SEMION. I . W}iEHl 'AS, it is represented to the City Council
of the City of Jefferson, Iiissouri, that said City is not
receiving; the proper returns from the gasoline tax now being
levied under the Ordinances of this City, and it being further
represented to the City that a sum of money might be recovered
on behalf of the City, because of under-payments or delinquencies
on the part of certain persons , firms or corporations now
engaged in the slae of gasoline within said City, and subject to
said tax; and
WHERBAS, it is the sense of the City Council that an
investigation and audit should be made under the terms bf the
Ordinances of said City, authorizing the City Collector, or his
duly authorized deputy or any person authorized by the Council
so to do, to investigate the correctness and accuracy of the
returns and reports of various persons, firms or corporations
subject to a gasoline tax; and
fMHEREAS, it is reasonably certain that the books of various
railroad companies and of the various gasoline companies must
be examined, and that the bocks of various refineries in other
states must be examined before an accurate and definite conclu-
sion can be reached as to the correctness of reports filed by
various oil companies engaged in business in Jefferson City; and
ViHEREAS, it appears that Samuel V'1. James, Jr. , of Jefferson
City, Missouri, is willing to undertake said investigation and
audit, and is able to make such investigation that may be
necessary to discover and determine any shortages or delinquencies
that may exist, and is willing to do said work under an agreement
that he shall receive one-half of any amount that may be recover-
ed, without expense to the City, he to pay all expense of inve6-
tigation.

MO N, AS FOLLOWS:

SECTION. n. That Samuel W. James, Jr. , be and is hereby
employed by the City of Jefferson as a Special Auditor, to work
in conjunction with the Uity Pollector to make any and all invest-
igations that may be necessary, and for this purpose only is
designated the authorized Deputy of the amity Collector, and in
the event any shortages or delinquencies are discovered he shall
report the same to the 1'ity Attorney in order that said City
Attorney may institute any action or actions that may become
necessary for the collection of any shortages or delinquencies,
if any. The said Samuel W. James, Jr. , shall receive as his sole
compensation in this behalf, one-half of any amount recovered
and in addition thereto Samuel W. James, Jr. , hereby binds himself
to pay all expenses that may be incurred in making such investi-
gation and audit, and shotrld it become necessary to file suit to
recover any sum found to be due the City,-and the said Samuel W.
James, Jr. , should desire to be represented by additional Counsel
then the said Samuel W. James , Jr. , shall have a right to employ
additional counsel at his own expense.
SECTION. 3. Be it further ordained that in the event the
result of the above stated audit shows a shortage for any persons,
firms or corporations, that the amount involved in said shortage
shall not be compromised or settled for a lesser sum than that
shown by the audit, except by written consent of both parties to
this contract.
SECTION. 4. This ordinance shall be in full force and
effect from and after its passage and approval, and the written
acceptance of same as endorsed herein by the said Samuel V1. James,
Jr.
