® ORDINANCE TO VACATE A PLATTED ALLEY SITUATED
IN GREENCASTLE, PUTNATNI COUNTY, INDIANA
WHEREAS, a Petition has been filed to vacate a certain
public way, more particularly described below; and,
WHEREAS, pursuant to I.C. 36- 7 -3 -12 and I.C. 5 -3 -1, a public
hearing on the Petition and Ordinance was conducted by the
Greencastle Plan Commission on the 22nd day of June, 1998;
WHEREAS, by unanimous vote, the Greencastle Plan Commission
recommended passage of the Petition by the Common Council and,
state law
WHEREAS, all legal notices reauired by applicable
having been given including notice by Certified Mail to adjoining
property owners:

BE IT ORDAINED BY THE COMMON COUNCIL OF GREENCASTLE
INDIANA, that the following public way is hereby vacated and the
Petitioners are hereby ordered to furnish the Putnam County
Recorder with a copy of this Public Way Vacation Ordinance for
recording and a second copy be furnished to the Putnam County

Auditor:
•
An alleyway 12 feet of equal width between Lots One
(1), Two (2), Three (3), Four (4), Five (5), Six (6),
Seven (7) and Eight (8) in Block Five (5) of Silvers
Survey of Lots Fifty -four (54), Fifty -five (55) and
Fifty -six (56) of Railroad Enlargement to the town, now
city of Greencastle, Putnam County, Indiana, as the
same appears of record on the Plat on file in the
Office of the Recorder of Putnam County, Indiana, at
Plat Book 1, Page 192; but excepting therefrom that
portion of the North /South alleyway which intersects
the above described and herein vacated East /West
alleyway.
Subject to the City of Greencastle having an easement
for utility purposes.
This Ordinance shall be effective immediately upon its
passage, and shall be recorded in the Putnam County Records as
required by 1aa.
