HomeMy Public PortalAboutOrdinance 62-69ORDINANCE NO. 62 -69 AN ORDINANCE OF THE CITY OF TEMPLE CITY, CALIFORNIA, REGULATING THE MAINTENANCE OF SWIMMING POOLS AND FENCING THEREOF. THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES ORDAIN AS FOLLOWS: SECTION 1. The Municipal Code of the City of Temple City is hereby amended by adding thereto Sections 5103 through 5111, which sections shall read as follows: "SECTION 5103. It shall be the duty of the City Mana- ger to enforce the provisions of this ordinance. "SECTION 5104. Every person, firm or corporation in possession of land within the City of Temple City either as owner, purchaser under contract, lessee, tenant or licensee, upon which is situated a swimming pool or outside body of water having a depth of over eighteen inches (18 ") shall main- tain on the lot or premises upon which said swimming pool or body of water is situated, a fence or wall not less than five (5) feet in height above ground level at all places, with openings, holes or gaps therein no larger than four (4) inches in any dimension except for doors or gates; provided, however, that if a picket fence is erected or maintained, the hori- zontal dimension between pickets shall not exceed four (4) inches. Said fence or wall shall completely enclose such pool or body of water. A residential structure or accessory building may be used as part of such enclosure. No fence or wall shall be erected or maintained that affords ladderlike access. All gates and doors shall be self - locking and self - latching by means of a device located not less than four and one -half (4) feet above the ground. Any door which shall open directly from a garage to the area in which a swimming pool or body of water is located, when the garage door itself is opened, shall be self- locking and self - latching. "SECTION 5105. All swimming pools or bodies of water within the City of Temple City shall be so maintained as to not cause any public health hazard, including, but not limi- ted to, the creation of mosquitos. "SECTION 5106. In the event the City Manager, or the County of Los Angeles Health Department, as an agency of the City of Temple City, shall determine the maintenance of any swimming pool or body of water constitutes ,a health hazard, the owner and /or occupant of the premises on which the partic- ular swimming pool or body of water is located shall be given notice in writing at the address of the swimming pool or body of water to correct the situation within five (5) days. If the owner or occupant of the premises shall fail to correct the situation within the said five -day period, the City Mana- ger may cause the necessary correction to be made and the owner and the occupant shall both be liable to the City of Temple City for any expense incurred and expense unpaid for, and the City of Temple City may institute proceedings against both the owner and occupant for immediate payment and may in the alternative charge the expense as a lien against the real property upon which the swimming pool or body of water is located, and in the event of non- payment cause the real prop- erty to be sold in like manner as for any failure to pay real property taxes. 1 177 1 "SECTION 5107. All plans for construction of swimming pools or body of water shall show compliance with this ordi- nance. Final inspection and approval of all swimming pools or bodies of water shall be withheld until all requirements of this ordinance have been met. "SECTION 5108. All requirements of this ordinance shall apply to existing swirmithg pools and outside bodies of water. Compliance shall be made within ninety (90) days from the ef- fective date of this ordinance. "SECTION 5109. A permit shall be secured from the City of Temple City for the installation of any fence or wall re- quired by this ordinance prior to erection, and shall conform to all City regulations pertaining to buildings or structures. "SECTION 5109. Any fence or wall erected for the pur- pose of complying with this ordinance shall conform to all, zoning regulations of the City of Temple City, provided, further that no swimming pool or outside body of water shall be constructed where protective fencing required by this or- dinance will be in conflict with said zoning regulations. "SECTION 5111. When practical difficulties, unnecessary hardships or results inconsistent with the general intent and purpose of this ordinance occur by reason of strict interpre- tation of any of its provisions, the Planning Commission, upon its own motion may, or upon the verified application of any interested person, shall' initiate proceedings for considera- tion of the granting of a deviation from the requirements of this ordinance."
