HomeMy Public PortalAbout1998-07 City CodeORDINANCE # 1998 -7 AN ORDINANCE AMENDING §845 and §8-47 OF THE GREENCASTLE CITY CODE, AND DELETING §8-42, §843, §844 and §846 OF THE GREENCASTLE CITY CODE BE IT ORDAINED AND ADOPTED by the Common Council of the City of Greencastle, Indiana, that §8-45 and §8-47 of the Greencastle City Code is hereby amended to read as follows: Sec. 8-45 Schedule of Leased Parking Space Zones. Schedule of Leased Parking Space Zones. Location Jackson Street Municipal Parking Lot Located on North Jackson Street Immediately north of the Banner - Graphic Building at 100 North Jackson Street. • Sec. 8-47 Leasing of Parking Spaces in Municipal Parking Facilities. a, An application for a leased parking space in a designated municipal parking facility shall be submitted to the Clerk- Treasurer on forms provided by the Clerk- Treasurer, along with the parking space fee specified in Subsection "b ". b. The fee and time period leased for a leased parking space is as follows: One (1) month lease - $15.00. 2. One (1) year lease - $150.00 3. From 6:00 A.M until 6:00 P.M. c. The Clerk- Treasurer shall: 1. review each application for a leased parking space in a designated municipal parking facility, determine whether the requirements for the leasing of parking spaces specified in Subsection "d° have been met, and either approve the application, with or without conditions, approve the application pending the availability of a leased parking space, or disapprove the application, 2. specify for all parking space lease agreements reasonable terms and conditions, which shall be incorporated into each parking space lease agreement, • 3. specify the nature, form, and content of the permit that will be issued to each parking space lessee and the manner and location in which the permit must be displayed on or in a lessee's vehicle, " and 4. adopt such additional rules and regulations as may be necessary to implement efficiently and effectively the policy of the City to lease parking spaces in designated municipal parking facilities for extended period of time. d. A parking space may be leased by the City in a designated municipal parking facility if the following requirements are met: 1. The applicant and members of the applicant's household are not liable for any outstanding parking violation assessments. 2. The applicant was not the lessee under any previous parking space lease agreement that was revoked by the City because of a violation of the terms and conditions of the agreement or rules and regulations. e. Upon the approval of an application for a leased parking space, the clerk- treasurer shall: enter into a parking space lease agreement with the applicant on behalf of the City, 2. issue a permit to the parking space lessee for display in or on the vehicle or vehicles that may be parked pursuant to the parking space lease agreement, 3. forward a copy of the lease agreement to the Police Department, and The Police Department shall: " 1. designate by appropriate signs, pavement, wall, or curb markings, or both the parking spaces in a designated municipal parking facility that have been leased and are reserved for the exclusive use of parking space leases, and 2. identify clearly each leased parking space in such a manner as to enable each parking space lessee to know with certainty which specific parking space or spaces the lessee is entitled to use. g. The Clerk- Treasurer may revoke a parking space lease agreement for any of the following reasons: 1. Violation of one (1) or more terms of conditions of the lease agreement. 2. Violation of any additional rules or regulations adopted by the Board. h. A parking space lessee may terminate a parking space lease agreement at any time by surrendering to the Clerk- Treasurer the parking permit issued pursuant to the lease agreement or by delivering to the Clerk- Treasurer written notice of termination of the lease agreement by the lessee. i. Upon the revocation or termination of a parking space lease agreement before the expiration date of the lease agreement, the Clerk- Treasurer shall refund to the lessee a prorated amount of the parking space lease fee paid by the lessee. The prorated amount shall be determined by multiplying the percentage of time remaining before the expiration of the lease agreement times the parking space lease fee paid, but in no event shall the refund exceed fifty percent (50 %) of the parking space lease fee paid. j. Any vehicle that is stopped, stood, or parked in a leased parking space of a municipal " parking facility, which is not permitted to be parked in the space pursuant to a parking space lease agreement and /or does not display the proper permit authorizing the vehicle to be parked in such space, " is subject to a parking violation assessTent of not rnor e than one hundred dollars ($100.00) in favor of the City. BE IT ORDAINED AND ADOPTED by the Common Council of the City of Greencastle, Indiana, that �8-42, �8-43, �8-44 and � 8-46 of the Greencastle City Code is hereby deleted from the Greencastle City Code as they are no longer necessary as there are no parking meters within the City of Greencastle.
