HomeMy Public PortalAboutResolution No. 240-05 10-11-2005 • RESOLUTION N0.240-OS A RESOLUTION OF THE CITY OF RICHLAND HILLS, TEXAS AMENDING THE RULES OF PROCEDURE GOVERNING THE PROCEEDINGS OF THE CITY COUNCIL; PROVIDING FOR NOTICE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council has previously adopted rules of procedure governing the proceedings of the Council in order to more effectively conduct the business of the City; and WHEREAS, the City Council has determined that additional rules governing the reconsideration of questions and actions taken by the Council are needed; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CI"I'Y OF RICHLAND HILLS, TEXAS: SECTION 1. ORDER 'The City Council hereby adopts the following addition to the Rules of Procdure for conducting City Council. meetings. This policy is in addition to those Rules of Procedure previously approved and adopted by the City Council on or about March 13, 2001: • 9. RECONSIDERATION OF ITEMS a. The City Council will reconsider an action taken only as provided herein. Only a council member who voted with the majority on any item may make a motion to reconsider. A motion to reconsider any action of the city council must be made not later than the next succeeding official regular meeting of the city council. If a motion to reconsider is made at the meeting at which the action to be reconsidered was taken, such a motion can be made, seconded, debated, and acted upon even though it is not on the formal agenda. b. If a motion to reconsider is not made at the meeting at which the action to be reconsidered was taken, then a council member who voted with the majority who wishes to reconsider the action may request the City Manager to add the motion to reconsider to the agenda for the next regularly scheduled meeting, or for a special meeting to be held prior to the next regularly scheduled meeting. A motion to reconsider may be seconded by any member of the Council. • c. The affirmative vote ofseventy-five percent of the Council members present (excluding any members who recuse themselves or who or disqualified from • voting) shall be required for any motion to reconsider to carry. d. No question shall be reconsidered twice except by unanimous consent of the Council. e. If the Council votes to reconsider any matter which requires either notice by publication or a public hearing, an affirmative vote in favor of a motion to reconsider shall have the effect of setting the matter for the next available Council meeting consistent with compliance with applicable notice requirements, and the City staff shall again comply with all applicable notice requirements. SECTION 2. REMAINDER OF RULES UNCHANGED The Rules of Procedure previously approved and adopted by the City Council on or about March 13, 2001, except to the extent amended herein, shall remain unchanged. SECTION 3. NOTICE Upon adoption of this Resolution, the City Secretary is directed to give notice of this • resolution in the manner required by law. SECTION 4. AUTHORIZATION OF NECESSARY ACTIONS The Mayor and the City Secretary, in consultation with the City Attorney, are authorized and directed to take all actions necessary to effectuate this resolution. SECTION 5. EFFECTIVE DATE This Resolution shall be effective upon its adoption. Passed and apprp, fed this 1 T'`" day of October 2005.
