N0. 3485. AN ORDINANCE PROVIDING FOR THE HOLDING OF A SPECIAL
ELECTION WITHIN AND FOR THE CITY OF JEFFERSON, COLE COUNTY, MISSOURI,
FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED VOTERS OF SAID CITY
A PROPOSITION TO BE VOTED UPON WHETHER THE SUM OF $71,089.72 OF
JUDGMENT INDEBTEDIESS, BEING THE ENTIRE JUDGMENT INDEBTEDNESS OF SAID
CITY, SHALL BE FUNDED BY THE ISSUANCE AND SAIZ OF BONDS IN THE SUFI[
OF $710089.72.
WHEREAS, a certain judgment was rendered in the Circuit
Court of ole County, Missouri, on the 16th day of January, 1932, in
favor of the Capital City Water Company, a corporation, Exchange
National Bank of Jefferson pity, Missouri, a corporation, Central
Missouri Trust Company of Jefferson City, Missouri, a corporation,
The First National Bank of Jefferson City, Missouri, a corporation
and W, A. Dallmeyer, Trustee, and against the City of Jefferson, Cole
County, Missouri, in the principal sum of Forty-three Thousand,
Seven Hundred and Thirty-one Dollars and Forty Cents ($439731.40),
which said Judgment bears interest thereon from and after the date
of Its rendition at the rate of six per centum (6%) per annum; and
WHEREAS, a certain judgment was rendered. in the Circuit
Court of Cole County, Missouri, on the 16th day of January, 1932, in
favor of Missouri Power and Light Company of Jefferson City, Missouri,
a corporation, and against the City of Jeferson, Cole county,
Missouri.; in the principal sum of Twenty-seven Thousand, Three Hundred
and Fifty-eight Dollars and Thirty-two Cents ($27,338.32) , which
said judgment bears interest thereon from and after the date of its
rendition at the rate of six per centum (6%) per annum; and
WHEREAS, there is now due and owing on said judgments the
sum of Seventy-erne Thousand, Eighty-nine Dollars and Seventy-two
Cents ($71,089.72) together with interest thereon at the rate of
six per centum (6%J pet annum from and after the 16th day of January
1932; and
WHEREAS, both of said judgments are now due and payable and
constitute a valid subsisting indebtedness of the City of Jefferson;
and
WHEREAS, there are no funds belonging to the City of
Jefferson available for the payment of said judgments; and
• WHEREAS, a necessity exists for refunding said judgment
indebtedness and the issuance, of bonds at a- lower rate of interest,
in order that said bonds ma.y be sold and the proceeds thereof used for
the exclusive purpose of paying off and satisfying said judgments;
THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
JEFFERSON CITY, MISSOURI, AS FOLLOWS:
SECTION. I. That a Special Election shall be and the same
is hereby called and ordered to be held in the City. of Jefferson City
Missouri, for the purpose of submitting to the qualified voters of
said City a proposition to issue bonds of said City in the amount of
Seventy-one Thousand', Eighty-nine Dollars and Seventy-two Cents
($719089.72), for the purpose of funding the following judgment,
indebtedness of said Citys

SECTION. 2. That said special election shall be held in
the said City of Jefferson on the 31st day of May, 1932, and that the
polls shall be kept open from 6 O'clock in the forenoon until 7 0'
cloak in the afternoon of said day.
SECTION. 3. That for the purposes of said special election
the voting in the several wards shall take place in the precincts
designated by an order of the County Court of Uole County, Missouri,
heretofore made and entered of record in the office of the County
Clerk of Cole County, Missouri, that is to say&

And that said special, election shall be conducted and the returns made
and the results thereof declared in the same manner as an election for
City Officers.
SECTION. 4. The City Clerk shall give notice of such election
by publication in The Daily Capital News, a newspaper published in the
City of Jefferson; once a Week for three consecutive weeks by making
three insertions of said publication ' in said newspaper, which said
notice shall state therein the' time, place and purpose of such election
and the amount of- bonds to 'be voted, and which. said notice shall be
substantially the following forms

Pursuant to an Ordinance duly adopted by the City Council
of the City of Jefferson City, Missouri, and approved by
the Mayor of said City on the 6th day of May, 1932, notice
is hereby given that a special election will be held in
the said City on Tuesday, the 31st day of May, 19329
for the' purpose of testing the sense of the qualified
voters of' said City upon the following proposition:
PROPOSITION
Shall the City of Jefferson City, Missouri, incur an
indebtedness and issue bonds of said City in the amount of
Sevent -one Thousand, Eighty-nine Dollars and Seventy-two
Cents(�71,089.72), for the purpose of funding the Judgment
indebtedness of said City.
The Polling places for said election will be as followas

SECTION. 6. If two-thirds or more of the qualified voters
of the City of Jefferson City goting on said proposition shall assent
thereto, said municipality shall be authorized to borrow upon its
:. credit the sum of Seventy-one Thousand, Eighty-nine Dollars and
Seventy=two Cents ($71,089.72) and to issue, negotiate and sell the
coupon funding bonds of the said municipality therefor, and from the
A proceeds of said sale or sales thereof to satisfy and discharge. the
sum of Seventy-one Thousand, Eighty-nine Dollars and Seventy-two Cents
071,089.72), 'being the entire judgment indebtedness of said City.
SECTION. 7. That the `'ounty Court within and for the County
of Cole, State of Missouri, be and the said Court is hereby respect-
; fully requested to provide for the holding of a special registration
of voters in the said 04ty of Jefferson City, Missouri, prior to the
holding 6f the special election herein called and as required by
Section 105469 Revised- Statutes of Missouri, 192.9. Immediately upon
the passage and approval of this Ordinance, the City Clerk shall trans-
zit a certified copy hereof to the 'said County Court, with a request
