SECTION 1. Whereas, it was heretofore found and declared by the Uity Council, by its resolution, passed andapproved on ',-arch 5th, 1947 necessary to pave with penetration bituminious macadam the road- way of . herry Street between the curb line, from the center of the intersection of sherry Street and. I,.iller Street, to the center of the 6ritersection of herry Street and -lm Street, arid it appearing to the ity Council that said resolution has been duly .published according to the law for more than seven (7) consecutive Insertions, in the Jefferson "ity Post-Tribune, a daily newspapar, printed and publisehd in the ity of Jefferson, Iv;issouri , and .a ?::aiority of the residenbe owners of property along said section of Wherry :street liable for the oost:: of said improvement, and who own a ma iority of the front feet on said Cherry Street intended to be improved, have not filed with the City "lerk a protest against said contemplated irr.prover.ent. SECTIOE 2. That the said roadway of Cherry street between the curb lines, from the center oft he intersection of berry Street and Yiller Street, to the center of the intersection of Cherry Street and "'lm Street, be graded, curbed and guttered where necessary with cement material and paved with :penetration bituminious raterialcin accordance with the plats and specifications submitted by thie ity Engineer and field in the office of the City Clerk, and that the total cost of th,, work aforesaid. shall be ch.arged and levied as a special assessment against the real estate abutting and fronting; on said contemplated improvement and special tax bills shall be issued therefor, as provided in the City �hnrter, and in section 770 and 771 of chapter 13 of the Revised Ordinances of the City of Jefferson, Ir:issouri , 1941, and of the Revised Statutes of the State of A issouri , 1939, and amendments t ;ereto.
