SECTION. 1 . There is hereby appropriated out of any money in the
City Treasury not otherwise appropriated, chargeable to the .Revenue
Fund, for the purpose of paying October, 1929 salary of elective
and appointive City Officials, firemen and Police, the sum of 05301.66
SECTION. 2. This Ordinance shall take effect and be in force from
and after the 31st day of October, 1929.

NO. 3214. AN ORDINANCE TO REPEAL SECTION I OF AN ORDINANCE ENTITLED
"AN ORDINANCE AUTHORIZING ANDREW C . DIEI►ILER, HIS SUCCESSORS,
LESSEES ANN) ASSIGNS TO ESTABLISH AND OPERATE MOTOR BUS SERVICE FOR
THE TRANSPORTATION OF PASSENGERS IN AND UPON THE STREETS AND HIGH-
'SAYS OF THE CITY OF JEFFERSON CITY, MISSOURI, "AND TO ENACT IN LIEU
THEREOF A DI SECTION -TO BE KNOWN AS SECTION I .
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF JEFFERSON,
AS FOLLOWS:
SECTION. I. That Section I of "An Ordinance authorizing Andrew
C. Diemler, his successors, lessees and assigns to establish and
operate Motor bus service for the transportation of passengers in
and upon the Streets- and Highways of the City of Jefferson City,
Missouri, being Ordinance No. 2928, be and the same is hereby re-
pealed, and a new section enacted in lieu thereof to be known as
Section I.
SECTION. 2. The right, power and authority (but not the exclusive
right, power and authority) are hereby granted to the Andrew C.
Diemler (hereinafter designed as grantee) , his successors, lessees
and assigns to operate motor busses for the transportation of
passengers in and upon the public highways for the City of Jefferson
City, Missouri, as follows:
Starting at the corner of Madison and High streets, South
on Madison to dunklin street, West on Dunklin to Broadway street,
South on Broadway to Atchison Street, West on Atchison to Mulberry
street, North on Mulberry to Elm Street, 'Nest on Elm to Highway
No. 50, in a general 'Westerly direction on Highway No.50 to Waverly
Street, North on Waverly to St. Mary's Blvd. , East on St. Mary' s
Blvd. to Elm Street, East on Elm to Mulberry Street, L)outh on
hulberry to Atchison Street, East on Atchison to Broadway Street,
North on Broadway to Dunklin Street, East on .Dunklin to Jefferson
Street, North on Jefferson to High Street, East on High to Madison
street, the place of beginning.
SECTION. 3. All other conditions set out in said Ordinance No.2928,
shall remain in full force and effect, and this Ordinance shall be
in effect from and after the date of its passage and approval.

_8"RUTION. I . Ice 07cai an used in T.—M; Ordinance, is a f6od product
made from pasteurized orgasm, and ougar--or pasteurized cream,
pasteurized milk and nugar, and shall contain not less than 8% milk
fat and not less than 34',9 i;otal solids. It shall not contain any
preservative, neutralizing agent, saccharine, renovated or process
butter, fats or oils foreign to milk or to other ingredients allowed.
It may contain wholesome eggs, harmleas coloring; matter, flavoring,
sound,clea,n,matured fruits and nuts, pastries and approved stabilizer
not to exceed 5-10%. Approved stabilizer is defined as wholesome
gelatin or gum tragaoanth and no other substance shall be used as a
stabilizer unless approved by the board of health. Ice Cream as
herein defined and the various ingredients thereof, shall be free
from filth, manure, harmful or pathogenic organisms, or any element,
ingredient or constituent deleterious to health. No Ice cream shall
be sold offered or exposed for sale which has not been made of
pasteurized milk or pasteurized cream and other products, and such•
pasteurization as used in this Ordinance means that such milk or
cream shall be pasteurized by heating; same to a temperature or not
less than 295 degrees fahrenheit and held at that temperature for
not less than thirty minutes . Pasteurizing equipment must be equipped
with r6cording thermometer and must meet the approval of. the Board
of Health. Any water used in or about an Ice Cream plant shall be
of the kind, character and quality as required by the State of
Missouri.
SECTION. 2. No person, firm or corporation shall sell, offer for sale
or •exoose for sale in the City of Jefferson any Ice cream as herein
defined without first making application to the City Health Depart-
ment and receiving a permit therefor. This application shall show
the name and address of the manufacturer, the location of the plant
where the ice cream is made and the brand or label under which the
same will be sold or offered for sale. Upon the filing of such
application the Board of Health, or its inspectors , shall thoroughly
inspect the place where the ice cream is made and thereafter if the
Board of Health of this City determines that said ice cream is
sufficiently pure and made under such conditions that it will not
be deleterious to the health of any person eating the same, and that
said business will be conducted in accordance with the terms of this
Ordinance then the Board of Health shall issue a permit allowing
such ice cream to be distributed and sold in this City. Said permit
may be applied for by the manufacturer, wholesaler, or distributer.
SECTION. 3. No product not coming under the definition of Ice
cream as herein defined shall be sold under the name of ice cream
in this City, and no ice cream shall be sold unless the same is
labeled showing whose product it is and under a permit issued by the
Board of Health, nor shall any ice cream be sold which has not been
manufactured under a permit issued from the State Food and Drug
Commission as provided by the laws of the State of Lissouri.
SECTION. 4 . The Board of Health and its inspectors are hereby
authorized to inspect all places where milk is produced from which
ice cream is made, and all buildings, equipment or places where ice
cream is manufactured, and places where the same is sold, offered
or exposed for sale, or stored, and may require the maker of such
ice cream to provide such means as are necessary to keep said build-
ing in a strictly sanitary condition and prevent such ice cream from
becoming contaminated. No ice cream shall be made in any part of the
building commonly known as the basement. Should the' Board of Health
find any ice cream made, handled, stared, sold or offered for sale
not in compliance with this Ordinance, &r in any such manner that
the same is insanitary or is likely to produce ill effects to any
person eating the same, the Board of Health shall stop the sale
thereof, and is hereby authorized to revoke the permit of any person
firm or corporation making or distributing that kind or brand of
ice cream. The City Physician is hereby authorized and directed to
secure from time to time a sample of different kinds or brands of
ice cream sold or offered for sale in this City and analyze the same
and report his findings to the Hoard of Health, and if such analysis
shows that the ice cream does not meet the requirements of the Board
of Health, or is deleterious to health, the Board of health shall
revoke the permit of the person, firm or corporation authorizing; them
to sell or distribute same in this City.
SUCTION, 5. The Board of Health of this City, in addition to the
