the Police ,oard of the ''ity of Jefferson it shall be necessary for the per- . son, firm or corporaLion desiring said license to operate a taxicab business to file a written application with the City -lerk, add- ressed to the Police Board:,:af• the .City. of "efferson, and (a) Said written application shall have attached to it as an exhibit, :a financial statement showing the true financial state- ment of the operator; (b) Said application shall show the number of- taxicabs owned by the applicant and to be used in the taxicab business, together with a complete description of laid taxicabs, showing the year, make, model and motor number of such vehicle; 418 (c) Said application shall briefly stpte the reason why the public convenience and necessity will be served by the granting oft. the application. Upon tLe filing of said application the "ity Clerk will cause the same to be filed with the Police I'oard of the City of Jefi'erson and the Police , oard of the city of J efferaon will cause said application to be set down for public hearing, at which hearing evidence will be taken to co::sider the needs and the effects of the additional service, and the Police "oard shall cause the �'ity "I erk to give ten days written notice to all persons, forms or corporations then and there engaging in thetaxicab business and all those persons, firms or corporations holding a certificate of convenience and necessity to engage in the taxicab business. The Police Poard in determining whether a certificate of con- venience and necessity shall be issued to the applicant shall take into consideration the following: (a) The number of taxicab owners licensed and the number oftaxicabs in operation, (b) Whether requirements of public convenience and necessity canbbe met and complied with only by the issuance of additional licenses; (c) The resulting effect upon the business of existing licenses and upon the existing agencies of transportation in the City; (d) Traffic congestion and its relation to_ traffic movement and to the safety of the public using the streets;' (e) The financial responsibility of the applicant; (f) Whether applicant is a law-abiding, moral and upright 4. citizen. (g) Any other facts which may be revelant. No certificate of convenience and necessity shall be issued by the Police board to any pr=rson, association or corporation who at the time of the hearing does not own at least two four-door vehicles, which vehicles shall be exclusively used in said taxicab business. At said public hearing existing common carriers of persons operating within Jefferson Iity *all be notified and b shall have an opportunity to defend against the application and to 419 show that the convenience and necessity of the ; ublic ,wit 1 not be served ny ne granting of such application. When said cetti- ficate of convenience and necessity is issued by the Police "oard of the City of Jefferson the City Clerk of the City of Jefferson shall notify the applicant and issue the applicant a license; provided, however, that said applicant must meet all the requirements of Chpater 16, Re- vised Ordinances of the City of Jefferson, 1941. All operators and all taxicabs engaging in business at the time of passage of this ordinance shall automatically be granted a certifi- cate of convenience and necessity to engage in business and such taxi- cabs or vehicles shell not be required to meet the restrictions con- tP fined herein. Section 3. REVOCATION OF OPERATORS LICENSES,- The Police hoard may revoke a certificate of convenience and necessity already issued a taxicab operator for the following reasons: 1. If the operator fails to engage in the taxicab business for a period of thirty days; 2. If the operator has made misrepresentations before the Police -Board in order to secure his certificate of convenience and necessity; 3• For the violation of any law or ordinance; 4. ,Permitting drivers to operate without having a taxicab driver' s license as provided by the City Ordinances; 5. Whenever the operator is found to be operating his business `k in illegal or immoral manner. Section 4. TRANSFER OF LICENSE.- No taxicab operator shall have '-� the right to transfer his license to another operator without first having obtained the consent of the Police 'oard and the new applicant shall always file an application showing the same facts as eee re- quired in the original application for certificate of convenience and necessity. Section 5. Any and all ordinances or parts of any ordinances in conflict herewith be and the same are hereby repealed. Section 6. 'his ordinance shall take effect From and after its passage and approval.
