• RESOLUTION SUPPORTING CITIZEN ACTION
TO REMOVE DEED RESTRICTION ON PROPERTIES
NEAR THE INTERSECTION OF RUFE SNOW DRIVE
AND TEXAS STATE HIGHWAY NUMBER 26
WHEREAS, the City of Richland Hills does not presently have afull-service grocery
store in its City limits and, as a result, residents have been forced to travel to neighboring cities
in order to find a full array of grocery products and or provisions; and
WHEREAS, the City Council believes that the presence of afull-service grocery store
within the city limits would enhance the quality of life for many residents of the City of Richland
Hills; and
WHEREAS, up to 30 to 50% of grocery store sales may be subject to state and local
sales taxation, and such tax revenue would allow the City of Richland Hills to enhance the
services it currently provides to its residents; and
WHEREAS, the presence of a foil-service grocery store often encourages and facilitates
the development of other sales tax-generating restaurants and in-line retail tenants; and
WHEREAS, Richland Hills' economic development efforts have resulted in private
• developer interest in and around the present Sam's Furniture & Appliance building, which served
as a Safeway grocery store location for many years; and
WHEREAS, existing deed restrictions placed on the adjoining parcels in the early 1950s
prohibit the sale of beer and wine products, in contrast to Richland Hills' citizens passage of a
referendum approving the sale of such products in November 2000; and
WHEREAS, grocery stores considering redevelopment sites in Richland Hills need the
additional revenues provided through the sale of beer and wine products to compensate for
additional project costs incurred through the assemblage of surrounding properties; and,
WHEREAS, at least 75% of the property owners living in the subdivision adjacent to the
former Safeway site will need to sign a petition waiving the existing deed restriction prohibiting
the sale of beer and wine beverages;
NOW, THEREFORE, BE IT RESOLVED THAT the Councilmembers of the City of
Richland Hills do hereby:
1. Support all efforts to develop agrocery-anchored retail center at SH 26 and Rufe Snow
Drive, thereby providing grocery-type sales in the City and generating sales tax revenues
for the City;

2. Endorse the effort to collect sufficient signatures on the deed restriction waiver
• documents so beer and wine may be sold in the proposed new grocery store; and
3. Encourage all residents within the affected subdivision to sign the above-referenced
petition and to encourage their friends and neighbors to also support the effort, in order to
encourage and support the return of afull-service grocery store to the City of Richland
Hills.
