HomeMy Public PortalAboutResolution No. 120-99 11-09-1999 RESOLUTION NO. 120-99 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RICHLAND HILLS, TEXAS, EXPRESSING THE INTENTION OF THE CITY TO TAKE FEE SIMPLE TITLE TO ALL PROPERTY TO BE ACQUIRED IN CONNECTION WITH THE HANDLEY-EDERVILLE ROAD WIDENING PROJECT. WHEREAS, the City Council of the City of Richland Hills, Texas, has heretofore by Resolution No. 99-98 declared a public necessity for the Handley-Ederville Road widening prof ect, and declared a public purpose to be served by the acquisition of property necessary or desirable to complete said project; and WHEREAS, the City Council of the City of Richland Hills, Texas, now wishes by this Resolution to express its intention to take fee simple title to all property to be acquired in connection with such project, as described in the exhibits attached to Resolution No. 99-98 heretofore passed by the Richland Hills City Council. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Richland Hills, Texas, that the City hereby expresses its intention to take fee simple title to all parcels of property to be acquired in connection with the Handley-Ederville Road widening project, as described in the exhibits attached to and incorporated in Resolution No. 99-98, heretofore passed by the Richland Hills City Council. BE IT FURTHER RESOLVED that this Resolution shall take effect immediately from and after its passage. Kelley, Mayor ATTEST: Terri is, City Secretary G:\Docs\R\RHills\Resolutions\Res.-Fee simple title.wpd RESOLUTION NO. 9 9 - 9 8 A RESOLUTION DECLARING A PUBLIC NECESSITY FOR THE HANDLEY-EDERVILLE ROAD WIDENING PROJECT, AND DECLARING A PUBLIC PURPOSE TO BE SERVED BY THE ACQUISITION OF PROPERTY NECESSARY OR DESIRABLE TO COMPLETE SAID PROJECT. WHEREAS, Handley-Ederville Road between Baker Boulevard and State Highway 121 is one of the main commercial corridors in the City of Richland Hills, and furthermore serves as one of the principal gateways to the City; and WHEREAS, due to many years of heavy use, the road surface has deteriorated substantially; and WHEREAS, the citizens of the City of Richland Hills, in a referendum election, voted their support for a project to realign and widen Handley-Ederville Road between Baker Boulevard and State Highway 121; and WHEREAS, significant public purposes will be served by such road widening project, including mitigation of traffic congestion and its associated increased levels of air pollution and increased access to commercial and industrial facilities located • along and adjacent to Handley-Ederville Road; and WHEREAS, the United States Environmental Protection Agency has indicated its imminent intention to reclassify the Dallas/Fort Worth area to a more severe air pollution category; and WI-AREAS, traffic congestion is one of the primary contributing factors to the increased level of air pollution within the Dallas/Fort Worth area, thereby creating a public necessity for the above-referenced project to ease such traffic congestion; and WHEREAS, in order to accomplish the Handley-Ederville Road widening project, there exists a public necessity to acquire land adjacent to the existing Handley-Ederville Road for right-of-way purposes, for the actual widening of the road itself and for drainage and other structures related to the road project; and WHEREAS, the City Council of the City of Richland Hills, Texas, finds and determines that a public necessity exists for the project, and that important public purposes will be served thereby, including but not limited to enhancement of the health, safety and welfare of the citizens of the City of Richland Hills, and of the Dallas/Fort Worth Metroplex area. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Richland Hills, Texas, that the recitals listed above are hereby adopted as legislative findings by the Richland Hills City Council in support of the Handley-Ederville Road widening project, and that the City Council hereby finds and determines that there is a public necessity for, and the public welfare and convenience will be served by, the acquisition of the property described in the attached Exhibits A for said road widening project, and that important public purposes will be served thereby; and RESOLUTION NO. PAGE 1 BE IT FURTHER RESOLVED that it is the intention of the City of Richland Hills, Texas, to acquire the real property described in Exhibits A attached hereto and made a part of this resolution for all purposes as part of the Handley-Ederville Road widening project in the City of Richland Hills for the purposes of road construction and widening, right-of-way, utility location, drainage and other purposes related to said project; and BE IT FURTHER RESOLVED that the City Manager is hereby authorized to contract on behalf of the City with professional appraisers for appraisal services and with title insurance companies for preparation of title opinions needed by the City from time to time in connection with the acquisition of right-of-way for said project; and BE IT FURTHER RESOLVED that the City Manager, or his designee, is hereby authorized to examine the independent appraisal reports as they are submitted to the City, to determine whether said appraisal reports are supported by sufficient data. Based upon such examination of said appraisal reports, the real estate appraiser shall make a recommendation to the City Manager as to establishment and approval of the amount of just compensation for each said parcel; and BE IT FURTHER RESOLVED that after consideration of said recommendation, the City Manager shall establish and approve the amount determined to be just compensation for acquisition of each parcel; and • BE IT FURTHER RESOLVED that upon establishment and approval by the City Manager of the amount of just compensation for the acquisition, the said City Manager is authorized to communicate a written offer to the owner of said parcel for acquisition of said parcel at the full amount determined and established to be just compensation therefor, and to negotiate with said owner on behalf of the City; and BE IT FURTHER RESOLVED that the City Manager be and is hereby authorized to execute all documents necessary to acquire each of the parcels of right-of-way needed for said project, on behalf of the City; and BE IT FURTHER RESOLVED that the City Manager be and is hereby authorized to sell such surplus improvements, if any, located on the real property acquired in connection with this project; and BE IT FURTHER RESOLVED that in the event any of said parcels cannot be acquired by donation or purchase, the City Manager and the City's attorneys are hereby authorized to institute eminent domain proceedings to acquire said parcel or parcels by condemnation; and BE IT FURTHER RESOLVED that this resolution shall take effect immediately from and after its passage.
