Owens President of the Uouncil Tylayor #4883 AN ORDINANCE to create a retirement system for firemen in the city of Jefferson, Y., ssouri , and to provide bt Ordinance for the retirement of the members of such a department and the widows and md)n(hr child- ren of deceased members in accordance with its provisions, and to take from its municipal revenue a fund for such purpose., providing for a board of trustees having exclusive contorl and management of the fund, the power and duties of the board, and for judicial review of its actions;providing the sources of the fund, and prescribing the contributions to the fund by members of the fire department, the benefits payable out of the fund and the :,-)ersons entitled to receive them., exempting the benefits form attachment, execution, garnish- ment., or 'other legal process; making the violation of vertain of its provisions a misdemeanor punishable by fine and impr(bsonment. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF JEFFERSON, 14ISSOTIRI, AS FOLLOWS: Section 1. A firemen retirement fund and a board of trustees of the firemen's retirement fund is hereby created in the ity of Jefferson., Missouri., to orovide for the retirement of the M^emL3ers as provided in this ordinnnee, and to take from its municipal revenue a fund for such purposes. .A. Section 2,' . "Ihe fund shall beunder the exclusive management and - cor-.trol of a board of trustees known as the "Firemen's Retirement ,und of the ity of Jefferson, Missouri"p in which nane it shall transact all. its business and hold all its monies., securities and other pro- pertyq The Board shall consist of' the Mayor of the (lity of Jeffersa-.. , ans two members appointed by the YqTor with the consent � d approval of the City Council, the city Treasurer, the Chief of the ire' deoart- ment., and two members of the Fire Departyrent elected by the members thereof, such elections to be held on the first Monday of June of each year for terms of two years. Section 2. (a ) he board of trustees s}zall keep in convenient form such data as shall, be necessary for acturial valuation of the funds of the retirement system, and for checking the experience of the system. (b) 'he board of trustees shall beep a r ecord of all its proceedings, which report shall be open to public inspection, Said trustees shall anniielly make a report to the city Council at its regular council meeting in the month of July of each year showing its fiscal transactions of the retirement s-rstem for the preceeding fiscal year which shall be from July 1st of each ,year, the amount of a accumulated cash and securities of the system, and the last balance sheet shoeing the financial condition of the system by means of an actrurial valuation of the assets and liabilities of the retirement . system. 'he trustees shall also publish in a dialy newsppper in the ity of Jefferso-- , Missouri, at least twice during the month of July of each year said report in full. (c) The board shall make rules en dregulations for the govern- ment of its affairs, the administration of the fund and for the limitation of the time within which claims may be filed. It shall have exclusive jurisdiction of all retirement claims, benefits or refunds9 It shall hold hearings and take and preserve the evidence on all disputed matters and the evidence, record and final finding, and decisions of the board shall be subject only to review by omit of cer•ti.oriri, with the right of appeal. as in civil cases from the de- cision of the reviewing court. Section 4. The retirement fund shall consist (a) Of all monies that may be given to such board or fund by my person or persons for the uses am d purposes for which such fund is created. hnd such board may take by gift, grant, devise or bequest any meney, personal property, real estate, or interest therein, or any right of property; and any such gift, Grant devise or bequest may be absoilute or in fee simple, or upon condition that only the rents, incorr.e of profits arising therefrom shall be applied to the purposes for which such fund is established. (b) Off all monies, fees rewards ro e,r:oluments of every nature and description that may be .laid or given to the airs Department, or any member thereof, for services .or duties performed. (c ) Every member of the „ire Department shall be assessed three per cent )Jo) of his salary, to be paid in regular monthly payments, which sum is to be deducted from each members compensation which is due 'rim n the first day of each month; this is to be done by the City 'Jlerk, who in turn shall give said amounts to the `,ity zA Treasurer, who in turn shall deposit same to the credit of the fire- men's retirement fund, Every person who be omes a member of the fire department shall be liable to the aforesaid assessment, and, in beccming a member thereof shall be conclusively deemed to undertake and agree to pay the same and to have it deducted from its compensation as herein provided. (d:: A sum of one (1) mill shall be levied on each dollar of the vaue of all taxable property annually assessed in the city of Jefferson, Yissouri , as th—:; dem a appears on the tax duplicate, which stun shall be set aside and made part of the 1'i.remeri' s retirement fund, by the City lerk; provided, that said size shall riot be used for or devoted to any purpose other than herein specified. Section 5. The board shall invest and reirivest all assets of the fund Ln excess of a sefe operating balance, but investment shall only be in bonds or other securities of the state or of the United States, or fully guaranteed by the United States, approved bonds of other securities of aV county, municipality, shcool or road district in the state, judgements against the county of inunicipal ity, or general c (' 2 6 or special tax bills against persons or proporty in the municia )lity. All persons who becomes members of the fire de- partment after the est; blishiiant of the fund shall be subject to the provisions of this ordinance as a condition of their employment. Each member of the fire Department at the time the fund is es- tablished, shall be subject to this ordinance. tinder riles of the board erch oerson who is a member og the " ire Department at the time the fund is est blished, shall file with the board a detailed statemnt of all prior service as a fireman for which he claims credit. the board shall fix by rule how much service in any callendar year shall con- stitute a year 's services but absence without pay for any period of coo more than one month 's duration shall not be eonted as service. The board shall promptly varify the statement of service, and upon verification thereof shall issue to each member a certificate of the length of his prior service on the basis of his statement. Such certificate may be modified at the requesr of the member or the board within one year from the date of issueance or modification thereof, m d udless so modified, shall be final and conclusive as to the length of prior service. Vihen a member leaves the service of the department for more than four ,years for any cause his certifi- cate of prior :service shall be void and on reentering -the service of the fire department he shall not be entitiled to credit for prior service except he laeves for disability received in line of duty. Section 7. any member of the fire Department in service and havi.n twenty-four years or more service in the department, of which the last ten years must be continuous, may file with the board an application for retirement on pension also setting forth a time, not less than thirty nor more than ninety days after filing of the application, at which he desires to be retired, and though his service has been discontinued during such period of notification, he shall be re- tored by the Igoard as of the time desired, and shall be paid monthly for life out of the fund a retirement fund a retirement pension of one- half his regular monthly salary. Section G. (a) A member of the fire department permanently and totally disabled by injury or disease caused in line of duty shall be paid out of the fund monthly for life the sum of one-half his regular monthly salary, provided one or more physicians appointed by the board shall certify that the disability is likely to be permanent and that the member shaould be retired from service. (b) Once each year following the retirement of a member of the fire department on a disability retirement allownace the board of trustees must requ&re ail such emebers who have not completed their thwenty-four years service to undergo a medical examination at a place designated by the medical board. uch examination shall be made by the medical board or in special cases,°by an additional physician or physicians designated by such board. hould any disability beneficiary who has not cor�pleted his twenty-four ,years service refue to submit to such examination, his allowance may be discontinued until his withdrawal of such refusal, and should his refusal con- tinue for one tgear all rights in and to his retirement shall be revoked by the board of trustees. (c) ''hould a disability beneficiary who has not completed twenty-four years service be found to be again able to carry out the performances of his duties and be restored to active service his retirement allowance shall cease, he shall a,.::ai n become a member of such department, and he shall contribute thereafter at the same rate he paid :)rior to his disability, and upon his subsequent retirement he shall be credited with ai.l his service as a member. (d) ''hould a member of the ''ire Department be discharged from said department for any cause, the fact that said member is discharged shall not disqualify said member form receiving the beiiefits Herein if said member ricets the requirements herein specified. Section 9. If' an active , disabled or retired member of the fire department shall die, his widow shall be )aid out of the fund monthly, a pension of fifty 'ollars oer month with the addition of Ton Lollrs per month for each c`llld under tl�e aE;e of cir.htoen (10) years, If there be no such widow, or widow dies , the monthly pay- ment provided for such widow shall be divided equally among the children who are living and under the age of 10 gears at the time of the division, and each child shall receive its share of the division monthly until it dies or obt a ine the age of 18 years. If the widow re- married., then her monthly payments shall stop immediately, but the payments to said children under 18 ,years of age shall continue until such time said children reach the age of 13 ,years. Section 10. he benefits payable by the fund, whether before or after ordered paid by the board, shall not be assignable or subject to counter claim, recoupment or set-off except as provided in this ordinance, nor shall they be subject to attachment, garnishment, executionexecution injunction or any decree, oraer, process or proceed r7... ings of m y court for the payment of any debt of my beneficiary, and the fund shall be held end distributed for the purpose of this ordinance m d for no other purpose whatsoever. Section 11. -.he city Treasurer shall be custodian of all monies, securities and other property of the fund, subject to the control and direction of the board. As prescribed by the board he shall keep separate boolis and complete accounts of the fund, and his books and accounts shall always be suject to the inspection of the board of any of its members. lie shall be liable on his bond executed to the municipality as ,.ity Treasurer of the city of Jefferson, Prlissouri, for all his acts concerning the fund. On the expiration of his term of office he shall deliver to his successor all unexpired monies, securities, books, records and other property which may have come into his )ossessior_ as treasurer of the Hind. Section 12. In the event said firemen's retirement fund as herein specified reaches an amount that is sufficient to tdie care of any and all claims for benefits and any and all antialoated claims for benefits as specified herein for any given ,year, the ity Council within its discretion shall have the right and power to not levy said mill tax for said given yearly period. Section 13. 'he "'ity Attorney shall be legal advisor of the board of trustees. Section 14. ny person who shall knowingly, or willingly, make any false statement, or shall fallify or Derr,-.it to be fd.sified any record or records,of such retirement system in any attempt to defraud such system as result of such act, shall be guilty of a misdemeanor, and shall-t be Iunishable therefore under the laws of this state. Section 15. For the reasons stated in an Act passed by the General Assembly of the Mate of P.;issouri anc! effective December 19, lc,'45, carrying an emergency clause and now in force, m d because Am under said Act it is necessary that this ordinance be passed in time to give notice as provided in said Act of the submission to the qualified voters of the City of Jefferson, Mlissourim at the General city elction to be held on April 19t1947, of the question concerning whet whether or not said Act and this ordinance shall take effect in the City of Jefferson, 14issouri , m emergency ig hereby declared to exist for the passage of this ordinance, rn d the ity L'lerk is hereby ordered to publish this ordinance as the notice required by saMd Act and in the manner as provided in said Act and that there be submitted to the qualified electors of the `'ity of Jefferson, Lr_ssouri , at the general city election to be held on npril 1st, 1947, the question, "Shall the Firemen's Pension ?tan be approved?" If a majority of the voters casting votes thereon at the general city election to be held on April 1st, 1947, are in favor gf the question, this ordinance shall be in full, force and effect in the ity of Jefferson, Y . ssoori , beginning thirty days after said election. Section 16. 4,11 ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 17. This ordinance shall take effect and be in force from and after its passage and approval.
