Savannah Beach, Georgia,
June 4th, 1941
The regular meeting of Council was held today at 8 p.m. in the Council
Chamber, and was attended by Mayor Jones, who presided, and Councilmen
Henry, Ferguson, Biotin, Lovell, Daniels and Town Attorney Dutton.
The minutes of the meeting of May 6th were read and approved.
The Mayor informed Council that the State Highway Department had done
an excellent job of hard- surfacing 17th and 18th Streets, and the drive-
way from 16th to 18th Street ;.that they also hard- surfaced 15th Street
from Butler Avenue to the Strand. He stated that he had requested
several of the large property owners in this area to come in and bear
part of the cost of this work, and that one of thaw had contributed;
that incidental expenses were made in connection with this work, which
he had paid personally, amounting to $142.00, and asked that he be
reimbursed in this amount. Councilman Biotin moved that the Mayor be
reimbursed:to' the' extentyof $142.00, and also that he write a letter to
the State Highway Board thanking them for their cooperation with the
Town. Councilman Henry seconded and the motion passed.

Dear Sir:
On behalf of the Town of Savannah Beach and the residents thereof I
want to express our deep appreciation for . the work of hard surfacing
Seventeenth and Eighteenth Streets, and the connecting driveway
between Sixteenth and Eighteenth Streets which affects a perfect
entrance and outlet of U.S. Route 80 to Savannah Beach.
This work was done under various difficulties, but mainly due to our
inability to secure experienced labor. The efficient and methodical
manner in which the work was consummated speaks very highly for all
those who took part in it.
I want to extend you an invitation to visit with us at any time you
may be able to drop down this way and a short notice in advance will

assure you the best accommodations available on the Island.

The Mayor informed Council that in cooperation with A.F. Solms a large
tract of land had been tendered for use as an Army Convoy parking area.
He had communicated with J.P. Houlihan, Chatham County Commissioner, and
he very kindly sent four of the County trucks to haul material from
Cockspur Island to hard- surface this area; also that he had purchased
two Chevrolet dump trucks ahead of time to be used in this work, but
that these trucks were purchased for use on the sewerage disposal system
when it starts. He had made an agreement with Mr. Solms that the
building of showers, dressing rooms, etc. be erected at a cost of
085.00, and that the Town was to pay one half, and Mr. Solms would
pay haif.of the cost of this building. Councilman Slotin moved that
the Mayor's action be approved, and also that the Commandants of the
Air Base and Camp Stewart be informed of this convenience for the use
of soldiers. Councilman Henry seconded and the motion passed.
The Mayor informed Council that he had been notified by the Work Projects
Administration in Savannah that a work order dated May 29th had been
issued authorizing work to start on the sewerage system. He also
informed Council that it was imperative that weeds and grass on the.
Island be cut, but at this time the cutting equipment on the tractor is
out of order. It.was decided to have a representative of International
Harvester Company send a man down to put the tractor in order so work
on underbrush could be started. He also informed Council that Works
Projects Administration would have a drag line down the later part of
this week so work could be started on putting the main piling into the
seawall. He also stated that at the present time the Town has three

mules that are doing nothing, but that he decided to wait until he hears
from the Work Projects Administration as to whether these mules will be
needed on the sewerage system of not before reccommending that they be
disposed of. He had purchased a forge, horse shows, nails and an anvil
to be used in connection with the showing of the mules.
The question of conveying 19th street to John Morel was discussed, but
no action was taken.
A communication was read from W.J. Bryan with reference to some money
due him from the•Town and which was held up pending his making a settle-
ment with the Town for tools charged to him. The letter was referred to
the Town Attorney.
The Mayor informed Council that he had issued instructions that the
parking areas be cleaned up and all trash and debris moved by extra
men when needed; that he had contracted with the Nik -o -lok Company
to install coin machines on two of the toilets in the new comfort
station.
The Mayor informed Council that he had subscribed to four weeks of
advertising in HThee Statesman0, a weekly newspaper of the State of
Georgia, at a cost of $48.00, and he had also contracted to purchase
one thousand copies of Dixie Mirror at a cost of $100.00, that he had
paid a total of $148.00 for both of these contracts, and asked that
his action be approved and that he be reimbursed. Councilman Slotin
moved that.the Action of the Mayor be approved, and that he be re -.
imbursed in the amount of $148.00. Councilman Henry seconded and the m
motion passed.
Councilman. Slotin moved that on the application of James Adams, colored,
for a license to operate the Brigham cottage for colored people, that he
be allowed to operate on the same conditions that license was granted to
John Curry. That is, he could sell whiskey, beer, soft drinks, serve
meals and operate a rooming house upon the payment of proper license,

but that the front door on Inlet Avenue must be kept closed and locked at
at all times, and he must not permit crowds to congregate in the front
of his place. Councilman Ferguson seconded and the motion passed.
Councilman Slotin informed Council that a drain had been placed on
his property, and he had heard that it was he who had this work done
for himself, but that he wanted to go on record as stating that he had
nothing to do with it, but the State Highway Department had done the
work.
Councilman Slotin stated that there was a balance outstanding due by
some of the contributors on the seawall #2, and this should be
collected as soon as possible, and that a letter should be sent to these
delinquints by the Clerk requesting that they pay up, and also that the
Town Attorney write to each of the property owners who have paid for
the work done in front of their property and who are expecting to have
that area conveyed to them, that they have their portion of the property
surveyed and have deeds drawn up so that same can be executed by the
Town.
A communication from Mr. S.N. Harris requesting that parking spaces
be opened for property owners. After some discussion it was decided
that it could not be done legally unless it be made open to everyone.
A communication was received from a representative of the Tybee
Amusement Company requesting that in the absence of Hrney F. Meyer
who is out of the city, that the licenses due by Tybee Amusement
Company be held in abeyance until his return. It was the opinion of
Council that the Tybee Amusement Company operated under a board of
directors And had other-officers who were authorized to sign checks
and it was not necessary to wait for Mr. Meyer's return to pay these
licenses, but they could be paid now. The Clerk was instructed to
notify then of that fact.
Councilman Slotin moved that on several requests that had been made
for allowance of 14% discount on the first half of 1941 taxes, that

if the delinquint tax payers would pay the full amount of the taxes
at this time, the discount for the full year would be allowed. Council-
man Henry seconded and the motion passed.
The Tybee Beach Company in a letter dated May 14th, requested that they
be allowed the full amount of 1941 taxes as the payment for the group
of lots in biook seven, Bay Ward that they had previously offered the
Town at what they thought would be the correct amount of taxes for 1941.
At the time of the transaction they did not know that the tax rate for
1941 had been increased, and requested that they be allowed $740.58
instead of the original figure of $638.16. Councilman Ferguson moved
that Tybee Beach Company's offer be accepted. Councilman Henry seconded
and the motion passed.
Councilman Slotin moved that in the collection of 1941 licenses that the
final time for payment be at 5 :30 p.m. June 10th, and if licenses are
not paid by any operator at that time, then they shall be placed in
docket for hearing in. Police Court on June 12th, and this be made final.
Councilman Henry seconded and the motion passed.
Councilman Biotin moved that on the property of Carrie T. Schwartz which
was sold at the Court House on November 5th, 1940 to E.A. Dutton as agent,
the difference between the cost of the sale and the amount of the taxes
amounting to $5.43, be allowed Mrs. Schwartz, making the amount due by
her for 1939 taxes $24.55. Councilman Lovell seconded and the motion
passed.
It was the concensus of opinion of Council that taxi cabs operating on
the Island proper be required to take out personal liability and public
damage insurance or else discontinue operation.
Town Attorney Dutton informed Council that the Harley Thomas ease had
been re- opened again, and he wanted to know if the Town wanted to
defend the suit. It was decided that Attorney Dutton be authorized to
handle the ease for the Town when it came up in court.

Councilman Ferguson informed Council that the places serving food on,t1e ,
Island have been checked each week by Dr. Henderson.

dubmttted his tesignation previously for the purpose of accepting a post
on the Board of Aldermen of the City of Savannah, that it be accepted
regretfully. Councilman Lovell seconded and the motion passed.
Mayor Jones informed Council tof t, the vacancy existing on the Board due
to the resignation of Councilman J.F. Griffin and asked for nominations
to succeed to the vacancy. Councilman Hiunryymoved that Charles V. Walsh
be.nominated to fill the inexpired term of Councilman Griffin. Councilman
F:erg son seconded and the motion passed unnanimously. The following oath
was administered to Mr. Walsh by Town Attorney Dutton:
I, Charles V. Walsh, do solemly swear that I will faithfully
and honestly perform the duties of Councilman of the Town of
Savannah Beach to the best of my skill and ability, without
favor or affection, SO.HELP ME GOD.

All members of Council expressed themselves as being very happy that Mr.
Walsh to a new member and all told him that they were very glad to have
him with them. Mr. Walsh assured them that he appreciated the honor, '
and felt that everyone would work together for the best interest of the
Town.
The DeSoto Beach Hotel requested that a special policeman be provided
for their location. It was the consensus of opinion of Council that if
they would pay the salary of a special policeman, the Town would provide
one. Councilman Slotin moved that if the Beach Hotel would pay the
salary of a special officerin, the Town would swear him in as a police-
man and have the police department cooperate with him. Councilman
Ferguson seconded and the motion passed.
Councilman Slotin stated that the Red Cross Life Guards needed cots,

pillows, blankets, etc., and moved that the Town buy this equipment.
Councilman Henry seconded and the motion passed. Councilman Biotin
was authorized to handle the matter and purchase the material.
The question of a game known as "26 ", or similar games of chance was
brought up, and after considerable discussion, Councilman Walsh moved
that the licenses for this game be revoked, and part of the license
money be refunded, and in voting - voting NO - Councilman Siotin.
Voting YES - Councilmen Walsh, Henry, Ferguson, /oven. and Daniels.
After this motion was passed, the discussion was renewed, and Council-
man Walsh moved that his motion be withdrawn. Councilman Ferguson
seconded and in voting - voting NO Councilman Henry. Voting YES -
Councilmen Walsh, Ferguson, Lovell, Daniels and Slotin. It was decided
that the game known as "26" and another game known as
would be permitted to Operate. Councilman Siotin is to handle this
matter.
The Mayor informed Council that he had a partial report from Dr. C.C.
Hedges on eating places, and he expected Dr. Hedges to let him have a
complete report when it was finished. The Mayor also read a letter
from Dr. Hedges informing him that the United States Health Service
is giving the Town the use of personnel and trucks and material
for use in mosquito control within one mile of Fort Screven, which
would practically cover the whole Island. The personnel consists of
an inspector, a foreman and three oilers.
Councilman Henry moved that the Treasurer be authorized to pay all
bills on hand as approved by the Finance Committee. Councilman
Ferguson seconded and the motion passed.
Councilman Henry stated that he had been approached by several people
complaining of aeroplanes hedge- hopping over the pavilion and flying
low along the beach and annoying bathers, and suggested that the Mayor

write the commandant of the Air Base relative to this.
Councilman Henry stated that no military police were available over
the past week end until after 5 p.m. He informed Council that he
would handle the matter.
Councilman Ferguson stated that there was come question as to the use
of fresh water on seawall project #2, as on several oeeabions
Solomon had stopped Work Projects Administration workers from using
water for this project. It was decided to contact Charles F. Powers
and ascertain what the status of the use of this water was.
Councilman Ferguson moved that a woman attendant be hired to keep the
rest rooms clean for $3.00 per week. Councilman Lovell seconded and
the motion passed.
A Lubrication and service schedule for motorized equipment of the Town
was submitted by Jack Osborne to maintain all of the Town's equipment
such as the Police Car, Trucks, and motor cycle. Councilman Henry
moved that this contract be awarded him. Councilman Ferguson seconded
and the ;motion passed.
The resignation of S.P. Kehoe, Jr., as Town Surveyor was submitted and
accepted..
A communication was read from J.O. Blair Plumbing Company relative to
the plumbing ordinance of the Town and called attention to some features
of it which they contend were not being carried out in the Town. The
Clerk was instructed to write the Master Plumber's Association in,
Savannah requesting a list of those plumbers who have licenses to do
business in Savannah.
Councilman Siotin moved that the tax ordinance be amended so that,,
the following licenses can be added to it, and also that the operator
of any rides which cater to the public carry liability insurance for
the protection of the public. Councilman Ferguson seconded and the
motion passed.

AN ORDINANCE

AN ORDINANCE TO AMEND THAT CERTAIN ORDINANCE ENTITLED, "AN ORDINANCE
TO PROVIDE FOR THE TAXATION OF REAL AND PERSONAL PROPERTY IN THE TOWN
OF SAVANNAH BEACH, TYBEE ISLAND, GEORGIA, FOR THE FISCAL YEAR COMMENCING
MAY FIRST, 1941, AND TO PROVIDE -FOR THE RATE OF LICENSES FOR DOING
BUSINESS IN SAID TOWN OF SAVANNAH BEACH TYBEE ISLAND, GEORGIA, FOR THE
FISCAL YEAR - ENDING APRIL 30th,: 42, FIXING THE PENALTIES FOR THE VIOLATION
AND FOR OTHER PURPOSES ", PASSED BY THE MAYOR AND COUNCILMEN ON THE 3rd DAY
OF APRIL, 1941, BY ADDING THE FOLLOWING LICENSES AT THE END OF SECTION 4,
AND FOR OTHER PURPOSES.
SECTION 1: Be it enacted by the Mayor and Councilmen of the Town of
Savannah beach, Tybee Island, and it is hereby enacted by the authority of
the same that that certain Ordinance entitled, "An Ordinance to provide
for the taxation of real and personal property in the Town of Savannah Beach,
Tybee Island, Georgia, for the fiscal year commencing May lst, 1941, and to
provide for the rate of Licenses for doing business in said Town of Savannah
Beach, Tybee Island, Georgia, for the fiscal year ending April 30th, 1942,
fixing penalties for the violation ", passed by the Mayor and Councilmen on
the 3rd Day of April, 1941, be and the same is hereby amended by adding the
following licenses at the end of Section 4:
Kiddie Airplane Rides, seating capacity 5 $ 10.00
Loop -O- Plane, seating capacity 4 10.00
Silver Derby Merry- Go- Roun4, seating capacity 16 15.00
Chairplane, seating capacity 24 25.00

SECTION 2: Be it further enacted by the authority aforesaid that all
Ordinances or parts of Ordinances in conflict with this Ordinance be and
the name are hereby repealed.
The following is an act passed by the Legislature of the State of Georgia
on Mar. 24th, 1941,
amending the Charter of the Town of Savannah Beach, giving the Mayor and
Councilmen the authority to deed, quitclaim and transfer by resolution
to any property owner who has contributed an aliquot part of the cost of
the erection of the seawall from the northern corner of 2nd Street to 14th
Street along the Strand all of the right, title and interest of. the Town in
and to that portion of the Strand which remains abutting eastwardly from- the
property of such property owner to within eighteen (18) feet of the seawall.
AN ACT
To amend the several acts incorporating the Mayor and Councilmen of the

Town ofTJTYbeevinoWknOwn under the Ace of the General Assembly approved
August lat, 1929, as Savannah Beach, Tybee Island, to grant authority
to the Mayor and Councilmen to deed a certain portion of the Strand to
the property owners adjacent thereto; and for other purposes.
SECTION ONE
Be it enacted by the General Assembly of the State of Georgia and it is
hereby enacted by the authority of the same, that the Act of the General
Assembly of the State of Georgia, approved August 19th, 1922, entitled
"An Act to amend, revise and consolidate the several Acts granting
corporate authority to the Town of Tybee; to confer additional powers on
the Mayor and Councilmen of the Town of Tybee; to define the corporate
limits of said Town; and for other purposes ", be and the same is hereby
amended by adding a new section as follows:
SECTION 44: Be it further enacted by the General Assembly of the State
of Georgia that the Mayor and Councilmen shall, after the passage of this
Act, have authority to deed, transfer and quitclaim, by resolution, to
any property owner who has contributed an aliquot part of the cost of the
erection of the sea wall, from the northern corner of Second Street to
the northern corner of Fourteenth Street along the Strand, all of the
right, title and interest of the said municipality in and to that portion
of the Strand which remains abutting the property of such property owner
eastwardly to within eighteen (18) feet of the seawall and such owner
so contributing shall have the right for this consideration to obtain
from the municipality such deed, transfer and quitclaim, provided that
the said Mayor and Councilmen and said property owners shall not utilize
the eighteen (18) foot area abutting on sea wall and land so deeded
except for the purposes of repair and /or maintenance of said seawall
and groins."
SECTION TWO
Be it enacted by the General Assembly of the State of Georgia, and it
is hereby enacted b the authority of the same, that the Act of the
General Assembly, approved August 19th, 1922, entitled "An Act to amend,
revise and consolidate the several acts granting corporate authority to
the Town of Tybee; to convey additional power on the Mayor and Council-
men of the Town of Tybee; to define the corporate limits of said Town;
and for other purposes" be and the same is hereby amended by striking
from said Act Section 3 thereof and inserting in lieu thereof the
following:
Section 3: Be it further enacted that the present Mayor and Council-
men elected on the first Monday in April, 1922, shall hold office until
their successors are elected and qualified and that an election of a
Mayor and six (6) Councilmen shall be held on the first Monday in April
1924, and every two (2) years thereafter on the same day and the hours
of voting thereat shall be between seven (7) a.m. in the forenoon and
six (6) p.m. in the afternoon. The Mayor and Councilmen shall, hold their
respective offices until their successors have been duly elected and
qualified.
SECTION THREE
Be it further enacted that the Mayor and Councilmen of the Town of
Savannah Beach, Tybee Island, shall have the right to buy sell and /or

exchange any part of the Public Domain which will include public streets
and the Strand which are not considered necessary or con'enient for public
use and when same is ' "to the best advantage and interest of the Mayor and
Councilmen, but shall not close, exchange or sell any public street which
has been opened to the public by the municipality and used by the public
except after approval by a majority vote of all the qualified voters of
said municipality.
SECTION FOUR
Be it further enacted that the Mayor and Councilmen of the Town of
Savannah Beach, Tybee Island, shall have the power to levy, impose and
collect a special tax in a sum not to exceed one quarter of one per cent
of the total value of the assessments on the books of said municipality
as of January 1st, 1941, for the purpose of maintaining the sea wall and
groins, for beach erosion, for street paving and for sanitary purposes
including the collections and disposal of garbage; and that in all cases
where it shall be necessary to levy a special additional tax for any one
or more of the afore - mentioned purposes, the levy and assessment of the
same for each shall be separdtely made and collected and all amounts so
collected sha],1 be applied exclusively to the said expenses for tghich
said tax is levied and collected.
SECTION FIVE
Be it further enacted by the authority of aforesaid that all laws or
parts of laws in conflict with this'Act be and the same are hereby
repealed.
