That said sewer shall begin at a point that; is 18 feet East of the Weat curb line of Clay Street and on the center line of said alley; thence Westerly along the center line of said alley 400 feet. SECTION. 3. Said sewer shall be constructed of standard glazed sewer pipe, shall be constructed according to the plans and specifi- cations on file in the office of the City Engineer and constructed in all respects as provided by Ordinance. President of the Council. Mayor. NO. 3228. AN ORDINANCE ESTABLISHING THE GRATZ OF THE ROADWAY OF THE ALLEY IN TIDE BLOCK BETWEEN HIGH STREET-MCCARTY STREET-CHERRY STREET CHESTNUT STREET. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWSo SECTION. I. That the grade line of the alley in the block between High Street, McCarty Street, Cherry Street, and Chestnut Street in the City of Jefferson, Nissouri, be and is hereby established as follows; Beginning at the center of the alley and West gutter line of Chestnut Street, where the elevation of' the grade is, 203.2; thence 30 feet on a uniform grade, where the elevation of the grade shall. be, 202.0; thence I95 feet on a uniform grade where the el.eva- tioh of the grade shall be, 204.6; thence 100 feet on a vertical curve, where the elevation of the grade shall be 204.0; thence I00 feet on a vertical curve, where the elevation of the grade shall be I99.5; thence 46 feet on a uniform grade to the East gutter line of Cherry Street, where the elevation of the grade shall be, I96.5. SECTION. 2. All Ordinances or parts of Ordinances in conflict with this Ordinance are hereby repealed. SECTION. 3. President of the Zouncil. Mayor. NO. 3229. AN ORDINANCE TO REPEAL SECTIONS 832- 833-834-835-836-837 AND 838, BEING ARTICLE 89, CHAPTER 44, OF TIIE I*XISED ORDI.NAitCES OF THE CITY OF JEFFERSON. I925, AND TO ENACT IN LIEU THEREOF A NEW ARTICLE TO BE KNOWN AS ARTICLE 8, CHAPTER 441, RELATING TO THE SALM SUBJECT. BE IT ORDAINED BY THE COUNCIL OF TBE CITY OF JEFFERSON, AS FOLLOWS: SECTIONS 832-833-834-835-836-837-and 838 be and the same are hereby repealed and a new Article to be known as Article 8 of Chapter 44, enacted in lieu thereof, and to read as follows: ARTICLE VIII. SECTION. 832. Hereafter it shall be unlawful for any person or persons, firm, co-partnership or corporation or abutting property owner on any public street or alley within the City of Jefferson, to 53 dig or excavate in any manner in any public street or 'alley within said City of Jefferson, without Bret having had and obtained a permit so to do as specified in section 833 of this Article. SECTION. 833. Every person or persons, firm, co-partnership or corporation or abutting property owner on any public street or alley within the City of Jefferson, desiring to excavate or dig into any public street or alley in this City, shall first apply to the City Engineer for and obtain a permit so to do, which said permit shall be on a blank form to be prepared by the City Engineer which shall set forth the name and portion of the street or alley, as the case may be, the kind of street or alley, the number of estimated square feet Aft to be excavated, the amount of the cash or certified check to be required of the applicant and such other data and information as the City Engineer may deem necessary and pertinent. Upon receipt of said permit so issued as aforesaid, by the Engineer, the applicant shall present the same to the City Clerk, who shall endorse upon said permit the fact that the applicant has deposited with him cash, or a certified check of some banking institution of the City of Jefferson, for the use and benefit of said City for the proper replacement of said street or alley and in an amount as called for in such permit, the said amount of cash or certified check to be in an amount large enough to cover the cost of replacing the street or alley in as good a condition as before the excavation or digging: the number of square feet to be excavated to be estimated by the City Engineer at the time the permit is issued and the costs of the permit to be as follows: ON UNIMPROVED STREETS OR ALLEYS, $ I.00. ON BITUMINOUS STREETS OR ALITYS, $5.00 FOR ANY EXCAVATION UP TO THIRTY (30) SQUARE FEET, AND $0.22 PER SQUARE FOOT FOR EACH SQUARE FOOT OF EXCAVATION IN EXCESS OF THIRTY (30) SQTJARE FEET. ON CEIUJ NT CONCRETE, BRICK, ASPHALTIC CONCRETE, SHEET ASPHALT OR ROCK ASPHALT, $I0.00 FOR ANY EXCAVATION UP TO EIGHT (8) SQUARE FEET, AND 80.50 PER SQUARE FOOT FOR EACH SQUARE FOOT OF EXCAVATION IN EXCESS OF EIGHT (8) SQUARE FEET. All money collected for the issuance of such permits as herein above provided shall be retained by the City of Jefferson and placed to the credit of the Vehicle fund to be used to defray the expense of replacing the pavement where excavations shall have been trade in the streets. Provided however that the person or persons, firm, co-partnership or corporation or abutting property owner making any excavation in the streets of this City as hereinbe.f'ore provided, shall itrmiediately after such excavation is Trade and the work completed replace all earth excavated by tamping, wetting and puddling to the satisfaction of the City Engineer or Street Cormission- er, and shall keep the excavation so refilled at a level with the surrounding street surface as to make the surface of the excavation safe and comfortable for traffic during; the period which ensues between the time of the excavation and the time the Street Commission- er is able to resurface. Provided further, that any person or persons, firm, co-partnership or corporation or abutting property owner desiring to dig or excavate, may deposit with the City One- Hundred ($IC0.00) Dollars in cash and pay for the permit the first of each 11onth following completion of the work. However, the permit for each separate excavation must be obtained before any excavation is rude in the public streets of Jefferson City. SECTION. 834. It is hereby made the duty of every Police Officer of the City of Jefferson to ascertain whether or not any person or persons, firm, co-partnership or corporation or abutting property owner, excavating or digging in any public street or alley in this City has a permit, properly issued, as specified in Section 833 of this Article; and if not, to report the same to the City Attorney. It is also made the right of any City Official or citizen to rec_uire that such. a permit be shown on demand therefor. The permit rr,ust be kept in possession of someone employed at the place of excavation.
