Section 1. ,that the following described streets arldiE alleys
be vacated as such, which land so vacated as streets and alleys is
described as follows., to-wit:
All that part of Union Avenue lying between the west
line of 1',-'�nroe Street and the east right of way line of
U. S. Highway No. 54.
All that part. of Henry Street lying between the South
line of Union Avenue and the north line of Russell Street.
All that part of Case Avenue lying between the west
line of KOnroe Street and the East line of 'Henry Street.
All that part of the alley lying between Case Avenue,
Union Avenue, Henry Street and Tlronroe Street.
Section 2. All ordinances or parts of ordinances in conflict
herewith be and the same are hereby repealed.
Section 3. this ordinance shall become effective upon its
passage and approval.

AS FOLLOV-IS:
Section 1. The way-or of the 'ity of Jefferson., Missouri., a
municipal corporation., is hereby authorized and d6rected to sign ?nd
execute on behalf of the Uity of Jefferson, 1.1i s sour-1 , a certain
agreement with the J. C . Penny ompany., a corporation., the terms of
said agreement to be as follovisp to-wit:
"THIS SUPPLEMENTARY AGREElt-ENT Ai.TD LEASE, made and entered
into as of the first day of August., 1946 by and between the

"Landlord ' and J. C . PENh)f COf.!PANY, a corporation existing
under the laws of the State of Dcllaware with offices at
No. 330 west 34th Street., Few York 1., 11,. Y. ,, hereinafter
called the "Tenant" .

1"IIIEREAS, by Indenture of i-ease dated October 15, 1934,
RECORDED THE �`RD DAY OF May 1935 in the office of the Recorder
of Dpeds of the County of Cole, State of Missouri in book
86, "age 489, the Landlord demised and leased to Tenant cer-
tain promises located at No. 240 Fast High Street in the
`pity of Jefferson, County of Cole, State of 1"tissouri., said
demised premises being more particularly described therein.,
for a term of ten (10) Years from the 15th day of September
1935 until the loth day of September 1945,0 which said lease

until September 14, 1950 pursuant to fin opf,ion corrteined therein giving

virtue of said lease dated October 15, 1934 include a part of the
basement of the building of which the der1ised premises are a part,
and the Landlord has agreed to lease and de..iise the to Tenant
additional space in the basement of said building upon the terms,
covenants and conditions hereinafter set forth.
I'DIO'N THERIFORE, in consideration of the mutual terms, covenants
ar�d conditions hereinafter set forth, the parties hereto do here-
by mutually convenant and agree as follows,:
111. Landlord does hereby demise and lease to Tenant the
entire space located iri the base : ent of said building presently
occupied by Tenant pursuant to said lease oated October, 15, 1934,
excepting therefrom a space approximately twenty-four feet (241) by
twelve (121 ) feet used as a boiler room and reserving to Landlord
the right of access to said boiler room through the space measuring
approximately twenty five feet . (251 ) by twelve feet (121 ) located
in the southeast corner of said basement adjacent to and east of the
space formerly used for a coal. room; TO HAVE AND TO HOLD the said
additional basement floor space, together with all and dingular
the improvements, appurtenances, rights, privileges and easements
thereunto belonging or in anywise appertaining unto the sais Tenant
from the 15th day of August, 1946 f'or, during and until the date on
which said lease dated October 15, 1934 as extended terminates and
endsgi that is, September 14, 1950.
112. Landlord hereby covenants and agrees that it will
immediately make said additional space hereby demised suitable
and ready for use and occupancy by Tenant so that said space may
be used by Tenant in connection with the premises demised tinder said
lease dated "ctober 15, 1934.
"3. Landlord agrees that it will at its own cost and
expense promptly close up the opening in the wall or partition
forming the south side of said boiler room leading into the space:
to the south thereof' and adjacent thereto formerly used for a coal
room in accordance with pl?ns and specifications satisfactory to Tenant
114. Tenant hereby covenants and agrees that the rent pay-
able under said lease ated October 15, 1934 during the remainder
of the term commencing August 15, 1946 shall be at the rate of
forty-dine hundred fifty dollars ($4,950) per annum payable in the
sums of four hundred twiUve dollars and fifty cents ($412. 50) per
month.
15.Said additional space hereby demised shall be and the same hereby
is made apert of the premises dern$sed and leased by Landlord to
Tenant pursuant to said lease dated October 15, 1934, as extended
and said additional space shall be held ?rid enjoyed by Tenant
upon and subject to all the te;•ms, covenants and conditions of
said lease as extended and as hereby supplemented modified and
amended. As hereby sgpplemented,modified and amended, the parties kJRgR
hereto do hereby ratify and confirm all the terms, covenants and
conditions of said lease dated October 15, 1;,34 as extended.
116. this agreement shall be binding upon and inure to the benefit
of the parties hereto, their successors in interest and assigns.
Section 2. All ordinances or parts of oridnances in conflict
with this ordinance sre hereby repealed.
Section 3. this ordinance shall take effect and be in force
from and after its passage and approval
