Indiana ( "City") provides fire service and protection ( "Fire Service ") in and around the City's corporate boundaries to residential. cotmnercial, governmental, and L1011- profit properties and entities. Whereas, the City's taxpayers provide the bulk of the financial resources necessary to defray the continuing costs of the Fire Service, Whereas, an undo financial burden would be unposed upon We City's taxpayers if non- taxpaying entities failed to provide fu ancial resources to defray the ongoing costs of providing Fire Service to theut. Whereas, the City's Common Council has determined that non - taxpaying. non -tax financed entities should pay a user fee or other charge for Fire Service provided to them in order to defray the financial burden currently being shouldered solely by the City's taxpayers. Now, Therefore, The Common Council of the City of Greencastle, Indiana, Ordains and Enacts the Following: 1) Establishment of Fee by Common Council: The City's Common Council determine the user fee or other payment mechanism ("Fcc ") to be charged to and paid by non - taxpaying, non -tax financed entities that receive Fin' Scrvicc from the City at One Thousand dollars ( $1,000.00 ) per emergency response. 2) Application, Imposition, and Collection of Fee Delegated to Board of Works: The application. imposition, and collection of the Fee will be administered be the Board of Works. which is granted the discretion to prospectively or retroactively wave or adjust We Fee in cases of undue hardship or other just cause. 3) Appeal to Board of Works and Common Council: Non - taxpaying, non -tax financed entities may appeal the application, imposition, or collection of the Fee as follows: a) Appear in person or by a duly authorised rcprescntativc at a regularly schcdufcd BOU O of Works meeting within thirty days of rccciving notice of the imposition of the Fcc to show whN an undue hardship or other just cause exists to reduce or naive the Fee. The Board of Works ma in its discretion, reduce, tNaiyc, or othcrn isc adjust the application or collection of the Fee in response to the emity's rcqucst. b) If the Board ol' Works' response to the entity's request is unacceptable to the cntity, a did k authorized rcprescntativc of [lie entity may appear at a regularly scheduled Common Council nscling %61hin thirt days of verbally or othcnyisc rccciving the Board of Works' response to its rcqucst, to sho,y why an undue hardship or otherjust cause exists to reduce or waive the Fee.
