HomeMy Public PortalAboutResolution No. 214-04 10-26-2004 • RESOLUTION NO. 214-04 A RESOLUTION OF THE CITY OF RICHLAND HILLS, TEXAS AUTHORIZING THE MAYOR OR CITY MANAGER TO EXECUTE A PETITION SUPPORTING THE DELETION OF CERTAIN DEED RESTRICTIONS APPLICABLE TO BLOCKS A TO H INCLUSIVE, BEING A REVISION OF LOTS 10 TO 21, BLOCK 22, AND BLOCKS 28 TO 32, INCLUSIVE, OF THE RICHLAND HILLS ADDITION TO THE CITY OF RICHLAND HILLS; PROVIDING FOR NOTICE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, on or about September 24, 2004, pursuant to Texas Property Code Chapter 201, and specifically pursuant to Texas Property Code Section 201.005, a petition committee has been formed to delete one of the existing restrictions, specifically, the existing restriction against the sale of spiritous, vinous, or malt liquors, beers, or other intoxicants, applicable to all or portions of the following described property: Blocks A to H inclusive, being a revision of Lots 10 to 21, Block 22, and Blocks 28 to 32, inclusive, of the Richland Hills Addition to the City of Richland Hills, Tarrant County, Texas; which restrictions are contained in an instrument filed in the Deed Records of Tarrant County on or • about November 3, 1948, which instrument is recorded as Instrument Number. 44224, recorded at Volume 388-C, of the Plat Records of Tarrant County, Texas, beginning at page 154; and WHEREAS, the City of Richland Hills owns Lots 7 & 8, Block F, Richland Hills Addition, Richland Hills, Texas, which is property in the above referenced subdivision; and WHEREAS, the City of Richland Hills believes that the deletion of the deed restriction as requested by the above-referenced committee would encourage economic development and be in the best interests of the City; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RICHLAND HILLS, TEXAS: SECTION 1. ORDER The City Council hereby orders that either the Mayor or the City Manager are authorized and directed to execute and record in the deed records of Tarrant County, Texas, a petition on behalf of the City of Richland Hills, Texas to delete one of the existing restrictions, specifically, the existing restriction against the sale of spiritous, vinous, or malt liquors, beers, or other intoxicants, applicable to all or portions of the following described property: • • Blocks A to H inclusive, being a revision of Lots l0 to 21, Block 22, and Blocks 28 to 32, inclusive, of the Richland Hills Addition to the City of Richland Hills, Tarrant County, Texas; which restrictions are contained in an instrument filed in the Deed Records of Tarrant County on or about November 3, 1948, which instrument is recorded as Instrument Number. 44224, recorded at Volume 388-C, of the Plat Records of Tarrant County, Texas, beginning at page 154; SECTION 2. INCLUSION OF CITY PROPERTY IN AREA TO BE AFFECTED BY PETITION The Mayor or the City Manager are directed to exercise any option to include such City owned property in the area to which the modification is to be effective, and not to attempt to exempt such property from the effect of such modification. SECTION 3. NOTICE Upon adoption of this Resolution, the City Secretary is directed to give notice of this resolution in the manner required by law. SECTION 4. • AUTHORIZATION OF NECESSARY ACTIONS The Mayor, City Manager, and the City Secretary, in consultation with the City Attorney, are authorized and directed to take all actions necessary to effectuate this resolution. SECTION 5. EFFECTIVE DATE This Resolution shall be effective upon its adoption. Passed and approved this 26th day of October , 2004.
