HomeMy Public PortalAbout025-2005 - PUD- Hidden ValleyAMENDED ORDINANCE 25-2005 A SPECIAL ORDINANCE PROVIDING FOR A PLANNED UNIT DEVELOPMENT GENERALLY LOCATED SOUTH OF HIDDEN VALLEY DRIVE AND SOUTHWEST 15TH STREET TO BE USED FOR RESIDENTIAL PURPOSES WHEREAS, the Zoning Map designates and describes a mixture of certain tracts, each zoned in a certain manner, more particularly described below, all of which comprise a 54.78 acre tract which will be amended by this Ordinance; and WHEREAS, it is desirable to change the various zoning designations to a Residential P.U.D. District to allow the real property to be used for a residential development consisting of a maximum of 67 lots. NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, that the zoning designation of a 54.78 acre tract, which is more particularly described below, is hereby changed to a Residential P.U.D. District for the development of a residential development consisting of a maximum of 67 lots. The Concept Plan is hereby approved and the Concept Plan and Draft Development Plan will be attached to this Ordinance as Exhibit A. The above description is intended to generally describe the 54.78 acres of real property to be used for a residential development consisting of a maximum of 67 lots. The following restrictions apply: Voluntary annexation of the residential component and select acreage of greenbelt as agreed to by the Department of Metropolitan Development into Richmond City limits and Richmond Sanitation District before the issuance of the first Building Permit; Exclusion of multi-family residential uses; Inclusion of sidewalks and street lighting into the final development plan; Rezoning of land already owned by Mr. Nicholson in other portions of Hidden Valley to O-1 Greenbelt; Development of a homeowners association or property management agreement satisfactory to the Department of Metropolitan Development to insure the maintenance of designated greenbelt space; Pursuit of a conservation easement or similar restriction to assist with the preservation of the historic farmstead.
