HomeMy Public PortalAbout19410422CCMeeting108 Savannah Beach, Georgia, April 22nd, 1941 The regular adjourned meeting of Council was held today at 4 p.m. in the Council Chamber, and was attended by Mayor Jones, who presided, and Councilmen Griffin, Siotin, Lovell, Daniels., Henry and Ferguson. The minutes of the meeting of April 1st, were read and adopted. The budget for the year 1941 was read and upon motion by Councilman Griffin, seconded by Councilman Siotin, the motion passed -unnani- mously. After the bids were opened and tabulated, it was Found that tYe,bid of Wyatt, Neal and_Waggoner and their associates was lowest, after which Councilman Griffin moved that the following resolution be adopted. Councilman Ferguson seconded and the motion passed unnanimously. RESOLUTION WHEREAS, in accordance with a Resolution heretofore adopted and an advertisement appearing in the Savannah Evening Press, Council met in an adjourned regular meeting this 22nd'day of April, 1941, at four o'clock P.M., after proper and legal notice given to each Councilman, . for the purpose of receiving sealed bids for the sale of $32,000.00 worth of Bonds, known and designated as Sanitary Sewerage Bonds, and sealed bids were duly opened by the Clerk of Council in the presence of the Mayor and Councilmen of the Town of Savannah Beach, Tybee Island, and the bidders or repreeentatives of said bidders; and WHEREAS, the following bids were submitted, to -wit: Atlanta, Georgia, April 22, 1941 Hon. Mayor & Councilmen of the Town of Savannah Beach, Savannah Beach, Georgia. Gentlemen: Based on the financial statement submitted to us, for the: $42,000. Town of Savannah Beach Georgia, 20 SANITARY SEWERAGE BONDS, dated March 1, 1941, and to mature serially from 1943 through 1962, as described in your official notice of sale, we will pay you the sum of: THIRTY TWO THOUSAND, FIFTY FOUR DOLLARS & FORTY CENTS ($32,054.40) plus accrued interest to date of delivery of bonds to us in Atlanta. Prior to delivery, you are to furnish us promptly, without expense to us, lawfully certified copies of all legal proceedings, including the election, validation and judgement and other such proofs suggested or required by our attorneys relative to the issuance and sale of said bonds, which shall satisfy our attorneys that the bonds are unqualified, valid and binding obligations of the Town of Savannah Beach, issued in conformity with the Constitution and laws of said state, including unlimited tax levy on all the taxable property therein, both real and personal, as provided by law. Our attorney's opinion shall be con- clusive in the matter. Your attorney, also, is to cooperate with our attorneys without expense to us. Enclosed herewith is Cashier's check, No. 167751, issued by the Fulton National Bank of Atlanta, in the amount of $1,000. which check is to be betdrned to us promptly in the event our bid is not accepted; other- wise, it is to be held uncashed by you and when the bonds are delivered and paid for under the terms of this bid, said check is to be returned to us. Councilman Biotin moved that the following resolution be adopted. Councilman Griffin seconded and the motion passed unnanimously. Clerk of Council of the Town of Savannah Beach, Tybee Island, or its agency in the City of New York, New York, at the option of the holder. This bond is one of the series aggregating the sum of 02,000.00, issued for the construction and maintenance of a sewerage disposal plant in the Town of Savannah Beach, Tybee Island, under and by virtie of the authority conferred by the Constitution and laws of the State of Georgia, and pursuant to the result of an Election duly called and held in the Town of Savannah Beach, Tybee Island, on the 30th day of January, 19.1, for the purpose of authorizing the issuance of said Bonds, whereat more than twe- thirds of the qualified voters of the said Town of Savannah Beach, Tybee Island, voting in said Election voted in favor thereof; said two - thirds so voting being a majority of the registered voters of the said Town. It is hereby certified, recited and declared that all acts, conditions and things required to exist to happen and to be performed, precedent to and in the issuance of this Bond exist, have happened and have been performed in due time, form and manner, as required by the Constitution and laws of said State of Georgia, and ordinances and resolutions of the Town-of Savannah Beach, Tybee Island, applicable thereto; and that the amount of this Bond, together with all other indebtedness of said Town of Savannah Beach, Tybee Island, does not exceed the•statutory and Constitutional limitations; That provisions have been made by the Mayor and Councilmen of the Town of Savannah Beach, Tybee Island, for the Collection of an annual tax sufficient in amount to pay the principal and interest of this Bond, within the time prescribed by law. The holder of this Bond may at any time have the same registered at the office of the Clerk of Council of the Town of Savannah Beach, Tybee Island, and have such registration certified hereon, after which it shall be transferred only by endorsement of the registered holder to the transferee, and such transfer noted hereon, unless the last registered holder shall transfer it to bearer when it shall again be transferred by delivery. ATTEST: CLERK OF COUNCIL BE IT FURTHER RESOLVED by the authority aforesaid, that the form of the interest coupon on said Bond shall be substantially as follows: The Mayor and Councilmen of the Town of Savannah Beach, Tybee Island, on the let day of March, 1941, will pay bearer at the office of the 115 Clerk of Council in the Town of Savannah Beach, Tybee Island, or its Agency in the City of New York, New York, at the option of the holder, , being six (6) months' interest then due on its Bond, dated March 1, , No. This coupon is receivable for all taxes and o her dues of said Town. MAYOR ATTEST: CLERK OF COUNCIL Council heard protests from Joseph G. Stovall, protesting against the 1940 -1941 assessment on his property, after which Mr. Stovall was excused. On motion of Councilman Slotin that the assessments were in order and that they remain as is, seconded by Councilman Henry, the motion passed. A protest against his 1941 assessment was read:from Oertell Collins. Councilman Biotin moved that the assessments were in line with others in the neighborhood, and that Mr. Collins assessment should remain as is. Councilman Ferguson seconded and the motion passed. Mr. E.A. Dutton, as Agent for Home Owners Loan Corporation protested against the taxes on lots 5 -6, Ward 5, in the name of Home Owners Loan Corporation, and re- quested that the assessments be reduced. Councilman Griffin moved that the assessment remain as is until the property is 'sold, when Council can reconsider and adjust the assessment. Councilman Ferguson seconded and the motion passed. Councilman Griffin moved that the offer of Tybee Beach Company to sell to the Town lots 1 through 16, Block 7, Bay Ward, for $638.16, be accepted, these lots to be used for the location of the treatment plant. Councilman Slotin seconded and the motion passed. The Mayor informed Council that he had been in communication with Officers of the United Stated Army with reference to utilizing Camp Sebeca as a Military Center,this to be sponsored by the Town. He stated that the owner was asking $600.00 rent per year, and also stated 116 that it would require about $100.00 for plumbing, and an additional $100.00 for miscellaneous expense to make the 'camp usable for the Military. Councilman Slotin suggested that the matter be left to a committee to handle and report back at the next meeting. It was decided that the official Tybee opening day would be on May 17th.
