HomeMy Public PortalAboutORD03555 Z70 AN ORDINANCR REPEALING SECTIONS 406 TO 433 INCLUSIVE OF CHAPTER 29 , REVISED OR- DINANCES, DEFINING "MILK" AND CERTAIN "MILK PRODUCTS", "MILK PRO- DUCER", "PASTEURIZATION", ETC. , PROHIBITING THE SALE OF ADULTERAT- ED AND MISBRANDED MILK AND MILK PRODUCTS, REQUIRING PERMITS FOR THE SALE OF MILK AND MILK PRODUCTS, REGULATING THE INSPECTION OF DAIRY FARMS AND MILT{ PLANTS, THE TESTING, GRADING, LABELING, PLAC- ARDING, PASTEURIZATION, REGRADING, DISTRIBUTION, SALE, AND DENATUR- ING OF MILK AND MILK PRODUCTS, PROVIDING FOR THE PUBLISHING OF MILK GRADES, THE CONS11RUCTION OF FUTURE DAIRIES AND MILK PLAN'T'S, THE EN- FORCEMZNT OF THIS ORDINANCE, AND THE FIXING OF PEN.,LTIES, CREATING OFFICE, OF MILK INSPEC TOR, FIXING S.ILRY LND DUTIES. i 000 BE IT ORDAINED BY THE COUNCIL OF THE CITY OF JEFFER- SON CITY AS FOLLOWS: All sections included in Chapter 29 of The Revised Ordinances of the City of Jefferson, viz: Section 406 to 433 in- clusive, of said Chapter 29 , are hereby repealed and new sections are enacted in lieu thereof to be known as Chapter 29 and to read as follows: SECTION 1. DEFINITIONS. The following definitions shall apply in the interpretation and the enforcement of this or- dinance: (A ) MILK. Milk is hereby defined to be the lacteal secretion obtained by the complete milking of one or more healthy cows, excluding that obtained within fifteen days before and five days after calving, or such longer period as may be necessary to render the milk practically colostrum free; which contains not less than eight and one-half per cent '(8j%) of tailk solids not fat, and not les6 than three and one-fourth per cent (3-1/4%) of milk fat. (B) MILK FAT OR BUTTER FLT. Milk fat or butter fat is the fat of milk. (C ) CRFJAM. Cream, sweet cream, is that portion of milk, rich in milk fat, which rises to the surface of milk on standing or is separated from it by centrifugal force, is fresh and t clean, and which contains not less than eighteen per cent (18%) , preferably twenty per cent (20%) , of milk fat; provided that cream having less than eighteen per cent milk fat shall be known as sub- standard cream. Cream having less than thirty per cent (30%) milk fat shall be -known as light cream. Cream having thirty per cent (30%) or more and less than forty per cent .(40%) milk fat shall be known as heavy cream, and cream having forty per cent (40%o) or more milk fat shall be known as extra heavy cream. Whipping cream and manufacturing cream or creams con- taining not less than thirty per cent (30%) milk fat, intended for whipping or manufacturing purposes, and the grades of same shall not be based on bacterial count. (D) SKIMMED MILK. Skimmed milk is milk from which a sufficient portion of milk fat has been removed to reduce its milk-fat percentage to loss than three and one fourth per cent 2 (E) CHOCOLATE MILK. Chocolate milk is milk to Which has been added in a sanitary manner a chocolate syrup composed of wholesome ingredients. (F ) BUTTERMILK. Buttermilk is the product which remains when fat is removed from milk or dream in the process of churning. it contains not Less than eight and five-tenths per cent (8.5%) of milk solids not fat. (G) CULTURED BUTTERMILK. Cultured buttermilk is the product resulting from the souring or treatment, by a lactic acid culture, of milk or milk products. it contains not less than eight and five-tenths per cent (8.5%) of milk solids not fat, and shall be pasteurized before adding the culture. (H) MILK PRODUCTS. Milk products shall. be taken to mean and include cream, skimmed milk, chocolate milk, buttermilk, and cultured buttermilk. (I) PASTEURIZATION. The terms "Pasteurization": "Pasteurized", and similar terms shall be taken to refer to the process of heating every particle of milk or milk products to a temperature of not less than 1420F. , and holding at such tempera- ture for not less than 30 minutes in pasteurization apparatus ap- proved by the health officer, provided that approval shall be lim- ited to apparatus which requires a combined holder and indicating thermometer temperature tolerance of not more than 1*oF'. , as shown by official tests with suitable testing equipment, and provided that such apparatus shall be operated as directed by the health of- ficer and so that the indicating thermometers and the recording thermometer charts both indicate a temperature of not less than 143*OF. , continuously throughout the holding period, provided that nothing contained in this definition shall be construed as disbar- ring any other process which has been demonstrated as of at least equal efficiency and is approved by the state health authority. (J) ADULTERATED MILK AND MILK PRODUCTS. Any sub- stance claimed to be any milk or milk product defined in this or- dinance, but not conforming with its definition as given in this ordinance shall be deemed adulterated and misbranded. (K) MILK PRODUCER. A milk producer is any person who owns or controls one or more cows, a part or all of the milk or milk products from which is sold and delivered to another person. (L) MILK DISTRIBUTOR. A milk distributor is any person who has in possession, offers for sale, sells or delivers to another any milk or milk products for consumption or manufacturing purposes. (M) DAIRY OR DAIRY FARM. A dairy or dairy farm is any place or premises where one or more cows are kept, a part or all of the milk or milk products from which is sold and delivered to any person. (N) MILK PLANT. A milk plant is any place, or prem- ises or establishment where milk or milk products are collected, handed, processed, stored, bottled, pasteurized, or prepared for distribution. (0) HEGLTH OFFICER. The term "health officer" shall mean the health authority of the City of Jefferson City, or his authorized representative. (P) AVERAGE BACTERIAL COUNT. Average bacterial oount shall be taken to mean the logarithmic average of the bacter- ial counts of all samples taken during the grading period, including at least four samples taken upon separate days, provided that in en- forcing Section 9 on Supplementary Regrading the last four conseo-- utive samples may be used in determining an average bacterial count. 3 (Q) GRADING PERIOD. The grading period shall be such period of time as the health officer may designate, within which grades shall be determined for all milk, cream, buttermilk and cultured buttermilk supplies, provided that the grading period shall in no case exceed six (6 ) months. (R) BACTERICIDE. The term bactericide shall be tak- en to mean any bactericidal substance or process approved by the health officer. (S ) PERSON. The word "person" as used in this or- dinance, shall mean "Person, firm, corporation, or association. " SECTION 2. THE SALE OF ADULTERATED OR MISBRANDED MILK OR MILK PRODUCTS PROHIBITED. No person shall within the City of Jefferson City, or its police jurisdiction, produce, sell, offer, or expose for sale, or have in possession with intent to sell, any milk or milk product which is adulterated or misbranded. SECTION 3. PERNITS, It shall be unlawful for any person to bring into or receive into the City of Jefferson, or its police jurisdiction, for sale, or to sell, or offer for sale there- in, or to have on hand, any milk or milk product defined in this ordinance, who does not possess a permit from the health officer of the City of Jefferson, and on whose vehicle there does not appear in a conspicuous place the permit number in figures at least three in- ches high and one and one-half inches wide. Such a permit may be revoked by the health officer upon the violation by the holder of any of the terms of this ordin- ance or in any emergency when in the judgment of the health officer the milk supply in question has become a public health menace, pro- vided that the holder of said permit shall, after complying with such revocation, have the right of appeal to the board of health. SECTION 4. LABELING AND PLACARDING. All bottles, cans, packages, and other containers enclosing milk or any milk pro- duct defined in this ordinance shall be plainly labeled or marked with (1) the name of the contents as given in the definitions in this ordinance; ( 2) the grade of the contents if said contents are raded under the provisions of this ordinance; (3 the word '"pas- eurized" if the contents h ve been pasteurized; 4) the word "raw" if the contents are raw; (5 the name of the pro ucer or distrib- utor. The label or mark shall be in letters of a size, kind and color approved by the health officer and shall contain no marks or words not approved by the health officer. Every restaurant, cafe, soda fountain, or other es- tablishment selling or serving milk shall display at all times, in a place designated by the health officer, a notice approved by the health officer, stating the grade of the milk at the time when de- livered and whether same is raw or pasteurized. SECTION 5. INSPECTION OF DAIRY FARMS AND MILK PLANTS FOR THE PURPOSE OF GRADING OR REGRADING. At least once during each grading period the health officer shall inspect all dairy farms and all milk plants whose milk or cream is intended for consumption within the City of Jefferson, or its police jurisdiction. In case the health officer discovers the violation of any item of sanitation, he shall make a second inspection after a lapse of such time as he deems necessary for the defeat to be remedied but not before the lapse of three days, and the second inspection shall be used in det- ermining the grade of milk or cream. Two violations of this ordin- ance on separate inspections within any one grading period shall call for immediate de-grading. One copy of the inspection report shall be posted by the health officer in a conspicuous place upon an inside wall of one of the dairy farm or milk plant buildings, and said inspection re- 4 port shall not be removed by any person except the health officer. Another copy of the inspection report shall be filed with the re- cords of the health department. SECTION 6. ITIE TESTING OF MILK AND MILK PRODUCM, During each grading period at least four samples of milk or cream from each dairy farm and each milk plant shall. be taken on separate days and tested by the health officer. Samples of milk and cream from stores, cafes, soda fountains, restaurants, and other places where milk products are sold shall be tested as often as the health officer may require. }bacterial Counts shall be made in conformity with the standard methods recommended by the American Public Health Association. Tests may include such other chemical and physical determinations as the health officer may deem necessary for the detection of adulteration, these tests to be made in accordance with the latest standard methods of the American Public Health Assom cation and the Association of Official Agricultural Chemists, Bact- erial count or reduotase test results shall be given to the produc- er or distributor concerned as soon as determined, Samples may be taken by the health officer at any time prior to the final delivery of the milk or milk products. All stores, cafes, restaurants, soda fountains, and other similar places di all furnish the health offic- er, upon his request, with the name of the milk distributor from whom their milk is obtained. SECTION 7. THE GRADING OF MILK AND CREAM. At least once every six (6) months the health officer shall announce the grades of all milk, buttermilk, cultured buttermilk, and cream sup- plies delivered by all producers oru distributors and ultimately consumed within the City of Jefferson, or its police jurisdiction. Said grades shall be based upon the following standards, the grading of oream, buttermilk and cultured buttermilk being identical with the grading of milk, except that the bacterial standard shall be omitted in the case of buttermilk and cultured buttermilk. CERTIFIED MILK: Certified milk is milk which con- forms with the current requirements of the American Association of Medical Milk Commissions, and is produced under the supervision of the Medical Milk Commission of the Medical Society of Cole County, and of the State Board of Health or of the City and County Health Officer, GRADE "A^ RAW MILK. Grade "A" Raw Milk is milk the average bacterial count of which as determined under Section 6 of this ordinance does not exceed 50,000 per cubic centimeter, or the average reduction time of which is not less than 8 hours, and which is produced upon dairy farms conforming with all of the following items of sanitation. ITEM 1. COWS - TUBERCULOSIS AND 09HER DISEASES. A physical examination and tuberculin test of all herds and additions thereto shall be made before any milk therefrom is sold, and at least once every twelve months thereafter, by a licensed veterinar- ian approved by the state livestock sanitary authority. Said tests shall be made and any reactors disposed of, in accordance with the current requirements approved by the United States Department of Agriculture , Bureau of Animal Industry, for accredited herds, A certificate signed by the veterinarian or attested to by the health officer, and filed with the health officer, shall be the only valid evidence of the above test, Every diseased animal shall be removed from the herd at once and no milk from diseased cows shall be offered for sale. All reacting animals shall be isol- ated at once and immediately excluded from the premises. All animal; failing to pass the T. B. test shall be branded with the letters "T" or "TB'F on the shoulder, hip, or jaw, and removed at once and slaugh- tered under the direction of the health officer. Each letter in the brand shall be not less than two inches high and one and one-half in- ches wide. milli 5 ITEM 2. DAIRY BARN - LIGHTING. ITEM 3. DAIRY BARN - AIR SPACE AND VENTILATION. Such sections of all dairy barns where cows are kept shall have at least four hundred (400) cubic feet of air space per stanchion, and shall be well ventilated. ITEM 4. DAIRY BARN FLOORS. The floors and gutters of such parts of all dairy barns in which cows are kept or milked shall be constructed of concrete or other impervious and easily cleaned material approved by the health officer and shall be graded to drain pro perly, and shall be kept clean and in good repair. No horses, pigs, fowl, etc. , shall be permitted in parts of the barn used for dairy purposes. ITEM 5. DAIRY BARN, WALLS AND CEILINGS. The walls and ceilings of all dairy barns shall be whitewashed once each year or painted once every two years, or oftener if necessary, or finish- ed in a manner approved by the health officer, and shall be kept clean and in good repair. In case there is a second story above that part of the barn in which cows are milked, the ceiling shall be tight. ITEM 6. DAIRY BARN; COW YARD. All cove yards shall be graded and drained as well as practicable and kept clean. ITEM 7, MANURE DISPOSAL. All manure shall be re- moved and stored or disposed of in such manner as best to prevent the breeding of flies therein, or the access of cows to piles there- of. ITEM 8. MILK HOUSE OR ROOM: CONSTRUCTION, There shall be provided a separate milk house or milk room for the hand- ling and storage of milk and the washing and bactericidal treatment of mijk a aratus and utensils, provided with a tight floor con- s rue •ed g� concre a or other :impervious material and graded to pro- vide proper drainage. The walls and ceilings of the milk pause or room shall be of such construction as to permit easy cleaning, and shall be painted at least once each year , or finished in a manner approved by the health officer. The milk house or room shall be well lighted and ventilated and all openings effectively screened to prevent the entrance of flies, and shall be used for no other purpose than the handling and storage of milk or milk products and j other operations incident thereto. The cleaning and other opera- tions shall be so located and conducted as to prevent any contamin- ation to the milk or to cleaned equipment. The milk room shall not open directly into a stable or into any room used for domestic pur- poses. ITEM 9. MILK HOUSE OR ROOM: CLEANLINESS AND FLIES. The floors, walls, ceilings and equipment of the milk-house or room shall be kept clean at all times. All means necessary for the elim.., ination of flies shall be used. ITEM 10. TOILET. Every dairy farm shall be provided with a sanitary toilet constructed and operated in accordance with the ordinances of the City of Jefferson, and the recommendations of the State Board of Health. ITEM 11. WATER SUPPLY. - The water supply shall be easily accessible, adequate, and of a safe, sanitary quality. 6 ITEM 12. UTENSILS CONSTRUCTION, All containers or utensils used in the handling or storage of milk products must be made of non-absorbent material and of such construction as to be easily cleaned, and must be in good repair. Joints and seams shall be soldered flush, All milk pails shall be of a small mouth design approved by the health officer, ITEM 13. UTENSILS CLEANING. All containers and other utensils used in the handling, storage, or transportation of milk and milk products must be thoroughly cleaned after each usage. ITEM 14. UTENSILS - BACTERICIDAL TREATMENT. All containers and other utensils used in the handling, storage or transportation of milk or milk products shall between each usage be treated with steam, hot water, or chlorine in a manner approved by the Health Officer. ITEM 15. UTENSILS STORAGE. All containers and othe: utensils used in the handling, storage, or transportation of milk or milk products shall be stored so as not to become contaminated be- fore again being used. ITEM 10. UTENSILS - HANDLING. After bactericidal treatment no container or other milk or milk product utensil shall be handled in such manner as to permit any part of the person or clothing to come in contact with any surface with which milk or milk products come in contact. ITEM 17. MILKING, UDDERS AND TEATS. The udders and teats of all milking cows shall be' olean at the time of milking. ITEM 18.. MILKING. FLANKS. The flanks, bellies and tails of all milking cows shall be free from visible dirt at the .time of milking. ITEM 19. MILKERS, HANDS. Milkerst hands shall be clean, rinsed with a bactericidal solution, and dried with a clean towel immediately before milking. Should the milking operation be interrupted, the milkerst hands must be again rinsed in the solut- ion. Wet hands milking is prohibited. Convenient facilities shall be provided for the. washing of milkerst hands. ITEM 20. CLEAN CLOTHING. Milkers and milk handlers shall wear clean outer garments while working. ITEM 21. MILK STOOLS. Milk stools shall be kept clean. ITEM 22. REMOVAL OF MILK. Each pail or can of milk shall be removed immediately to the milk house or straining room. No milk shall be strained in the dairy barn. ITEM 23. COOLING. Milk must be cooled within one hour after milking to 50 degrees fahrenheit, or less, and maintain- ed at or below that temperature until delivery, unless it is deliv- ered to a milk plant for pasteurization or separation, in which case it must be cooled or pasteurized within two hours of the time of, production. ITEM 24. BOTTLING AND CAPPING. Milk shall be bott- led from a container with a readily cleanable valve, or by means of a bottling machine approved by the health officer. Bottles may be capped by a machine or manually. In case a machine is used it shall be cleaned and disinfected before each usage. In case capping is done by hand the hands shall be disinfected in a manner approved by the health officer before the process of capping is begun and after any interruption. Caps shall be purchased in sanitary containers and kept therein until used. 7 ITEM 25. PERSONNEL. HEALTH CERTIFICATES. Every person connected with a dairy or milk plant whose work brings him in contact with the production, handling, storage , or transportation of milk, milk products, containers, or equipment, shall have within twelve months or less, as required by the health officer, passed a medical examination made by the health officer or by a licensed physician approved by the health officer, and shall submit such speoiments of bodily discharges as the hoalth officer may require. ITEM 26. NOTIFICATION OF DISEASE. Notice shall be sent to the health officer immediately by any milk producer or dis- tributor upon whose dairy farm or in whose milk plant any case of sickness or any infectious, contagious, or communicable disease occurs. GRADE "B" RAW MILK. Grade "B" Raw Milk is milk the average bacterial count of which at no time prior to delivery ex- oeeds 200,000 per cubic centimeter, or the average reduction time of which is not less than six (6 ) hours, and which is produced up- on dairy farms conforming with all the items of sanitation required for Grade "A" Raw Milk, except 2, 31 41 5 or 6, provided that clean- liness of the barn and the cow yard shall in no case be omitted. Item 23 shall apply except that the cooling temperature shall be changed to seventy (70) degrees Fahrenheit. GRADE "C" RAW TULK. Grade "C" Raw Milk is milk the average bacterial count of which at no time prior to delivery ex- ceeds 1,000,000 per cubic centimeter, or the average reduction time of which is not less than Zj hours, and which is produced on dairy farms conforming with all the items of sanitation required for Grade "BII Raw Milk. GRADE "D" RAW MILK. Grade ''D" Raw Milk is ravr milk which does not meet the requirements of Grade "C" Raw t1i.lk, and which shall be plainly labeled :*cooking only. " GRADE "All PASTEURIZED MILK. Grade Pasteurized Milk is Grade "A" or Grade IIB" Raw Milk which has been pasteurized, cooled, and bottled in a milk plant conforming with all of the fol- lowing items of sanitation and the average bacterial count of which at no time after pasteurization and until delivery exceeds 50,000 per cubic centimeter. ITEM 1. FLOORS. The floors of all rooms in which milk is handled shall be constructed of ooncrete or other equally imper- vious and easily cleaned material and shall be smooth, properly drained and provided with trapped drains, and kept clean. ITEM 2. WALLS AND CEILINGS. Walls and ceilings of rooms in which milk is handled or stored shall have a smooth, wash- able, light colored surface and be kept clean. ITEM 3. DOORS AND WINDOWS: All openings into the outer air shall be offectivoly screened to prevent the access of flies. Doors shall be self-closing. ITEM 4. LIGHTING AND VENTILGTION. All rooms shall be well lighted and ventilated. ITEM 5. PROTECTION FROM CONTI,MINATION AND FLIES. The various milk-plant operations shall be so located and conducted as to prevent any contamination to the milk or to the cleaned equip- ment. All means necessary for the elimation of flies shall be used. This requirement shall be interpreted to include separate rooms for (a) the pasteurizing, cooling, and bottling operations; (b) the wash- ing and bactericidal treatment of containers and equipment. Cans of raw milk shell not be unloaded directly into the pasteurizing room. 8 Pasteurized milk shall not be permitted to come into contact With equipment with which unpasteurized milk has been in contact. Rooms in which milk or cream or cleaned utensils or containers are hand- led or stored shall not open directly into any stable or living quarters. ITEM 6. TOILET FACILITIES. Every milk plant shall be provided with toilet facilities conforming with the ordinances of the City of Jefferson. There shall be at least one room or ves- tibule not used for milk purposes between the toilet room and any room in which milk or milk products are handled or stored. The doors of all toilet rooms shall be self-closing. Toilet rooms shall be kept in a clean condition, in good repair, and well ventil- ated. In case privies or earth closets are permitted and used, they shall be separate from the building and shall be of a sanitary type constructed and operated in conformity i-iith the ordinances of the City of Jefferson, and the recommendations of the State Board of Health. ITEM 7. WZTER SUPPLY. The water supply shall be eras, ily accessible, adequate, and of a safe, sanitary quality. ITEM S. WASHING FACILITIES, Washing facilities shall be provided, including hot running dater, soap, and sanitary towels of a type approved by the health officer. The use of a common towel. is prohibited. ITEM 9. MILK PIPING. Only "sanitary milk piping" of a type which can be easily cleaned with a brush shall be used. ITEM 10. CONSTRUCTION OF EQUIPMENT. All equipment with which milk comes in contact shall be constructed in such man- ner as to be easily cleaned. ITEM 11. DISPOSAL OF WASTES. All wastes shall be disposed of in conformity vith the requirements of the health of- ficer. ITEM 12. CLEANING LND BLCTERICIDAL TREATMENT OF CON- TAINERS AND APPI.RATUS. All milk containers end milk apparatus shall be thoroughly cleaned after each usage and subjected to a bacteric- idal treatment approved by the health officer immediately before each usage. ITEM 13. STORAGE OF CONTAINERS: +after bactericidal treatment all bottles, cans, and other containers shall be stored in such manner as to be protected from contamination. ITEM 14. HANDLING OF CONVJNERS AND .6PPLRATUS. Between bactericidal treatment and usage containers and apparatus shall not be handled in such manner as to permit any part of- the person or clothing from coming in contact with any surface with which milk or milk products come in contact. ITEM 15. STORI,GE OF CAPS. Milk-bottle caps shall be purchased and stored only in sanitary tubes and shall be kept therein until used. ITEM 16. PASTEURIZATION. Pasteurization shall be performed as described in Section 1-1 of this ordinance. The time and temperature record charts shall be dated and preserved for a period of 3 months for the information of the health officer. ITEM 17. COOLING. All milk not pasteurized within two hours after it is received at tho plant shall then be immediat- ely cooled to a temperature of 50 degrees Fahrenheit or lass and maintained thereat until pasteurized, and all pasteurized milk shall be immediately cooled to a temperature of 50 degrees Fahrenheit or less and maintained thereat until delivery. 9 ITEM 18. BOTTLING. Bottling shall be done at the place of pasteurization in automatic machinery approved by the health officer in such manner as to prevent any part of the person or clothing from coming in contact with any surface with which milk or milk products come in contact. ITEM 19, OVERFLOW MILK. Overflow milk shall not be sold for human consumption. ITEM 20, CAPPING. Capping shall be done by machin- ery approved by the health officer. Hand capping is prohibited. ITEM 21, TIME OF DELIVERY. Milk to be consumed in the form of whole milk shall be delivered to the final consumer' within sixty hours of the time of pasteurization. ITEM 22. HEALTH CERTIFICATES. Every person connect- ed with a milk plant whose work brings him in contact with the han- ' dling, storage or transportation of milk, milk products, containers, or equipment, shall have within twelve months or less as required by the health officer passed a medical examination made by the health officer or by a licensed physician approved by the health officer, and shall submit such specimens of bodily discharges as the health officer may require. ITEM 23. NOTIFICATION OF DISEASE. Notice shall be sent to the health officer immediately by any milk distributor in whose milk plant any case of sickness or any infectious, contagious, or communicable disease occurs. ITEM' 24. PERSONNEL-. GRADE "B" PASTEURIZED'MILK. ' Grade "B" Pasteuriz®d ., Milk is' Grade IfC'" Raw Milk which has been pasteurized, cooled, and bottled in a milk plant conforming with all of the requirements for. In case'. the applicant!.s existing low grade is 'due to a violation of an stem of, sanitation other than baoterial -cotut or temperature, said' applicatio must. be accompanied by a statement to the effect that the' violatedn' item of sanitation has 'been conformed with. , Within two weeks. of. the- receipt. of such an application the health officer shall make' a reinspeotion­bf, the applicant's 'estab- 10 lishment and, in oase the findings justify, shall award a regrade. At any time between regular announcements of milk �r grades the health officer shall lower the grade of any milk produc- er or distributor if as a result of inspections or milk analyses, a lower grade shall to justified in accordance with the terms of this ordinance. SECTION 9. TRANSFERRING OR DIPPING MILK; SALE OF MORE THAN ONE GRADE; DELIVERY OF MILK AT QUARANTINED RESIDENCES. No milk producer or distributor shall transfer milk or milk products from one container to another upon the street or in any vehicle or store, or in any place except a bottling or milk room especially used for that purpose, except as may be specially permitted by the health officer in the case of milk being delivered in bulk. The sale of dip milk is hereby expressly prohibited. All pasteurized milk shall be placed in its final delivery container in the plant in which it is pasteurized. It shall be unlawful for hotels, soda fountains, restaurants, and similar establishments to sell or serve any milk except in the original container in which it was received from the producer or distributor, provided that this re- quirement shall not apply to mixed milk drinks. If more than one grade of milk is sold by any dis- tributor separate receiving, pasteurizing, cooling, and bottling equipment shall be provided for each grade and the equipment for each grade shall be located in separate buildings or in separate rooms of the same building. The delivery of milk to and the collection of milk containers from quarantined residences shall be subject to the spec- ial requirements of the health officer. SECTION 10. MILK AND CREAM FROM POINTS BEYOND 9HE LIMITS OF INSPECTION OF THE CITY OF JEFFERSON CITY. Milk and cream from points beyond the limits of inspection of the City of Jeffer- son City may not be sold in the City of Sefferson unless produced and pasteurized under the provisions of this ordinance, except as may be authorized by the health officer in case of emergency. The limits of inspection are. The County of Cole and other territory not more than twenty (20) miles distant from the City of Jefferson City. Any milk producer or milk distributor be- yond these limits may submit to the provisions of this ordinance, provided such person request inspection by the health officer of the City of Jefferson City any pay for the services of such health of- ficer as provided in Section 119 SECTION 11. FEE FOR IITSPWTI ON BEYOND LIMITS' For each inspection, including testing and grading, made beyond the limits of inspection the health officer shall collect in advance from the person requesting same a fee of five dollars ($5.00) per day or part thereof together with five cents (5¢) for each mile travelled from Jefferson City to, and returning therefrom, the dairy farm or milk plant of such person in the course of making such inspection, and shall account to the Treasurer of the City of Jef- ferson City for such inspection fee and such health officer may re- tain said mileage fee. SECTION 12. SPITTING. No person shall spit in any part of any room, vehicle, or other place used for the sale, stor- age, handling, or transportation of milk. SECTION 13, VEHICLES. All vehicles used for deliv- ery of milk in the City of Jefferson City, or its police jurisdict- ion, shall be so constructed as to protect the milk from the sun and from contamination. Such vehicles shall be kept clean while used in transporting milk or milk products. No substance capable Of contaminating milk or milk products shall be transported with Milk or milk products in such manner as to permit contamination. SECTION 14. DENATURING MISBRANDED PRODUCTS. The health officer may denature with rennet or some harmless matter any milk or milk products found misbranded with respect to grading or sold without a permit, provided that if the conditions warrant the milk or milk products may be destroyed. SECTION 15. REPASTEURIZATION PROHIBITED. No milk or milk products shall be pasteurized more than once, except as may be specially permitted by the health officer. SECTION 15. FUTURE DAIRIES AND MILK PLANTS. All dairies and milk plants from which milk is supplied to the City of Jefferson City, which are hereafter constructed, shall conform in their construction to the requirements of the health officer, which shall not be less than the Grade "All requirements of this ordinance. SECTION 17. PEIZALTY. Any person who shall violate any provision of this' ordinance shall be fined not more than one hundred dollars ($100.00) , at the discretion of the Court. Each and every violation of 'the provisions of this ordinance shall constitute a separate offense. SECTION 18, REPEAL AND DhTE OF EFFECT. All ordinan- ces and parts of ordinances in conflict with this ordinance are hereby repealed ; and this ordinance shall be in full force and ef- fect immediately upon its adoption and its publication, as provided by law. SECTION 19. UNCONSTITUTIONALITY CLAUSE. Should any section, paragraph, sentence, clause, or phrase of this ordinance be declared unconstitutional or invalid for any reason, the remain- der of said ordinance shall not be affected 'thereby, SECTION 20. OFFICE OF H&LTH OFFICER CREATED, SAMEY, EXPENSES AND LABORATORY. The office of Health Officer of the Qity of Jefferson City is hereby created. The health officer shall be appointed for a term of one year by the mayor with the consent and approval of a majority of the city council. The salary of the health officer shall be fifteen hundred dollars ($1,500.00) per an- mum and in addition thereto he shall receive not more than Twenty- five dollars ($25.00) per month toward payment of his necessary ex- penses. The city council shall provide him with proper laboratory equipment and supplies. Said health officer shall be approved by the Department of Dairying of the Missouri State University. SECTION 21. DUTIES OF HFi,LTH OFFICIA. It shall be the duty (..� the health officer to enforce the provisions of the ox- dinanoes contained in this chapter and to perform the functions therein detailed and others which the council may from time to time prescribe by ordinance.
