A RESOLUTION BY THE CITY OF RICHLAND HILLS,
TEXAS, DECLARING A PUBLIC NECESSITY FOR AND
AUTHORIZING THE ACQUISITION OF EASEMENTS,
RIGHTS-OF-WAY AND OTHER INTERESTS IN PROPERTY
FOR IMPROVEMENTS TO THE RICHLAND PARK
OUTFACE WASTEWATER LINE.
WHEREAS, the United States Environmental Protection Agency has mandated
improvements to wastewater systems throughout northeast Tarrant County; and
WHEREAS, one of the actions mandated by the United States Environmental Protection
Agency is a prof ect to increase wastewater system capacity in the Richland Park Outfall Wastewater
Line; and
WHEREAS, a major portion of said Richland Park Outfall Wastewater Line is located
within the city limits of the City of Hurst; and
WHEREAS, the City Council of the City of Hurst, Texas, has heretofore, by Resolution No.
1219, adopted by the Hurst City Council on the 26th day of January, 1999, authorized and granted
• permission to the City of Richland Hills to take whatever actions are necessary, including
condemnation, to acquire under the power of eminent domain any sites, easement or rights-of--way
which maybe required to change the location of the Richland Park Outfall Line, in the event that
unanticipated underground utilities or unknown cultural or historic resources are encountered in the
course of the wastewater system capacity increase project described herein; and
WHEREAS, the City Council of the City of Richland Hills, Texas, finds and determines that
a public necessity exists for the acquisition of the interests in land described above, and the
wastewater system capacity increase project contemplated hereby.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
RICHLAIVD HILLS, TEXAS:
I.
That a public necessity exists for the acquisition of any sites, easements or rights-of--way
which may be required to complete the wastewater system capacity increase prof ect for the Richland
Park Outfall Wastewater Line, such as construction easements and borrow and fill areas, together
with any sites, easements or rights-of--way which may be required to change the location of the
Richland Park Outfall Line, in the event that unanticipated underground utilities or unknown cultural

• or historic resources are encountered in the course of the wastewater system capacity increase
project, whether such property is located in the City of Richland Hills, the City of Hurst, or
elsewhere.
II.
Be it further resolved that the City Manager of the City of Richland Hills, and persons
designated by him, are hereby authorized to take any necessary steps to acquire such sites,
easements, orrights-of--way, whether located within the City of Richland Hills or elsewhere, utilizing
the City's power of eminent domain and condemnation authority, if necessary, to accomplish the
public purposes to be furthered by such wastewater system increase project.
PASSED AND APPROVED by the City Council of the City of Richland Hills, Texas, by
a vote of 4 ayes, 0 nays and 0 abstentions thisl3th day of Aril , 1999.
