public sidewalks of the City of Jefferson for any purpose whatsoever
without first placing around at least three (3) sides of the hole
in said public street or on public sidewalk from which the covering
was removed a metal or wooden barricade not less than three (3)feet
high.
SECTION. 2. Any person, firm, co-partnership or corporation
violating the terms of this Ordinance shall be deemed guilty of a
misdemeanor and upon conviction shall be fined not more than one
hundred. (8100-00) dollars.

NO. 3241. AN ORDINANCE TO APPROPRIATE MONEY.
WHEREAS, on the 7th. day of November, 19279 there was
introduced into the City Council an oral motion that the Mayor be
directed and empowered to buy a lot 150 feet on Chestnut Street by
a depth of 209 feet for twenty-seven hundred ($2700.00 ) dollars from
Peter Kaullen, Kaullen to pay for the Street Improvement taxes on the
lot, the role call resulting in a tie vote being aye 5 and nay 5, the
Mayor casting the deciding vote aye; and
'WHEREAS, the said Peter Kaullen has selivered to the City
Clerk Abstract and Warranty Deed to certain property which the said
Peter Kaullen claims is the property set out in the above mentioned
motion; and
WHEREAS, the said Peter Kaullen has been to considerable
expense, and has brought suit in the Cole County Circuit Court for
the purchase price of said property as set out in the above described
Motion; and
VMEREAS, the City Council of Jefferson City refuses to pay
said sum of $2700.00 by reason of the fact that said Council is
advised that the attempted purchase of said property was illegal and
unlawful because of the fact that there was no Ordinance authorizing
said purchase and because of the further fact that Section 750 of
the Revised Ordinances of the City of Jefferson provides that it
shall not be lawful for any Officer of the City Government or any
Committee of the Council, except, by and in persuance of an Ordinance
or resolution of the Council duly passed and approved to contract
for the laying out or expenditure of a greater sum of money than
twenty 020.00) dollars, excepting in cases of emergency, for any
purpose whatever. , and every bill proposing to appropriate money shall
clearly and distinctly specify the purpose or service rendered for
which the appropriation is made; and
X[EREAS, the Council is desirous that the said Peter
Kaullen be reimbursed for any expense occasioned him by the actions
of the City Council. NOW THEREFORE,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF JEFFERSON,
AS FOLLOWS:
That there is hereby appropriated the sum o£_�Ia0.00
dollars out of the GENERAL REVENUE FUND f-or the purpose of
reivgbuirsing Peter Kaullen for the expense and delay occasioned by
the City's failure to accept deed to the above described property.
The City Clerk is authorized to draw a Viarrant in the above
mentioned amount, payable to the said Peter Kaullen, which Warrant
shall be delivered to the said Peter Kaullen upon the delivery by
him of a release to the City of Jefferson, forever releasing said
City from all claims or liability to the said Peter Kaullen by
reason of the premises hereinbefore set out.
