HomeMy Public PortalAboutResolution No. 138-00 05-09-2000 • RESOLUTION NO. 138-00 A RESOLUTION AUTHORIZING CONVEYANCE OF ABANDONED WELL SITE AT 7436 TOWER STREET TO ABUTTING LAND OWNERS. WHEREAS, the City of Richland Hills, Texas, has for many years maintained a water well on a site located adjacent to 7436 Tower Street, a parcel of approximately 400 square feet located between Lot SR and Lot 6, Block 3, Midway Place Addition to the City of Richland Hills; and WHEREAS, the water well on said site has been abandoned and the well shaft filled with concrete and capped; and WHEREAS, the City of Richland Hills has no further use for said parcel of property; and WHEREAS, as determined by the City's appraiser, the parcel's small size and lack of access to a public roadway renders it unusable independently, under current zoning, subdivision and other applicable development ordinances of the City, and the City is therefore authorized to convey the • site to abutting property owners under the provisions of Section 272.001(b)(1) of the Texas Local Government Code; and WHEREAS, the City has obtained an appraisal of the value of said site, and the appraisal reflects the value of said site to be $1.00; and WHEREAS, it is the desire of the City Council of the City of Richland Hills, Texas, by this resolution, to authorize the Mayor of said City to execute appropriate documents to convey title to said property to the abutting land owners, in return for the fair market value of said property. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RICHLAND HILLS, TEXAS: I. That the City Council hereby authorizes the Mayor of the City of Richland Hills, the Honorable C. F. Kelley, to execute on behalf of the City a Special Warranty Deed conveying the City's abandoned well site located adjacent to 7436 Tower Street, a 400 square foot parcel located between Lot SR and Lot 6, Block 3, Midway Place Addition to the City of Richland Hills, identified on the filed plat as "City of Richland Hills Well Site", for a consideration of $1.00. II. • Be it further resolved that the Mayor of the City is hereby additionally authorized to execute any additional documents necessary to complete said conveyance on behalf of the City. Grantor, for the consideration and subject to the reservations from and exceptions to conveyance and warranty, grants, sells and conveys to Grantee the property, together with all and singular the rights and appurtenances thereto in any wise belonging, to have and hold it to Grantee, Grantee's heirs, executors, administrators, successors, or assigns forever. Grantor binds Grantor and Grantor's heirs, executors, administrators, and successors to warrant and forever defend all and singular the property to Grantee and Grantee's heirs, executors, administrators, successors, and assigns against every person whomsoever lawfully claiming by, through or under Grantor, but not otherwise, or to claim the same or any part thereof by, through or under Grantor, except as to the reservations from and exceptions to conveyance and warranty.
